  • A Study of Panglima La’ōt: An ‘Adat Institution in Aceh

      Abstract: This article is about a brief history of Panglima La’ōt Aceh and its current position along with Adat La’ōt (customary law) among Acehnese community. It will look at relationship between Adat and presence of Panglima La’ōt  (the Commanders of the Sea). To what extent we could say that there is a strong connection between the adat laot and Panglima La’ōt' It is argued that this institution has been established for more than 400 hundred years by the Kingdom of Aceh. It is also said that adat laot is one of the oldest customary law in Aceh. This article consists three sections. After the introduction, it will discuss the history of Panglima La’ōt in Aceh. The next section is about the current position of Panglima La’ōt in Acehnese society. Here, the data will be focussed on the dynamics of fisher and their perpection toward the Panglima La’ōt in different setting of research area. Finally, the examination of the revitalization of Panglima La’ōt as formal institution in, especially the overlapping of the authority of adat institution, will be provided in final section.[Tulisan ini merupakan penjelasan mengenai hubungan Panglima La’ot dengan hukum adat La’ot ditengah masyarakat Aceh dewasa ini yang secara resmi pemerintah daerahnya menegakkan syari’ah Islam. Sebagai salah satu institusi adat yang tertua sejak berdirinya kerajaan Aceh, Panglima La’ot dan adat La’ot mengalami dinamika yang luar biasa. Dengan mengambil studi kasus dibeberapa tempat yang berbeda, penulis menunjukkan bahwa formalisasi kembali institusi ini bukan hanya menjadi cara melestarikan warisan budaya, melainkan juga menjadi aparatus pemerintahan lokal yang mewakili masyarakat nelayan Aceh ditengah dinamika ekonomi politik lokal, regional dan internasional.]

  • Ibn Al-Haytham’s Classification of Knowledge

      Abstract: Ibn al-Haytham (d. 1039) is a well known scholar for his contributions in natural and mathematical sciences. The research focuses on his works in sciences and mathematics and only a few studies carry out on his contribution on philosophy due to the lack of the primary sources. The only known surviving Ibn al-Haytham’s work on philosophy is Kitāb Thamarah al-ḥikmah. However, few studies have examined and explored this work. Based on this work, the present study tries to scrutinize Ibn al-Haytham’s epistemology and focused mainly on his classification of knowledge. The comparative study of Ibn al-Haytham’s classification of knowledge and that of al-Fārābī‘s, Ibn Ḥazm’s, Ṭūsī’s, and al-Ghāzālī  is also carried out. The result shows that Ibn al-Haytham has two mode of classifications: the ontological and epistemological. It is also obvious that Ibn al-Haytham tries to integrate Greek philosophy and sciences within the worldview of Islām. The results of the present study also suggests that the nexus between the concept of classification of knowledge and the concept of perfect man (al-insān al-tāmm) is obvious.[Ibn al-Haytham (w. 1039) adalah sarjana yang dikenal sumbangsihnya dalam ilmu-alam dan matematika. Penelitian-penelitian hingga saat ini cenderung difokuskan pada karya-karya sains dan matematikanya saja dan hanya sedikit dilakukan pada karya-karya filsafatnya karena kurangnya rujukan primer. Satu-satunya karya Ibn al-Haytham yang ada dalam bidang filsafat adalah Kitāb Thamarah al-Ḥikmah. Namun, studi yang dilakukan untuk meneliti dan mengeksplorasi karya ini sejauh ini amat kurang. Berdasarkan karyanya tersebut, kajian ini mencoba untuk meneliti dengan seksama epistemologi Ibn al-Haytham dan utamanya difokuskan pada klasifikasi ilmu pengetahuan. Studi perbandingan antara klasifikasi ilmu Ibn al-Haytham dengan al-Fārābī‘s, Ibn Ḥazm’s, Ṭūsī’s, and al-Ghāzālī juga dihadirkan. Hasil penelitian menunjukkan bahwa Ibn al-Haytham memiliki dua cara klasifikasi ilmu pengetahuan. Juga sangat nampak bahwa Ibn al-Haytham mencoba memadukan filsafat dan sains Yunani dalam pandangan alam Islam. Kajian ini juga menunjukkan bahwa terdapat hubungan yang jelas antara konsep klasifikasi ilmu pengetahuan dengan konsep manusia sempurna (al-insān al-tāmm)]

