  • Die fassinerende meganika van hoppende fietswiele : natuurwetenskappe

      Abstract: Die gedrag van eksentries-belaaide wiele of hoepels het tydens die afgelope twee dekades aandag geniet, veral met betrekking tot sulke wiele se geneigdheid om te hop. Hier word 'n oorsig gegee oor die verskillende aspekte wat in die vorige artikels bespreek is, beginnende met J.E. Littlewood se voorbeeld van 'n massalose hoepel in 1953, die foto van 'n hoppende hoelahoepel in T. Pritchett se artikel in 1999, asook ander aspekte, soos die effek wat wrywing op die beweging het.Feitlik al die gepubliseerde numeriese resultate is gegee vir beweging van 'n hoepel op 'n horisontale vlak; in hierdie artikel word 'n wiel wat afrol op 'n skuins vlak beskou. Die parameters vir 'n werklike fietswiel wat belas is deur 'n stuk lood op die rand vas te smelt, soos getoon in die foto in figuur 1, word in die wiskundige modelle gebruik.Resultate word gegee vir drie modelle van die wiel, naamlik vir 'n starre wiel, 'n linêer elastiese wiel sonder demping, en 'n linêer elastiese wiel met viskeuse demping. Littlewood, on his retirement from Cambridge University, published a booklet called A Mathematician's Miscellany. The following formulation is from p. 37 of the revised edition of this book:A weight is attached to a point of a rough weightless hoop, which then rolls in a vertical plane, starting near the point of unstable equilibrium. What happens, and is it intuitive? ...In 1997 the same problem was considered by Tokieda, whose analysis is based on the geometric aspects of the motion. Both Littlewood and Tokieda conclude that the hoop will hop after rolling through 90° after starting from rest with the particle at the highest point of its cycloidal path. This conclusion troubled a number of authors, it being counter intuitive that the hoop can hop while the particle is moving downwards. This sparked a number of articles, a thorough review of which is given in the Introduction to this article.In almost all the previous work the motion occurred on a horizontal plane, and a hypothetical loaded hoop was considered. In this paper new results are presented for a bicycle wheel rolling down a sloping plane. As shown in figure 1, the wheel is weighted with a lump of lead melted onto the rim. To some extent the elasticity of the wheel depends on the air pressure in the tyre.

  • AuII : skaars of afgeskeep? 'n Kritiese literatuuroorsig :

      Abstract: Verbindings van AuII is reeds langer as 60 jaar bekend. 'n Literatuurstudie toon dat slegs 'n beperkte aantal struktuur- en bindingstipes tot dusver in suiwer vorm geïsoleer en gekarakteriseer kon word. Die grootste enkele groep bevat AuII as gekomplekseerde, kovalentgebonde [AuII-AuII]-eenhede en die twee goudatome is óf ligandgebrug (die grootste gros) óf óngebrug ('n handvol). Monokernige AuII-verbindings kom ook voor en word gekenmerk óf deur die teenwoordigheid van die eksotiese ligand Xe, óf weens chelaatvorming met bidentate of heksadentate S- of S- en O-donor-ligande, óf weens vierkantigvlak porfirienkompleksvorming waarin imien-N en amied-N donorfunksies vervul. Die vorming van AuII gedurende nanogoudsintese, 'n rol daarvoor in homogene katalise, sowel as die stabilisering daarvan op verskillende vaste ondersteuningsplatforms, toon dat meer bruikbare toepassings in die toekoms verwag kan word. In die lig van resultate wat veral sedert 2000 verkry is, word die bestaande literatuur hier georden en bespreek en tekorte in die chemie van AuII uitgewys. Verskeie voorstelle vir verdere ondersoek word gemaak.AuII : rare or neglected? A critical literature reviewDedicated kinetic studies of one of the first examples of electron transfer catalysis in the 1950s signalled the birth of AuII chemistry. Post-2000 developments in AuII chemistry, which is the focus of this article, rest on mainly four pillars of discovery made in the previous century:
      Isolation of the first mononuclear paramagnetic AuII complex, using mnt as ligand (Figure 1).
      Preparation and investigation of the structure and reactivity of an extended series of [AuII-AuII] complexes pioneered by Schmidbaur and others (Equation 2) using bipodal ligands.
      Determination of the first crystal structure of a AuII complex, a macrocyclic, S-donor ([9]aneS3) product (II, Figure 2).
      Characterisation of intermediate AuII species formed during nanogold preparation by pulse radiolysis and photolytic reduction of AuIII.

  • Paul Kruger, die Uitlanderstemreg en die Engelstalige pers in die ZAR voor
           1895 : geesteswetenskappe

