      La retirada del Reino Unido de la Unión Europea es una cuestión de máxima actualidad que ha sembrado de incertidumbres a los estudiosos, por tratarse de un objeto de análisis insospechado hasta el anuncio por parte del primer ministro británico de la realización de un referéndum sobre esta cuestión. Las negociaciones en las que se articulará la futura relación entre la organización y el Estado que no desea seguir participando en ella como miembro pondrá a prueba la fortaleza de la Unión Europea. En este trabajo intentamos entender los factores que han rodeado al Brexit, así como las eventuales consecuencias del mismo, siendo conscientes de que aún no se han iniciado las negociaciones que concluirán con el modelo relacional futuro. En todo caso, nuestra intención es identificar algunos ámbitos materiales que se verán afectados por ellas sin aportar más soluciones que las que nos permita el análisis jurídico de la situación en presencia. The British withdrawal from the European Union is an extremely topical issue, casting doubts in the scholars as we are facing a new subject that had been unsuspected until the Prime Minister of the United Kingdom announced a referendum on the country's permanence in the Union. The negotiations on the future relationship of the United Kingdom and the European Union will test the strength of the Organization in front of the leaving country. This paper addresses the main factors surrounding the Brexit decision and its eventual implications, bearing in mind that the negotiations have not yet begun. In any case, it is the authors’ purpose to identify some policy areas which will be necessarily affected in this process, without providing more solutions than those arising from the legal analysis of the given situation.

  • La influencia “artística” de las emociones y la empatía en el
           contenido, la interpretación y la efectividad del derecho internacional

      Las emociones integran una de las dimensiones de las experiencias y actividades humanas, y ello explica su posible incidencia en la interacción de distintos actores con el derecho internacional, que es una construcción social en cuya evolución y creación han incidido no sólo argumentos racionales sino además posturas emotivas, que en la práctica pueden incidir no sólo en la creación, sino, además, en la interpretación o invocación e incluso en la efectividad y legitimidad de aquel derecho, máxime cuando tanto las emociones como el derecho internacional ofrecen lenguajes mundiales. Ello explica el empleo de distintas estrategias emotivas, formales o no, jurídicas y extrajurídicas, como el cine, el arte o actividades lúdicas, por parte de quienes interactúan con el derecho internacional, en tanto los discursos jurídicos con tintes emotivos pueden hacer a sus destinatarios más proclives a acoger sus discursos, que al entrañar un intento de transmitir emociones pueden calificarse de “artísticos”. Estos discursos acarrean riesgos cuando procuren desconocer derechos de minorías pero ofrecen la promesa de “humanizar” el derecho si se fundamentan en la empatía, que al llevar al intérprete a asumir la posición de las víctimas puede identificar sus necesidades de protección jurídica tanto en la lex lata como en la lex ferenda. emotions are part of the multiple dimensions of human experience and activities. International Law, as a social construction, is thus prone to be subject to its influence. Such influence can be channeled by different participants which interact with that law in processes of legal creation, invocation or interpretation, taking advantage of the universal language of international law and enhancing their discourses with emotional overtones. Furthermore, certain emotional strategies, with can either employ legal or extra-legal vessels as movies, art or games can either generate empathy, promoting changes in normative contento or action in order to have solidarity with those who suffer; or to increase or affect the effectiveness of international law.

      A partir del año 2011, la implementación de los Principios Rectores de la ONU sobre las empresas y los derechos humanos por los Estados se ha medido principalmente a través del desarrollo y adopción de planes de acción nacional. Este enfoque, que pone en el centro de las herramientas de internalización del derecho internacional a las políticas públicas, requiere un examen cuidadoso, debido al enfoque mayoritario en medidas no vinculantes (en oposición a la legislación, regulación e interpretación judicial) y que sirven para coordinar los esfuerzos del sector público. Ante ello, se analiza la efectividad de las políticas públicas sobre empresas y derechos humanos como herramientas para dar efectividad al derecho internacional a nivel interno. Since 2011, the implementation of the UN Guiding Principles on Business and Human Rights by States has been measured particularly through the development and adoption of National Action Plans. This approach, focused on the use of public policy as a tool for the domestic application of international law, requires a thorough examination, due to the primordial focus on non-binding measures that aim to coordinate the efforts of public administration (as opposed to legislation, regulation and judicial interpretation). Thus, this article analyzes the effectiveness of public policies on business and human rights as tools to give effect to international law in the domestic sphere.