  • Being Pious Among Indonesian Salafists

      Abstract: This essay is a brief explanation on the development of the process of Islamic Puritanism among Salafis in Indonesia. The article argues that the Salafis in Indonesia are in the process of puritanization and Arabization. Being pious, to them, means that one has to become an Arab and a Puritan Muslim. This puritanization of Islam is shown by purifying Islamic doctrines from any deviation. That is, religious concepts and practices should be based on the Qur’an and the Sunna only. Likewise, Salafis present themselves as like Arabs as their men let their beard grows, wear turban and trousers above their ankles, while their women wear enveloping veil (niqab). The research also found out that the using of Arabic words, like abi (father), umi (mother), ‘ami (uncle), ‘ama (aunt), akhi and ukhti for friend, are widely popular. Changing name from Javanese to Arabic is another form of Arabization. The acts of piety among Indonesian purist Salafis show that Salafi challenges both secular and traditional worlds which aim to create a stronger bonding every the followers among them, but, at the same time, distance them from other groups.[Tulisan ini menjelaskan tentang perkembangan proses puritanisasi diantara kaum Salafi di indonesia. Tulisan ini memberikan argumen bahwa anggota gerakan Salafi sebenarnya mengalami puritanisasi dan arabisasi. Mereka beranggapan bahwa menjadi orang baik dan saleh berarti menjadi seperti orang Arab dan muslim yang puritan dengan jalan memurnikan doktrin agama dari penyimpangan-penyimpangan. Cara yang diambil adalah dengan kembali kepada Al Qur’an dan As Sunnah. Misalnya bagi laki-laki salaf adalah menumbuhkan jenggot, menggunakan surban dan memakai celana yang panjangnya di atas mata kaki. Sedangkan bagi perempuan harus menggunakan jilbab. Selain itu penelitian ini juga menemukan populernya penggunaan nama panggilan yang berasal dari bahasa Arab, seperti abi, umi, ami dan ama diantara mereka sendiri. Ada juga kecenderungan pergantian nama Jawa menjadi nama Arab. Kesalehan mereka sebenarnya ditujukan untuk merespon tradisionalitas dan modernitas, akan tetapi disaat yuang sama mereka justru membuat jarak dengan kelompok yang lain.]

  • Under Children's Eyes: Becoming Pious in Tayeb Salih and Pramoedya
           Ananta Toer Short Stories

      Abstract: This research seeks to discuss how child characters navigate their interactions with the adults in two short stories set in the predominantly Islamic society of Sudan and Indonesia. It examines Tayeb Salih’s “A Handful of Dates” (1964) and Pramoedya Ananta Toer’s “Circumcision” (1950) by locating both texts in World Literature which is largely Western or Eurocentric. Both short stories belong to the genre of initiation fiction often included in world literature anthologies. This paper argues that both authors help contribute to not only the rethinking of World Literature concept and circulation thereof, but also balanced view of heterogonous, multicultural Muslim society. Using post-Genette focalization theory as conceptual framework, this study finds out that the child narrators play distinct roles as (1) the perceptual focalizer to reveal injustice and frivolity of the adults’ world; (2) the ideological focalizer to make meaning of children’s faith through their relationship with the grown-ups. [Penelitian ini bertujuan membahas bagaimana tokoh anak berinteraksi dengan orang-orang dewasa dalam dua cerita pendek dari negara berpenduduk mayoritas Islam, Sudan dan Indonesia. Karya Tayeb Shalih, "A Handful of Dates"[Segenggam Kurma] (1964) dan karya Pramoedya Ananta Toer "Sunat" (1950) dikaji dengan menempatkan kedua teks dalam Sastra Dunia yang cenderung berkiblat ke dunia Barat dan Eropa. Kedua cerita pendek  bergenre fiksi inisiasi ini sering diikutkan dalam antologi sastra dunia. Makalah ini menunjukkan bahwa kedua penulis memberikan kontribusi dalam penafsiran ulang konsep dan peredaran Sastra Dunia, serta pandangan yang lebih seimbang terhadap masyarakat Muslim yang heterogen dan multikultural. Menggunakan Teori Fokalisasi Pasca-Genette sebagai kerangka konseptual, studi ini menyimpulkan bahwa tokoh anak dalam kedua cerpen memainkan peran yang berbeda sebagai (1) focalizer (penyuara) perseptif yang mengungkapkan ketidakadilan dan kedegilan dunia orang dewasa; (2) penyuara ideologis yang memaknai keimanan anak lewat relasi dengan orang-orang dewasa.]