      Abstract: Paul Kruger se menings en uitsprake het groot invloed in die Zuid-Afrikaansche Republiek (ZAR) gehad. Dit het ook gegeld ten opsigte van die belangrike kwessie van stemreg vir die Uitlanders wat sedert die ontdekking van goud op die Witwatersrand in 1886 die land binnegestroom het. Reeds in September 1887 het 'n komitee van Johannesburgers beklemtoon dat inspraak in besluitneming in die land vir hulle belangrik was. Kruger het dit egter duidelik gemaak dat stemreg slegs die oorspronklike burgers beskore was.Kruger het hom daarna tot 1894 gereeld voor Uitlandergehore oor die stemregkwessie uitgespreek, maar die vaagheid van sy uitsprake en beloftes daaroor het hulle onbevredig gelaat. In â??n onderhoud in 1892 met 'n afvaardiging van die National Union as spreekbuis van die Uitlanders het hy hulle ook baie kortaf behandel en die organisasie van hom vervreem.Tydens die belangrike debat van Junie 1894 oor die hersiene Kieswet was Kruger se rol beslissend. Die vereistes vir naturalisering is strenger gemaak en die belangrike bepaling is aanvaar dat uitbreiding van die stemreg voortaan kon geskied slegs indien twee derdes van die stemgeregtigde burgers hul goedkeuring daarvoor te kenne gee. That also applied to the all-important question of the franchise for the Uitlanders who had flocked to the ZAR after the discovery of gold on the Witwatersrand in 1886. As early as 1887 a committee of Johannesburg gold-diggers welcomed him in the new township and emphasised that they wished to participate in decision-making in the Republic and thus wanted full civil rights. On this occasion he made it clear to them, however, that the franchise was meant only for the original burghers. After that Kruger addressed Uitlander audiences regularly until 1894 and made pronouncements on the franchise question. None of these satisfied the Uitlanders and the franchise problem started to loom large and was eventually to lead to war with Britain in 1899.Kruger was often evasive when addressing Uitlander audiences on the franchise question. In many of these speeches he would dwell extensively on the history of the settlement of former Voortrekkers in the territory north of the Vaal River, and the sacrifices they made to settle there and to regain the independence of the ZAR after the annexation of the Republic by Britain in 1877. This argument - if it could even be called that - was dubbed by the English language newspapers the "blood and sweat argument" proffered by Kruger for not granting the franchise to the newcomers on the same footing as the already enfranchised burghers. In this process he used the biblical concept of the birth right of the original white inhabitants as justification to withhold the franchise from the new settlers on the goldfields.

  • Kompleksiteit en die begeerte van die filosofie : geesteswetenskappe

      Abstract: Kompleksiteitsteorie hou skynbaar groot belofte in om ons denke en praktyke te verruim op onder meer wetenskaplike, sosiale, politieke, filosofiese en etiese gebiede. In hierdie artikel kyk ek krities na kompleksiteitsteorie se aansprake om betekenisvol te wees vir die filosofie deur dit in gesprek te bring met Alain Badiou se betoog dat die filosofie onderhou word deur 'n vierdimensionele begeerte vir opstand, logika, universaliteit en die waagstuk. Badiou voer aan dat die vierdimensionele begeerte van die filosofie ondermyn word deur 'n wêreld wat oorheers word deur die verwronge logika van handel, kommunikasie, spesialisasie en sekuriteit. Hy betoog voorts dat invloedryke filosofiese strominge soos die hermeneutiek, analitiese filosofie en postmodernisme die waansin van die wêreld tot so 'n mate weerspieël ("reflect") dat dit nie in staat is om teenstand daarteen te bied nie. Badiou sets his account of philosophy and desire against an assessment of the contemporary world as dominated by an obsession with merchandise, communication, specialisation and security; according to Badiou this state of affairs endangers the existence of philosophy as such in so far as it undermines the desire that is constitutive of philosophy. Badiou further argues that the dominant contemporary philosophical orientations, hermeneutics, analytical philosophy and postmodernism are too compatible with the obsessions of the contemporary world to be able to offer any resistance to it. I argue that the significance of complexity theory for philosophy should be considered in this context. I argue that while in some respects complexity theory is subject to the same deficiencies as those Badiou identifies in the dominant philosophical orientations, it allows for an interpretation that sustains the four-dimensional desire of philosophy.

      Abstract: Samewerkingsnetwerke binne kulturele bedrywe is reeds met verwysing na film (byvoorbeeld Guillaume en Latapy 2006) en musiek (Gleiser en Danon 2003) bestudeer. In Suid-Afrika is die Afrikaanse filmbedryf ook sodanig ontleed (Senekal 2015b). In die huidige artikel word die samewerkingsnetwerke in die hedendaagse Afrikaanse toneelbedryf (2010-2015) bestudeer. Met verwysing na toneelproduksies wat in hierdie tydperk by die Klein Karoo Nasionale Kunstefees (KKNK), Aardklop en Vryfees opgevoer is, word die samewerkingsnetwerk tussen alle rolspelers as 'n netwerk ontleed, met inagneming van alle persone wat by hierdie produksies betrokke was. Die netwerkstruktuur word in sy geheel bestudeer, maar die fokus val op die identifisering van die belangrikste rolspelers en veral op die konsep van 'n pad in netwerke. The literary system has long been studied as a system where relationships within the system influence among others the production of a work and that work's value. A book is not the product just of an author, but also of reviewers, language practitioners, editors and graphic designers, while the value of the literary work is also determined by many other stakeholders, such as the publishing house, critics, literary scholars and literary historians. In the music industry a record is not only the product of a single artist - musicians, sound engineers, graphic designers and marketers and, of course, the critics and cultural historians - all contribute to the material and symbolic production of that record. In the film industry there are even more role players involved: although it is usually the director and lead actors whose names become known, a variety of role players - from marketers and accountants to stuntmen and animal handlers - are involved in the creation of a film. The same applies to a play, which is - except for a few one-man shows - also a product of the collaboration between actors, directors, writers and others.Cooperation networks have been studied within cultural industries with reference to the film industry (e.g. Guillaume and Latapy 2006) and music (Gleiser and Danon 2003). In South Africa the Afrikaans film industry has also been studied as a network (Senekal 2015b). The current article follows these publications by analysing social networks in the contemporary Afrikaans theatre industry (2010-2015). Collaborations on theatre productions that were staged at three of the main Afrikaans cultural festivals, namely the Klein Karoo Nasionale Kunstefees (KKNK) in Oudtshoorn, Aardklop in Potchefstroom and Vryfees in Bloemfontein, are studied. Every contribution listed in the festival programmes for every theatre production at these festivals is taken into account, with a total of 247 Afrikaans theatre productions in this period. From these, a collaboration network was constructed and analysed for the Afrikaans theatre industry, in both its bipartite and single-mode renditions.