  • The Close Relationship Between Serious Human Rights Violations and Crimes
           Against Humanity: International Criminalization of Serious Abuses

      This article aims to evidence both the existence of a close relationship between the notions of serious human rights violations and crimes against humanity, and how this works in international law. To do so, international legal sources such as the United Nations practice, case-law of international and hybrid criminal courts and tribunals, and case-law of the Inter-American Court of Human Rights and other human rights bodies are taken into account. Thus, this article analyses how these and other international sources have examined the above-mentioned relationship, i.e., inter alia the similarities and differences between serious human rights abuses and the legal objective and subjective elements of crimes against humanity. Accordingly, it is found that, although some differences exist, the notion of serious human rights violations underlies the legal concept of crimes against humanity. In turn, this is linked to the relationship between those two categories of international law.

      De la firma del Estatuto de Roma de la Corte Penal Internacional por parte de México, derivan compromisos implícitos y explícitos que es necesario cumplir. De una parte, la obligación de tipificar, en el ámbito interno, los delitos competencia de la Corte y, de la otra, la obligación explícita de contar con disposiciones internas que permitan sancionar los delitos cometidos contra la administración de justicia en procedimientos efectuados en la Corte o en conexión con ella y que también permitan asegurar los procedimientos aplicables a todas las formas de cooperación previstas en el Estatuto. El presente trabajo explora las diversas formas en que los Estados han procurado cumplir con estas obligaciones y propone las vías que serían más factibles en el caso de México, haciendo especial referencia los crímenes de genocidio, lesa humanidad y de guerra. Mexico's signature of the Rome Statute of the International Criminal Court, derive implicit and explicit commitments that must be met. On the one hand, the obligation to define, in the domestic sphere, crimes jurisdiction of the Court and, on the other, the obligation to have in place provisions penalizing offenses against the administration of justice in procedures performed at court or in connection with it and also allow secure procedures applicable to all forms of cooperation envisaged in the Statute. This paper explores the various ways in which States have sought to fulfill these obligations and proposes ways that would be more feasible in the case of Mexico, with particular reference to the crime of genocide, crimes against humanity and war crimes.

  • L’Emprise du Droit International sur la Violence Physique

      This paper aims to develop a brief analysis of the treatment and determination of physical violence by international law. For this, we present a study of this delimitation in different international treaties on this issue. We use qualitative and quantitative analysis criteria, as well as the universal and relative criteria, based on the intensity of the suffering, in the determination of victims and perpetrators, among other factors. Ce document a pour but développer une brève analyse du traitement et de la détermination de la violence physique par le droit international. Pour cela, nous présentons une étude de l’approche introduite par différents traités internationaux sur cette question. Pour l’analyse, nous avons fait l’utilisation des critères qualitatifs et quantitatifs, ainsi que les critères universels et relatifs, en fonction de l’intensité de la souffrance, de la détermination des victimes et des auteurs, entre autres facteurs.

      En el presente artículo analizaremos unos de los tribunales regionales de protección de los derechos humanos más desconocidos en el mundo occidental: el Tribunal Africano de Derechos Humanos y de los Pueblos (TADHP). Si bien fue creado en 2004, no ha sido sino en los últimos años cuando ha llevado a cabo una incontestable tutela de los derechos humanos en África, actitud que ha dado lugar a que, pese a los arduos retos que aún ha de afrontar, tanto la sociedad civil como organismos pro derechos humanos y académicos hayan puesto sus esperanzas en esta institución en aras de acabar con la impunidad que azota dicho continente, siguiendo los pasos de sus continentes hermanos: América y Europa. In this article we will analyze one of the less known regional courts of human rights protection to the western world: the African Court on Human Rights and People's Rights (AfCHPR). Although it was created in 2004, it was not until recent years that it has irrefutably protected human rights in Africa. This attitude has caused, despite the difficult challenges to be faced, that both the civil society as well as pro human rights and academic bodies to put their hope in this institution in order to end the impunity that reigns in said continent, following the steps of its sibling continents: America and Europe.