  • Muslims with Tattoos: The Punk Muslim Community in Indonesia

      Abstract: Tattooing is becoming increasingly popular in the predominantly Muslim country of Indonesia. While mainstream society continues to perceive the tattooing practice negatively, many individual Muslims attach positive personal meaning to tattooing. This paper provides some of the academic insights into contemporary perceptions of tattooing among Indonesian Muslims. It focuses on the existence of ‘Punk Muslims’ community whose tattoos form an important part of their cultural identity and on responses to their tattooing practices from the wider society. Data were collected by means of individual interviews, a focus group discussion, and interactive social media communication. This paper reveals that Punk Muslim community has personal meaning of tattoo, while society has different perception. This community considers to maintain their cultural identity as punker symbolized by tattoo and Islam signed by worship.[Tato menjadi semakin populer di negara mayoritas Muslim seperti Indonesia. Ketika sebagian besar masyarakat memandang tato secara negatif, banyak juga Muslim secara pribadi memiliki pendapat positif terhadap tato. Artikel ini menyuguhkan beberapa wawasan akademik atas persepsi kontemporer terhadap tato dalam masyarakat Muslim di Indonesia. Fokus dari artikel ini meliputi eksistensi komunitas Punk Muslim yang menganggap tato telah membentuk bagian sangat penting dari identitas kultural mereka dan juga fokus pada respons dari masyarakat terhadap praktik bertato. Data penelitian dikumpulkan dari interview secara personal, diskusi kelompok terumpun, dan komunikasi interaktif di media sosial. Artikel ini menyatakan bahwa komunitas Punk Muslim memiliki makna personal atas tato ketika masyarakat memiliki penilaian yang berbeda. Komunitas ini mempertimbangkan untuk mempertahamkan identitas kultural sebagai anak punk yang disimbolkan dengan tato dan sebagai orang Islam yang disimbolkan dengan ibadah.]

      Abstract: Violence against Ahmadiyah and Shi’a minority communities escalated during the government of President Susilo Bambang Yudhoyono. This study discusses discrepancy between local and central state officials in response to the violence. It found that officials at local states looked ignorant to the violence, while central state officials sent mixed signals: they appeared to be enthusiastic to protect the rights of Ahmadiyah and Shi’a adherents to practice their faiths respectively; but at other times, the officials adopted compromising stance. This study argues that this discrepancy stems from different challenges that each tier of the state had to face. Local state officials were indifferent to the plight of the minority communities due to their kinship; and local affinities to fellow Sunni residents. In contrast, central state officials had to cater to more heterogeneous constituents, and hence they were not immune to pressures from various quarters, including from human right activists and international community. As result, central state officials were ambivalent in responding to the violence. This research is based on a seven-month fieldwork in Ahmadiyah and Shi’a communities, respectively in Kuningan regency, West Java province and in Sampang regency, East Java province in 2013. The data was gathered through ethnography and in-depth interview with relevant sources. [Kekerasan terhadap kaum minoritas Ahmadiyah and Syiah meningkat dalam pemerintahan Presiden Susilo Bambang Yudhoyono. Studi ini mendiskusikan kesenjangan sikap aktor negara pusat dan lokal dalam menanggapi tindak kekerasan tersebut. Studi ini menemukan bahwa aktor negara di tingkat lokal terkesan tidak peduli dengan rentetan kekerasan tersebut, sementara aktor negara di tingkat pusat menunjukkan sikap yang ambivalen: di suatu waktu mereka terlihat antusias untuk melindungi hak-hak kaum minoritas untuk memeluk kepercayaan-nya masing-masing; di waktu yang lain mereka memperlihatkan sikap kompromistis terhadap pelaku kekerasan atas nama agama. Studi ini berargumen bahwa kesenjangan terjadi karena perbedaan tantangan sosial politik yang masing-masing harus dihadapi oleh aktor-aktor negara di kedua tingkatan yang berbeda tersebut. Aktor negara di tingkat lokal terkesan tidak peduli dengan nasib kaum minoritas karena mereka terpengaruh oleh keterikatan pertemanan atau kekerabatan dengan pelaku kekerasan, yang memiliki kepercayaan yang sama, yaitu Sunni, yang merupakan kepercayaan Islam yang mayoritas di daerah dimana kaum minoritas Ahmadiyah dan Syiah tinggal. Sebaliknya, aktor negara di tingkat pusat harus menghadapi konstituen yang lebih beragam dalam hal agama dan kepercayaan, dan juga dalam hal pemikiran sosial dan politik. Hal ini mengakibatkan aktor negara pusat mau tak mau harus menghadapi tekanan sosial dan politik dari berbagai pihak sehubungan dengan penanganan persoalan kaum minoritas, terutama dari pegiat hak asasi manusia dalam skala domestik maupun internasional. Akibatnya, aktor negara di tingkat pusat terkesan ambivalen dalam menanggapi maraknya kekerasan terhadap kaum minoritas di era Presiden Susilo Bambang Yudhoyono, terutama kaum Ahmadiyah and Syiah. Studi ini berdasarkan kerja lapangan yang berlangsung selama tujuh bulan di tahun 2013, bertempat di pemukiman Ahmadiyah and Syiah di Kabupaten Kuningan, Jawa Barat dan Kabupaten Sampang, Jawa Timur. Pengumpulan data dilakukan dengan metode etnografi dan wawancara mendalam dengan sumber-sumber yang terkait dengan topik penelitian diatas.]