      Abstract: Die studie van fragmente uit Middeleeuse en Renaissance-manuskripte en die opbou van versamelings van fragmente is 'n onlangse ontwikkeling van manuskripstudie. Die naam fragmentologie is daarvoor voorgestel. Die ontstaan van die fragmente het egter 'n lang geskiedenis. In hierdie artikel word die aard en geskiedenis van manuskripfragmente bespreek onder die opskrifte "Wat is manuskripfragmente?", "Fragmente as bindmateriaal", "Fragmente as volledige enkelblaaie", "Die handel in uitgesnyde miniature" en "Ander doeleindes waarvoor fragmente gebruik is".Daarna word fragmente uit Middeleeuse en Renaissance-manuskripte wat in Suid-Afrika gevind is, bespreek. Hierdie fragmente is gevind in manuskripte in die Grey-versameling in die Nasionale Biblioteek van Suid-Afrika in Kaapstad, in die Nasionale Biblioteek van Suid-Afrika in Pretoria, en ook in privaatbesit. Betekenisvolle inligting is verkry uit die fragmente wat bestudeer is, waarvan een 'n palimpses is, en daar is gevind dat 'n fragment wat gebruik is om die band van 'n boek te versterk, in sommige gevalle van meer betekenis kan wees as die boek self. The name fragmentology has been suggested for this. The origin of the fragments has a long history, however. In this article the nature and history of manuscript fragments is discussed under the headings "What are manuscript fragments?", "Fragments as binding material", "Fragments as complete single pages", "The trade in excised miniatures" and "Other uses of fragments". Fragments from medieval and Renaissance manuscripts found in South Africa are then discussed. Meaningful information was discovered in the fragments studied, one of which is a palimpsest. It was found that a fragment that was used to strengthen the binding of a book could in some instances be more interesting than the book itself.The aim of this article is to investigate the nature and history of the new study of fragmentology. The origins of the fragments as well as the migration of the fragments are discussed, as are the historical and scientific value of the fragments and the contribution that the fragments can make to different subject areas. A secondary aim was to determine if a study like this had been undertaken in South Africa and if it would be possible to undertake such a study here. The article is, therefore, a research report on these two aims.

Philippe Lacoue-Labarthe se filosofiese konseptualisering van mimesis verteenwoordig die teoretiese perspektief vir hierdie onderneming. Lacoue-Labarthe het in sy essay "The horror of the West" (2012) sy vertolking van Conrad se teks gegee, en hoewel mimesis nie uitdruklik hier uitvoerig deur hom beredeneer word nie, is al die aspekte wat hy vir sy vertolking gebruik, herleibaar tot mimesis as sentrale, singewende motief. Venter's novel can be considered as a reimagining of Joseph Conrad's Heart of darkness and therefore facilitates, in its intertextual referencing, a mimetic relation to Conrad's original work. The first part of this article focuses on Lacoue-Labarthe's interpretation of Conrad's text: in his essay "The horror of the West" (originally a lecture given in 1995/6), he declares his appreciation for Heart of darkness as being one of the greatest texts of the Western canon, but also as being "an event of thought". And although mimesis as such is nominally not at the centre of this lecture, the motifs discussed in his essay can be seen as a constellation of concepts arising from mimesis as the central idea. Lacoue-Labarthe's whole philosophical oeuvre presents mimesis as its leitmotif and his essay on Conrad's text can and should be read with reference to the meaning he attributes to this concept.In "The horror of the West" Lacoue-Labarthe discusses eight aspects that he deems of great importance in Heart of darkness. These are (1) muthos, (2) narrative perspective, (3) reducing characters to their voices, (4) the definition of the artist, (5) ontological lack, (6) horror, (7) techne and (8) his interpretation of the character of Kurtz as representative of the West.