      Este trabajo se centra en el interés superior del menor frente a los riesgos epigenéticos derivados de los contratos de gestación por sustitución. Se defiende la necesidad de contar con un convenio de protección de derechos humanos ad hoc para la gestación por sustitución. Dicho Convenio debería inspirarse en la teoría del justo equilibrio de los distintos intereses en juego, como viene desarrollando el Tribunal Europeo de Derechos Humanos en casos recientes: Labasse y Menesson con Francia y Paradiso y Campanelli contra Italia. Aun cuando las cuestiones epigenéticas no se plantean en dicha jurisprudencia su invocación responde al deseo de que el interés superior del menor sea considerado en relación con su derecho a la identidad como parte de su vida privada, como hasta ahora, pero, además, en atención a la efectiva protección de su derecho a la salud. The analysis here developed focuses on the examination of the epigenetic risks for the health of children born through commercial surrogacy. It is defended the urgent need for an International Convention on human rights ad hoc for gestation by commercial surrogacy. To this aim we propose as inspiration for international legislator the theory of the right balance of different interests at stake, as it has been developed for decades by the European Court of Human Rights: Labasse and Menesson against France and Paradiso and Campanelli against Italy. Whereas epigenetics are not invoked in those judgments we consider relevant for our analysis as we defend that the superior interest of the child should be considered as regards the right to personal identity under the right to private life, as it is presently, but also linked to the right to health of children born through gestation by commercial surrogacy.

      La región sudamericana es la más afectada en el mundo en materia de demandas arbitrales referentes a inversiones privadas. El foro más acudido en la materia es el CIADI, dependiente del Banco Mundial, sin embargo, no es el único. En nuestra región, se ha venido avanzando en negociaciones sobre un mecanismo de solución de controversias dentro de la Unasur. El siguiente es un trabajo centrado en algunos aspectos problemáticos del régimen de protección de inversiones y del sistema de arbitraje y su comparación con proyectos para la creación de un Centro de Solución de Controversias en Materia de Inversiones de la Unasur, actualmente en negociación. The South American region is the most affected area in the world in terms of arbitration claims relating to private investments. Attended the forum on the subject is the ICSID of the World Bank, however is not the only one. In our region, the negotiations on a dispute settlement mechanism within the UNASUR, had been developed. The following is a work focused on some problematic aspects of the protection of investment and the arbitration system, with its comparison with projects for the creation of a Centre for Dispute Settlement on Investment of UNASUR currently under negotiation.

      The present article contains a detailed analysis of the draft protocol on the creation of a court of justice of Mercosur. The analysis focuses on several institutional as well as procedural aspects, while putting the draft protocol in the general context of current supranational law. The objective is to demonstrate that the draft protocol must be regarded as the result of a sophisticated work of comparative law, which incorporates valuable legal contributions based on the experience gained in integration processes launched both in Europe and Latin America. In order to better explain where these legal contributions originate from, what they consist in, as well as to describe the current stage of evolution of regional economic integration in its supranational format, the analysis refers to the rules in force in the other integration systems, more specifically, the Andean Community, the Central American Integration System, the European Free Trade Association and the recently established Eurasian Economic Union.

      Este artículo pretende evidenciar el renovado debate sobre las causales de exclusión de ilicitud en la responsabilidad internacional del Estado en materia de compromisos económicos y, particularmente, realizar un aporte al entendimiento del concepto de estado de necesidad. Para ello, se acude a un conjunto particular de casos en el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones. En este sentido, el análisis jurídico de este trabajo se construye con base en la distinción de la fuente a partir de la cual se invoca el estado de necesidad y en los efectos de esta diferenciación en cuanto a la carga de la prueba de la necesidad, al interés esencial del Estado que se ve afectado, al cálculo de daños y a la anulación de ciertos laudos por la incorrecta aplicación de tal causal. The article studies, from the concept of necessity developed by international law, the developing debate of the state of economic necessity and the way it operates as a circumstance precluding wrongfulness in the doctrine of Responsibility of States for Internationally Wrongful Acts. The article analyses the developments on the topic in the ICSID. The study aims to contribute in the debate on the effectiveness of circumstances precluding wrongfulness in the presence of the State's financial commitments and tries to make a contribution to the understanding of “necessity”. The article intents to identify the legal effects when invoking the doctrine of necessity, such as the burden of proof of the necessity, the identification of a essential interest of the State that is affected, its effects on the calculation of damages and the annulment of certain awards by the misapplication of such doctrine.

The essay studies the recognition of States, assessing its repercussion in the international community. Firstly, the study seeks to survey the theory and to explain its historical itinerary. It observes State practice on the act of recognition and the international legal instruments which define the requirements of a State, such as the Montevideo Convention. In this context, it investigates the phenomenom of the fragmentation of international subjectivity of States and its effects upon the creation of new territorial entities. Lastly, in light of the Kosovo case and the Advisory Opinion of the International Court of Justice, it is understood that the recognition of new States is governed by rules that are not entirely abided by the members of the international community.

