  • The State Trials of Louis XVI & Marie-Antoinette

      Abstract: Marie-Antoinette, born in Austria in 1755, at the age of 14 was married to the 15 year old Dauphin of France, the future Louis XVI. In January 1793, Louis was tried and executed. Nine months later, Marie-Antoinette was also tried and executed. This account compares the fairness of their separate trials. Louis received the fairer trial, even fairer than that of the English king, Charles I, a century earlier, whose trial is briefly outlined at the end of this account. At least in the trial of Louis, there was an attempt to pursue the rule of law, assisted by the distinguished role of his three defence counsel. The two defence counsel of Marie-Antoinette also deserve to be remembered for their role.

  • The United States Film, Music and Pharmaceutical Industries’ Battle for
           International Copyright and Patent Protection and Enforcement

      Abstract: There is tension in international intellectual property policy between less protection and more protection. The United States, a champion of expansion, plays a major role. It has contributed in multiple law-making forums. This article outlines the progress that the United States has made to further its interests in the global intellectual property law arena, both in law-making and in enforcement. It also discusses the interplay between these developments and the role of large corporations in private industry with a strong interest in intellectual property. It focuses on the film, music and pharmaceutical industries and specifically on copyright and patent laws. Albeit slow, the trend appears to be in favour of United States’ interests.

  • Achieving better outcomes for Chinese law students studying overseas

      Abstract: The internationalization of tertiary education has resulted in an influx of Chinese students studying in Australia. This movement brings invaluable advantages to Chinese law students studying overseas as well as challenges to host universities and their teaching staff. Much of these relate to social, cultural and educational differences, which have not been adequately acknowledged by the current teaching methodologies of host university law schools.This article discusses the main difficulties experienced by Chinese law students and the main efforts that have been made to help them overcome their difficulties. Although efforts to improve the situation have been made by host and home institutions through support programs and adjustments in teaching methodologies, the challenges experienced by Chinese law students persist. This article therefore recommends new approaches that may help Chinese students achieve better learning outcomes overseas.