      Abstract: In hierdie artikel word Riana Scheepers se verhaal "Katvoet" uit haar bundel Katvoet (2009) ontleed aan die hand van die fenomenologie met die klem op die vrou, haar liggaam en haar verhouding met ander, wat beide die menslike en die niemenslike (die dierlike en die natuur) insluit. Aspekte vanuit die teorieë van Edmund Husserl, Maurice Merleau-Ponty, Iris Marion Young en Simone de Beauvoir word as uitgangspunt gebruik om die ontleding te doen. Daar word veral aandag gegee aan die konsepte van die liggaam, die "belewende liggaam" ("lived body"), liggaamlike eienaarskap, dubbele sensasies, intersubjektiwiteit, die vrou, swangerskap, geboorte, die verhouding met die kind, asook die dier, die mens se verhouding met die dier, en die vrou en die natuur.Die vrou se ervaring van haar liggaamlikheid, haar verhouding met diere teenoor mense, haar swangerskap, die geboorte en die verhouding met haar kind is die verskynsels wat sentraal in die ondersoek staan. Die betekenis van die vrou se ervaringe word eerstens ontleed ten opsigte van die betekenisse van onder andere gesag, eienaarskap, vryheid en 'n vereenselwiging met 'n dierlike aard. Die vrou is die eenheidskepper van haar ervaringe, waar dit in hierdie geval sowel menslike as dierlike ervaringe insluit. Intersubjektiewe en interliggaamlike verhoudings sluit verhoudings met haar man, die kat, ander diere en haar kind in, en die betekenisse van hierdie verhoudings word ondersoek. Daarna word die verskynsel van die vrou se swangerskap, die geboorte en die vrou se verhouding met die kind ondersoek. Die verhouding tussen die mens en die dier, en meer spesifiek, die verhouding wat die mens met die dier binne haarself het, kom aan bod. Die ingewikkelde verhouding tussen die vrou en die natuur en die uitbeelding van die verhouding in die verhaal word ondersoek.The woman, pregnancy, and the animal in the short story "Katvoet" by Riana Scheepers : a phenomenological studyThe goal of this research is to present a phenomenological analysis of Riana Scheepers's short story "Katvoet" (in Katvoet, 2009) by referring to the theories of Edmund Husserl, Maurice Merleau-Ponty, Iris Marion Young and Simone de Beauvoir. The word katvoet is a combination of the Afrikaans words for cat and foot, and is also an Afrikaans idiomatic expression referring to somebody walking carefully, or gently, and this already gives a perspective with regard to the nature of the story. An association between the human and animal takes place where the perceptions and experiences of the woman's world and the animal's world are assimilated, and phenomenology provides an interesting angle from which this can be analysed. This short story gives the opportunity for an interesting view on the different relationships of a woman: the relationship between woman and animal, woman and her body, woman and nature, woman and her unborn child, woman with her newborn child, as well as a woman's relationship with the pregnant body.Phenomenology studies the structures and types of experience that a human can have, from the first-person point of view (Smith and Thomasson 2005:1). "Intentionality" refers to the characteristic of an experience that it is an experience of some kind of object, emotion, memory or perception, and what particular meaning, or significance, this has to the human (Smith en Thomasson 2005:1). Husserl's concept of the "lived body" refers to the idea that the body is active and living, and is the point of view from which the world is perceived; the body is the instrument that the human uses to synthesise and perceive the world (Cerbone 2006:101-6). According to Simone de Beauvoir human experiences are defined by the situation in which the human finds him- or herself, and this explains the way women's experiences are defined by the situations and the structures that society constructs (Young 1990:42). Husserl's intersubjectivity (intersubjektivität) refers to the subject's interactions with other subjects, and the experiencing subject realises that she is not the only experiencing subject and that the world is shared with other experiencing subjects (Drummond 2007:114; Jensen 2013:ix).

           waarnemings tydens hartstilstand : godsdienswetenskappe

      Abstract: Oor die afgelope dekade was daar 'n toename in publikasies wat daarop aanspraak maak dat navorsing oor nabydood-ervarings (NDE's), veral tydens hartstilstand, opspraakwekkende bevindinge bevat wat bestaande aannames oor bewussyn in die neurowetenskap bevraagteken en tradisionele sieninge oor die "siel" en lewe na die dood bevestig. Die aanspraak van navorsers uit verskillende velde is dat NDE's tydens hartstilstand daarop dui dat bewussyn (die siel) onafhanklik van die brein en liggaam kan funksioneer en dat dit gevolglik onafhanklik van die liggaam (of brein) kan bestaan. Aangesien sulke aansprake gereeld in dié navorsing gemaak word en dit wyd gepubliseer word, is dit belangrik om dit krities onder die loep te neem. In hierdie artikel word die belangrikste argumente in die navorsing ondersoek en die bewyse krities ontleed.Die belangrikste argument, dat daar honderde getoetste en opgetekende gevalle van betroubare buiteliggaamlike waarnemings is, blyk op retoriese herhaling van twyfelagtige resultate te berus. Ook die argument dat die kumulatiewe gewig van tallose persoonlike vertellinge as bewys daarvoor kan geld, word bevraagteken. Die gevolgtrekking op hierdie stadium is dat NDE's tydens hartstilstand nóg bevestig dat bewussyn onafhanklik van 'n beliggaamde brein kan funksioneer, nóg bevestig dat lewe na die dood bestaan.Near-death experiences : a critical analysis of out-of-body perceptions during cardiac arrestOver the past few years there has been a steady increase in publications claiming that research on near-death experiences (NDEs), especially during cardiac arrest, is challenging received views on consciousness in the neurosciences as well as traditional views on the soul. Some scholars even claim that such research is providing scientific proof of life after death. The central claim is that NDEs during cardiac arrest are showing that consciousness (the "soul") can exist independently of a functioning brain. Thus the idea of non-local consciousness is receiving scientific support from research on NDEs, while one of the central features of the neurosciences is fundamentally challenged.Three features of NDEs are considered as background to the discussion. One is that the term NDE refers to a spectrum of composite experiences and not to a clearly identifiable entity. Despite the fact that these experiences occur under life-threatening conditions, there is not such a thing as an NDE because the same experiences also occur under many other conditions. Therefore, secondly, the term is used for experiences close to death as well as to similar experiences that have nothing to do with life-threatening conditions. Thirdly, the term near-death is not clinically precise; one can be close to death in the sense of narrowly escaping danger but without any physical trauma. Since claims exist that NDEs support the notion of non-local consciousness, it is important to ensure that data about experiences close to death are separated from those that have nothing to do with life-threatening conditions.