      En la investigación se considera que los acuerdos megarregionales de libre comercio pueden convertirse en instrumentos de las grandes potencias para incidir en la generación de la nueva normatividad del comercio global. En la primera parte del trabajo se analiza el origen de los acuerdos megarregionales (especialmente en los casos del TPP y el TTIP) y sus características generales. En la segunda parte de la investigación, se describen las características de un proyecto de integración megarregional de China: la Iniciativa Cinturón y Ruta (CYR). Se analiza el alcance geopolítico y geoeconómico del CYR, su importancia para el proceso de reforma económica en China y la relevancia del CYR para la gobernanza del sistema mundial de comercio. This research considers that the mega-regional free trade agreements could become the great powers instruments to influence the generation of new norms for global trade. The first part of the research analyzes the origin of the mega-regional free trade agreements (especially the TPP and TTIP) and its general characteristics. The second part of the research analyzes the characteristics of the China's mega-regional integration project: the Belt and Road (B&R) initiative. It analyzes the geopolitical and geo-economics scope of B&R, its importance for the China's economic reform process and the B&R's relevance for the global trade governance.

      A presente pesquisa investiga se existe um fundamento para afirmar que existe um dever de cooperação internacional ou se a colaboração é apenas um ato de cortesia entre os Estados. Esse trabalho busca fundamentar tal dever na teoria moral deontológica da tradição kantiana para mostrar que a sua concepção da razão prática impõe um dever de cooperação internacional. A hipótese deste trabalho é que existe um dever tanto moral quanto jurídico de cooperação internacional. Para a construção deste argumento, verifica-se como a ideia de dever ético se articula na direção da ação política e que é possível transpor o edifício ético kantiano para as relações internacionais através do desenvolvimento de um cosmopolitismo moral e jurídico. Por fim, verifica-se que o desdobramento contemporâneo de alguns desses preceitos pode sustentar um dever de cooperação internacional por parte dos Estados. This study investigates whether there is a basis to assert that there is a duty of international cooperation or if the collaboration among states is only an act of courtesy. This work seeks to justify that duty on the deontological moral theory of Kantian tradition to show that his conception of practical reason requires a duty of international cooperation. The hypothesis is that there is a duty both morally and legal to international cooperation. For the construction of this argument, it is verified how the idea of ethical duty is articulated in the direction of political action and how it is possible to transpose the Kantian ethical building in direction to the international relations through the development of a moral and legal cosmopolitanism. Finally, it is verified that the contemporary unfolding of some of these precepts can sustain a duty of international cooperation by States.

           National Legal System: Taking Seriously Benefit Sharing from the
           Utilization of Genetic Resources in India

      In taking seriously the interpretation and application of international obligations on sharing of benefits equitably on genetic resources, India has decided for a law, rules and guidelines to define equitableness as well as a “case by case” assessment. In doing so, lessons from various cases in which (un)successfully benefits have been shared as well as the rule of application of Article 15.7 of the Convention on Biological Diversity (rules should be enacted as well as policies and “other measures”) were considered in a national Act on this subject. The process of law creation as a consequence of incorporation, therefore, is a dual process: interpretation (of a general international legal rule to determine specifically the national requirements to fulfil vague terms used in the rule) and, at the same time, application of these international rules (by enacting national legal rules defining the objects of legal regulation established by the treaty). Interpretation and application of article 15.7 in India has been defined ruling beyond obligation establishing legal objects and subjects, equitableness, fairness of sharing benefits and standards for a final amount, basically, detailing legal requirements and defining “equity” and “justice” as distribution, synallagma and procedure.

  • Protocolo de Nagoya: desafíos originados a partir de un texto
           complejo, ambiguo y controversial

      El Protocolo de Nagoya sobre acceso a los recursos genéticos y participación justa y equitativa en los beneficios que se deriven de su utilización podría ayudar a lograr varios objetivos, entre ellos: a) conservar la diversidad genética; b) achicar la brecha tecnológica existente entre el Norte y el Sur y c) compensar a las comunidades indígenas y locales por el uso de su conocimiento tradicional en relación con la utilización de la biodiversidad. Sin embargo, el texto del acuerdo, de carácter complejo, ambiguo y controversial, crea serios desafíos de cara a su implementación. Esta investigación destaca tres: (1) la complejidad, dinamismo y polémica de su ámbito material, (2) las dudas sobre su grado de retroactividad y (3) los problemas que suscita la elección y configuración de las medidas de cumplimiento en relación con su efectividad. Luego de analizar cada reto y aportar algunos elementos aclaratorios sobre ellos, se adelantan posibles soluciones a fin de facilitar la implementación del Protocolo. The Nagoya Protocol on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization could help conserve genetic diversity, bridge the technological gap between the North and the South, and compensate indigenous and local communities for the use of their traditional knowledge associated to the utilization of biodiversity. However, as the text of the agreement appears complex, ambiguous and controversial, serious national implementation challenges emerge. This research outlines three of them: (1) a complex, dynamic and disputed material scope; (2) doubts on Nagoya's degree of retroactivity and (3) problems in relation to the selection and operationalization of the envisaged compliance measures. After discussing each of the challenges, valuable insights and possible solutions are offered in order to facilitate the national implementation of the Protocol.