  • Religious Diversity and Blasphemy Law: Understanding Growing Religious
           Conflict and Intolerance in Post-Suharto Indonesia

      Abstract: This paper will look at how the explosion of militant religious activism and violence against minorities in post-Suharto Indonesia is embedded in the state’s failure to apply a proper management of religious diversity and civic pluralism. In the bottom of this issue lies controvertial Law No. 1 of 1965 on the prevention of the abuse or insulting of a religion,  known as the Blasphemy Law. Debates have abounded on the extent to which the Law has transgressed the principles of religious freedom guaranteed by the Indonesian Constitution. This paper will thus also examine petitions filed by human rights activists and civil society organizations to demand judicial reviews of the Law before the Constitutional Court[Artikel ini akan menjelaskan bagaimana militansi aktifis agama dan kekerasan terhadap minoritas pasca Soeharto yang muncul akibat kegagalan Negara dalam mengelola keragaman agama dan pluralitas masyarakat. Dasar dari persoalan ini berpangkal pada kontroversi UU No. 1 Tahun 1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama atau yang dikenal dengan UU Pencemaran Agama. Perdebatan yang panjang telah mengarah pada pelanggaran prinsip hukum mengenai jaminan kebebasan agama oleh konstitusi.   • Judges’ Legal Reasoning on Child Protection: Analysis of Religious
           Courts’ Decisions on the Case of Child Parentage

      Abstract: This paper examines four religious courts’ decisions on child legal status, especially child parentage, after Constitutional Court’s decision on the legal status of child born out of wedlock. The Constitutional Court’s decision has triggered controversy on the rights of child born out of wedlock due to lack of explanation concerning term ‘civil legal relationship with the biological father’. To study the decisions, the author uses legal philosophy approach, both in legal science and Islamic law, focused on legal reasoning used by judges in decisions on child parentage. As the result, the author finds two types of legal reasoning employed by judges of religious courts  in dealing with cases of child parentage, doctrinal-deductive legal reasoning and maṣlaḥa based legal reasoning. It argues that the employment of doctrinal-deductive legal reasoning by the judges has not benefitted children and therefore the protection of child’s rights has not been optimally made nd that the employment of maṣlaḥa based legal reasoning by the judges has led to the better protection of child’s rights.[Tulisan ini membahas empat putusan pengadilan agama terkait status hukum anak, khususnya waris anak, setelah dikeluarkannya putusan Mahkamah Konstitusi (MK) tentang status hukum anak di luar nikah. Putusan MK telah memicu kontroversi karena kesenjangan penjelasan tentang adanya hak perdata seorang anak yang lahir di luar nikah dengan ayah biologisnya. Dalam mengkaji persoalan ini, penulis menggunakan pendekatan filsafat hukum, baik secara ilmiah atau hukum Islam, yang fokus pada argumentasi hukum para hakim dalam kasus hak waris anak. Penulis setidaknya menemukan dua tipe argumentasi yang digunakan para hakim dalam kasus tersebut, yaitu: alasan hukum legal deduktif-doktrinal dan alasan hukum berbasis maṣlaḥah. Tipe yang pertama cenderung melemahkan perlindungan hak anak, sedangkan tipe kedua justru akan menguatkan hak anak.]