           Pesjitta-voorrangsteorie, Die Pad van Waarheid tot die Lewe-vertaling

      Abstract: 'n Nuwe Afrikaanse Bybelvertaling, wat in 2015 uitgegee is, roem daarop dat die Nuwe Testament daarin vervat, vertaal is uit die oudste, "oorspronklike" Aramese geskrifte, geskryf in dieselfde taal as wat Jesus self gepraat het. Die oogmerk van hierdie artikel is om die aansprake van die vertaling van die Bybel genaamd die Pad van Waarheid tot die Lewe (PWL), oftewel die Afrikaanse Lamsa-Bybel, krities te beoordeel, spesifiek met aandag aan die brontekste en die kwessie van "oorspronklikheid" en om te kyk hoe dit binne 'n bepaalde ideologie van Bybelvertaling funksioneer. Aangesien die mees omstrede aansprake van die PWL oor die aard en vertaling van die Nuwe Testament gaan, vorm dit die fokuspunt. Die artikel ondersoek egter nie net die Bybelwetenskaplike geldigheid van die PWL se aansprake nie, maar stel ook ondersoek in na waarom vertalings soos die Lamsa-Bybel en PWL so aanloklik is as moderne, kulturele artefakte. A critical evaluation of the Peshitta Primacy theory, Die Pad van Waarheid tot die Lewe translation (Afrikaans Lamsa Bible), and the cultural lure of orientalismA new Afrikaans translation of the Bible, entitled Die Pad van Waarheid tot die Lewe (PWL), meaning "The Way of Truth unto the Life", was published in 2015. It was translated by a South African missionary, Gerrie C. Coetzee. What makes the PWL translation of the Bible unique is its claim that the translation, particularly of the New Testament, is based on the "original" Aramaic manuscripts, written in the same language as that spoken by Jesus, and not on the Greek version as is conventional. To the expert it is immediately evident that the PWL is simply the Afrikaans version of the so-called Lamsa Bible.The purpose of this article is two-fold. Questioned is, first, to what extent the claims made by the Lamsa Bible and the PWL, particularly with regard to the original Aramaic manuscripts, are accurate. In this case attention will be given to the development of the Aramaic language in antiquity since the claims made by Lamsa and the PWL are based primarily on the authority and prevalence of Aramaic. Then a summary of the consensus view related to the New Testament manuscripts (as having been written in Greek) will be given, and this is then compared with the theory of Peshitta primacy as popularised by George Lamsa. Attention will also be given to the critical editions used by the PWL, especially the Khabouris codex. Second, the article also looks at why translations like those of Lamsa and the PWL have gained popularity in Western culture. In order to address this second issue, Edward Said's theory of orientalism will be used.

      Abstract: Die artikel ontleed 'n minder bekende opstel van die kultuurhistorikus Jörn Rüsen waarin hy voorstelle maak oor hoe 'n negatiewe verlede verwerk kan word sodat hierdie verlede uiteindelik "beter" word. Die onlangse opvlamming van protes teen figure soos Cecil Rhodes en Jan van Riebeeck is slegs die jongste voorbeelde van hoe die verlede gemoedere in die hede steeds in beweging kan bring. Dit illustreer terselfdertyd die toekomspotensiaal van herinnering. Rüsen ondersoek die aard van herinnering na aanleiding van 'n gesprek tussen twee karakters uit die bekende Peanuts-strokiesprent. Terwyl Linus meen dat dit verkeerd is om jou oor môre te bekommer, en eerder net aan vandag te dink, is Charlie Brown se antwoord dat dit sou beteken dat ons die handdoek ingooi wat die verlede betref: "Ek hoop nog steeds dat gister beter kan word." Die probleem is egter eerstens dat hy van 'n toekomsverwagting uitgaan wat te beperkend vir sy doel is en tweedens dat hy die toekomspotensiaal van herinnering nie konsekwent ontgin nie. Op voetspoor van Droysen (1977) en Von Ranke (1975) gee hy voorkeur aan 'n teleologiese opvatting van die geskiedenis, naamlik dat alle gebeure uiteindelik op 'n bepaalde doel afstuur. So 'n opvatting laat egter ruimte vir sogenaamde meesterverhale om die verstaan van gebeure te oorheers en vir ideologieë om wortel te skiet. 'n Utopiese geskiednisbeskouing is nie veel beter nie, omdat dit 'n ontkoppeling van die verlede veronderstel en nie duidelik maak hoe laasgenoemde vrugbaar vir die toekoms aangewend kan word nie. Apokaliptiese voorstellings is ook nie bruikbaar nie, omdat die fokus van die toekoms na die hede verskuif en die vernietiging van laasgenoemde die voorwaarde word vir die aanbreek van die einde. 'n Eskatologiese geskiedenisbeskouing is waarskynlik die mees bruikbare vir die "beter word" van die verlede omdat dit van die kontinuïteit tussen hede en toekoms uitgaan en 'n spanning tussen beide veronderstel wat toekomsgerigte optrede stimuleer. Ten slotte is 'n meer konsekwente ontginning van die toekomspotensiaal van herinnering nodig voordat werklik verby 'n negatiewe verlede beweeg kan word. In conversation with Jörn Rüsen on dealing with a problematic pastHow do we deal with a difficult - or worse still, a damning - past? The recent uproar about the statue of Cecil John Rhodes and related "colonial" images and symbols illustrates how vibrant memory can be and how strongly it affects current debates - long after these events were supposed to have been relegated to the past. The critical question is how memories of this kind influence present realities and impact on future developments. In this respect a lesser-known essay with the title Kann gestern besser werden? ("Can yesterday become better?") by the cultural historian Jörn Rüsen offers insights worthy of further exploration. According to Rüsen we are dealing with the contrast between experience and interpretation - a paradox giving rise to two opposing responses: a modern and a post-modern approach. The former follows the "scientific" route and wants to determine - à la Leopoldt von Ranke (1975) - what really happened to arrive at critically tested and objective, reliable knowledge. The latter takes the present as the point of departure, accepting that all knowledge about the past exists only in mediated form, having already undergone a process of interpretation. Since this "linguistic turn", the nature of historiography has changed for many historians, making the concept of "objective" knowledge a problematic one.Rüsen does not accept that the two approaches are mutually exclusive, but understands the contrast as the driving force behind the rapidly expanding memory discourse. The latter requires both the "cold" methodology of scientific historiography and the "warm" activity of collective memory. In order to make sense of history, the "facts" alone do not suffice. At the same time, memory will lose its ability to provide orientation if the past is merely fiction. But for successful sense-making, a change of perspective is needed: instead of taking the past as the point of departure, the future possibilities of memory should be explored. In this way the surplus meaning of historical events is released that can make yesterday become "better". Rüsen takes his cue from an exchange between two of the main characters in the Peanuts cartoon. In one sequence, Linus and Charlie Brown are contemplating life. Linus then asserts, "I guess it's wrong always to be worrying about tomorrow. Maybe we should think only about today ..." After a long silence Charlie responds: "No, that's giving up ... I'm still hoping that yesterday will get better."