      Este artículo argumenta que el principio de subsidiariedad es una herramienta conceptual sólida para entender la relación entre el derecho internacional de los derechos humanos y el derecho nacional. La subsidiariedad permite superar las insuficiencias de las teorías del monismo y el dualismo para explicar esta relación, pues se trata de un principio con la suficiente flexibilidad para mediar la tensión inherente que resulta de la existencia de normas universales en materia de derechos humanos, y la vigencia de principios como la soberanía del Estado y la autodeterminación constitucional. El artículo sostiene que la libertad que goza un Estado para determinar el alcance de los derechos humanos a nivel nacional depende fundamentalmente del nivel de protección a la dignidad humana reconocido por el derecho de los tratados. This article argues that the principle of subsidiarity is a solid concept to understand the relationship between International Human Rights Law and domestic law. Subsidiarity allows overcoming the insufficiencies of the theories of monism and dualism in the understanding of this relationship, since it is a principle with enough flexibility to mediate the inherent tension that comes from the existence of universal human rights norms, and the validity of principles such as the sovereignty of States and the right to constitutional self-determination. This article holds that State's freedom to determine the extent of human rights protection at the national level depends on the degree of protection to human dignity recognized by the law of treaties.

      La agenda internacional de protección al medio ambiente involucra la gestión de diferentes recursos naturales, los cuales se pueden encontrar tanto en el aire, como en la tierra o en los océanos. Por esta razón, desde hace ya varios años, el ser humano se ha preocupado por la manera en que se puede hacer un uso sostenible de los recursos marinos vivos. Este tema cobra aún más importancia por las implicaciones socioeconómicas que tiene el aprovechamiento de los acervos pesqueros ubicados a lo largo del planeta, los cuales no necesariamente se ubican confinados en las aguas territoriales o las zonas económicas exclusivas de los diferentes países. En este trabajo, se describe la situación actual de los recursos marinos vivos y la vinculación que guardan con el desarrollo económico de las diferentes sociedades, para dar paso a una breve descripción sobre las maneras en que el ser humano ha decidido gestionar dichos recursos. A partir de dicha descripción, se revisa con detalle uno de los esquemas de gestión: las Organizaciones Regionales de Ordenación Pesquera, a la luz de cinco elementos específicos. The international agenda of environment protection involves the management of different natural resources, which may be found in the air, land or oceans. For this reason, for several years already, humankind has worried about the manner in which living marine resources may be sustainably used. This topic becomes more important due to the socioeconomic implications brought by seizing the fishery resources located throughout the planet. These resources may not necessarily be secluded in territorial waters or in economic zones exclusive to different countries. In this document, the current situation of living marine resources and their link to the economic development of different societies is analyzed with the purpose of briefly describing the ways in which humans have decided to manage such resources. From the abovementioned description, each of the management plans is carefully reviewed: The Regional Fishery Management Organizations in the light of five specific elements.

      La mayor dependencia de los Estados de las tecnologías de la información y de la comunicación y consecuentemente su mayor vulnerabilidad ha provocado que la ciberseguridad se convierta en uno de los principales tópicos de debate de la comunidad internacional. En este aspecto, es de trascendental importancia la determinación del modo en que las normas del ius ad bellum, es decir, el conjunto de normas que regulan la utilización de la fuerza en el contexto internacional, se aplican en el ámbito del ciberespacio. En el presente trabajo se exploran las principales aristas que presenta esta problemática. Cyber-security has become one of the most important issues for the international community since States’ dependence on information and communication technologies and consequently its vulnerability has increased. Therefore, to determine how the ius ad bellum, this is the norms that regulate the use of force in the international context, is applied to cyberspace is essential. In this work different aspects of this issue are explored.