  • Van Calvinisme tot Romantiek : die invloed van die Bybel op die
           skrywerskap van Hennie Aucamp : godsdienswetenskappe

      Abstract: Hierdie artikel is die resultaat van my belangstelling in die neerslag van die Bybel en die godsdiens in die Afrikaanse letterkunde en spesifiek in die werk van Hennie Aucamp. Aucamp se omvattende oeuvre sluit sy groot kortverhaaloeuvre in, sy kabaret- en liedtekste, sy dagboeke en memoires. In sy memoires in In die vroegte (2003) skryf hy oor die sentrale rol van die Bybel en huisgodsdiens in die tipiese Afrikanergesin waarbinne hy grootgeword het. Ek bepaal my hoofsaaklik by Aucamp se kortverhaaloeuvre. In dié verband bespreek ek twee verhale uit sy debuut, Een somermiddag, waarin sy alter ego, die kind Wimpie, se skuld- en sondebesef 'n spelbederwer is. Twee personasies verteenwoordig in sy tweede bundel, Spitsuur, die buitestander wat breek met die tradisionele godsdiens van die Afrikanergemeenskap ("Au claire de la lune") en die ek-spreker as reisiger ("My tante wat in Chelsea woon"), wat die voorloper is van die reisende romantikus en van die prominente romantiese en dekadente argetipes in Aucamp se latere werk. Hierdie argetipes is teenpole van die Bybelsgevormde Stormbergse boere in Aucamp se werk wat hy herskep as geesverwante van die wyse manne van Spreuke en Prediker. Waar Aucamp in sy memoires die lewensgevoel in sy kabaret- en liedtekste toeskryf aan die invloed van Prediker en 'n verband lê tussen die Prediker en Eugène Marais, kom ek tot die gevolgtrekking dat Aucamp se dekadentistiese sinisme inderdaad aansluit by die lewensgevoel van die digter van Prediker en van Eugène Marais. By nadere ondersoek blyk egter dat Aucamp se identifikasie van Marais se "Skoppensboer" met Pred. 12 nie klop nie. Aucamp se dekadentisme eggo Marais se hedonisme, maar het in wese niks meer te doen met Prediker nie. In Kommerkrale, Aucamp se "ABC-leerboek", tree Jesus ons drie keer tegemoet as 'n ontluisterde Jesus in tekste wat slegs vae assosiasies met die oorspronklike tekste het. Die Bybel kon vir Aucamp se skrywerskap groter moontlikhede gebied het as hy dit ontgin het aan die hand van insigte van prominente Bybelwetenskaplikes. Dit het wel verhale van blywende betekenis in sy kortverhaaloeuvre gegenereer, sy woordmeesterskap gesmee en neerslag gevind in sy memoires wat daarvan 'n boeiende leeservaring maak.From Calvinism to Romanticism : the influence of the Bible on the oeuvre of Hennie AucampThis article is the result of my interest in the role of the Bible and religion in Afrikaans literature, and in this case specifically in the work of Hennie Aucamp. Aucamp's large oeuvre includes short stories, cabaret and song lyrics, as well as diaries and memoires. I focus on his short stories as they represent the indisputable peak of his writing career.Hennie Aucamp's parents, like mine, belonged to the first generation after the Anglo-Boer War. Both of us were born in the '30s of the 20th century. We inherited an Afrikaner culture in which the Bible and family devotions occupied a central place. The stories and language of the Bible, which has aptly been called "the Book behind the books", have influenced literature, the visual arts, and the music in Protestant countries. Hennie Aucamp's memoires published in his collection In die vroegte (2003) clearly shows his gratitude for what he learnt from his daily interaction with the farmers - of whom his father was one - while growing up on the farm Rust-mijn-ziel in the Stormberge. He honours them particularly for their knowledge of the Bible, which influenced his authorship.Aucamp made his debut in 1963 with a thin volume of eight short stories. The text, Een somermiddag, suggests the blissful years of childhood that Aucamp's alter ego, Wimpie, experienced as a farm boy. However, as a grown-up he describes these happy experiences with a deep awareness of that which complicated and affected this transitory phase of joy. Twice, a shadow of guilt falls over the adventures of Wimpie and his Xhosa friend, Tatties. One scorching summer afternoon, in the title story, they have to collect a cream can. They rest under a train bridge where they disturb a flock of swallows that has its nests there. Tatties takes some of the eggs from the nests. After Wimpie's initial excitement about Tatties's find, he realises that they are guilty of a wrongful deed. He describes it as "a great sin", holds Tatties responsible, and wants to place the eggs back in the nests when Tatties informs him that swallows would not sit on eggs that had been handled by humans. Wimpie takes revenge on his own meanness by ripping the necklace that Tatties made from the shells of the unhatched eggs off Tatties's neck and trampling it to pieces.

      Abstract: Voorstanders van die teodisee beywer hulle daarvoor om die skynbare afwesigheid van 'n alomteenwoordige en liefdevolle God in 'n wêreld vol pyn, lyding en boosheid te verklaar. Dikwels word hierdie skynbare afwesigheid en die bestaan van die kwade gebruik in argumente om die ateïsme te regverdig. Vir gelowiges wat worstel met stellings rakende die ateïsme, is dit egter belangrik om alle eksistensiële kwessies vir hulself uit te maak en 'n spiritualiteit te ontwikkel wat sin gee aan die menslike bestaan - waarvan die kwade onlosmaaklik deel is. Dit dwing die mens om 'n betekenisraamwerk te ontwikkel wat sin verskaf aan die lewe met sy pyn, lyding en boosheid. In hierdie interpretivistiese studie word 'n betekenisraamwerk geformuleer deur bestudering van die literatuur aangaande teodisee en die hel om sin te maak van hierdie lewe se euwels. Uiteindelik word dit duidelik binne hierdie raamwerk dat ons onsself tans in die hel bevind, 'n werklikheid wat die skynbare afwesigheid van God te midde van pyn, lyding en die kwade verklaar sonder om God se bestaan te bevraagteken of te verontagsaam. Tog kom daar nie 'n pessimistiese eksistensiële raamwerk na vore nie, maar 'n uitkyk wat fokus op goddelike versoening en naastediens, waar veral die navorsing van Moltmann insiggewend is.An interpretivist perspective on theodicy and hellAfter a personal experience of prolonged suffering ending in death in my family, existential questions suddenly came to the fore - something I had not anticipated in the preceding months during the fight against disease. I also became more aware of the pain and suffering around me and struggled to make sense of it all. Of course, it is not unusual to ask questions like "Where is God?", "Why does God not prevent this?", "What is God's plan in all of this?" during difficult times. This is the type of question with which scholars of theodicy concern themselves.

      Abstract: Gegrond op etnografiese metodes bespreek hierdie artikel die leerpraktykvorming van plattelandse werkersklasleerders in en oor hul leerruimtes heen. Ons huldig die mening dat alhoewel die invloed van armoede op die opvoedkundige geleenthede van landelike leerders belangrik is, armoede nie die deurslaggewende faktor om is die verskille in die opvoedkundige geleenthede en uitkomste tussen stedelike en landelike leerders te verklaar nie. Die doel met hierdie artikel is om te toon hoe arm plattelandse werkersklasleerders hul woonbuurtomstandighede gebruik om hul leerpraktyke te bou. Wat ons dus bied, is 'n bespreking van hoe landelike werkersklasleerders betrokke raak by die vorming van hul leerpraktyke in hul verarmde woonbuurt. Ons belangrikste uitgangspunt is die siening dat daar 'n gaping tussen die ryk opvoedkundige verbintenisse van plattelandse werkersklasleerders, soos hierdie leerders, en hul leefwêreld buite die skool is. Die gevolg is dat die perspektief heers dat hierdie leerders dikwels ontkoppel is van hul opvoedkundige prosesse. Hierdie artikel bied dus 'n ontleding van die wyses, sowel as die "ruimtelike" en konseptuele grondslag, waarop hulle hul leerpraktyke bou. Ons voer aan dat arm plattelandse werkersklasleerders sterk refleksief met hul omstandighede omgaan tot die bou van hul leerpraktyke. Ons wend ons tot Bourdieu (1977, 1986, 2006) se sosiologiese konsepte van habitus, veld, praktyke en kapitaal as teoretiese lense om die aangeleenthede van hul leerpraktykvorming te verwoord. Sentraal tot ons bespreking is die invloed van hierdie leerders se habitusvorming, dit wil sê die rol wat hul optredes, interaksies en denke in verhouding tot hul leerpraktykvorming speel. Die gevolg is dat hulle strategieë implementeer en ontwikkel, en ook netwerke skep, om hul leerpraktyke in hul omstandighede te bou. Dit is hierdie aangeleenthede wat hulle in staat stel om op koers te bly met betrekking tot hul opvoedkundige prosesse.The learning practice formation of high school learners in a rural working class townThis article discusses the learning practices of five learners in an impoverished rural settlement in the Western Cape province of South Africa. It responds to the following question: How do rural working class learners construct their learning practices in their neighbourhood context? This article does not focus on school learning. Instead, the focus is on the learners' navigations in the "lived" environs of their neighbourhood and the ways in which they use their neighbourhood's resources to establish a productive aspirant educational route. We discuss their dynamic interaction with their everyday networks, literacies, and other discursive materials in the neighbourhood as a means of exercising and establishing their learning agency.This article challenges popular perceptions about the educational paths of learners in impoverished contexts which portray them as victims of the impoverished circumstances and as lacking in the necessary cultural capital for educational success. On the contrary, this article illustrates how such learners are able to maximise their family and community resources in their quest for an education and, as in the case of the young people in this article, how they mediate and utilise the neighbourhood's resources to establish learning practices in support of their education.

           akademiese prestasie van Ekonomiese en Bestuurswetenskappe- (EBW-)

      Abstract: Statistiek aangaande deurvloeisyfers van studente in Suid-Afrika toon dat slegs 35% van die 1ste-jaar-studente wat voltyds vir 'n graad inskryf binne die voorgeskrewe tydperk gradueer, terwyl 48% binne vyf jaar gradueer, maar daar word beraam dat ongeveer 52% van die inname selfs na herhaalde pogings nooit sal gradueer nie. Die oorkoepelende doelstelling van hierdie studie was om die toepas van motiveringsfaktore en leerstrategieë deur 1ste-, 2de-, 3de- en 4de-jaar-EBW-onderwysstudente met mekaar, asook met die studente se akademiese prestasie in die 1ste tot 4de jaar, te vergelyk. Die teoretiese raamwerk het verskeie motiveringsfaktore ingesluit, onder andere doeloriëntering, taakwaarde, selfeffektiwiteit, suksesverwagting en toetsangs, asook leerstrategieë, waaronder inoefening, uitbreiding, organisering, kritiese denke, metakognisie, tydbestuur en bykomende pogings wat 'n rol by akademiese prestasie speel. Hierdie veranderlikes is in 'n kwantitatiewe empiriese studie ondersoek deur gebruik te maak van die Motiveringstrategieë-vir-leer-vraelys (MSLQ - Motivated Strategies for Learning Questionnaire). Ten opsigte van die motiveringsfaktore het die studente van al vier jaargroepe aangedui dat hulle toetsangs in 'n geringer mate ervaar, terwyl hulle 'n hoër mate van suksesverwagting getoon het. Ten opsigte van leerstrategieë is kritiese denke en metakognisie in die kleinste mate toegepas, terwyl organisering veral deur die 2de-jaar-studente in die hoogste mate toegepas is. Verbande tussen motiveringsfaktore asook leerstrategieë en akademiese prestasie is bepaal. Statisties sowel as prakties betekenisvolle positiewe verbande met 'n medium effek (p<0,05; r>0,3) is tussen akademiese prestasie en doeloriëntering by die 1ste-jaar-studente gevind; selfeffektiwiteit, organisering en tydbestuur by die 3de-jaar-studente; en suksesverwagting by die 4de-jaar-studente. Slegs een statisties sowel as prakties betekenisvolle positiewe verband met 'n groot effek (p<0,01; r=0,5) is tussen akademiese prestasie en suksesverwagting by die 4de-jaar-studente gevind.The role of selected motivational factors and learning strategies in academic achievement of Economic and Management (EMS) education studentsThe low throughput rates that occur especially at South African universities are an alarming phenomenon that has a negative impact on the country's economic growth and social development. Several factors, such as the inability of students to work and think independently, poor time management, a lack of study skills, incompetence regarding the language of instruction, and inadequate teaching and learning support at universities may contribute to this problem. Poor throughput rates result in a situation where only a small percentage of qualified students will be available for the labour force. One of the possible causes for the low throughput rate might be nested in the school setting, where many secondary schools throughout the country still persist with rote learning. At university students are responsible for their own study momentum and outputs, which obviously require better management of certain motivational factors and learning strategies.Motivational factors that were investigated in this study encompassed five subscales, namely goal orientation, task value, self-efficacy, success expectancy and test anxiety.

      Abstract: Uit die literatuur blyk dit dat die strafgerigte benaderings wat tans nog oorwegend in skole gebruik word, nie voldoende is vir die bekamping van eskalerende dissiplineprobleme en die ontwikkeling van verantwoordelike gedrag by leerders nie. In hierdie artikel word ondersoek hoe die filosofie en kernelemente van die herstellende geregtigheidsbenadering saamgevat kan word in 'n skoleprogram wat as alternatief vir of aanvulling tot die strafgerigte benadering kan dien.Die huidige situasie met betrekking tot uitdagende gedrag en bydraende faktore daartoe word eerstens in die artikel uiteengesit. Daarna volg 'n bespreking van die verskillende benaderings wat gebruik word om dissiplineprobleme in skole te hanteer. Teen dié agtergrond, en in die lig van die behoefte aan 'n alternatiewe of aanvullende benadering, word die herstellendegeregtigheidsbenadering as 'n moontlike oplossing bespreek. Die verloop en die waarde van internasionale implementering van hierdie benadering word as bydraende agtergrondkennis vir die implementering van 'n soortgelyke program in Suid-Afrikaanse skole bestudeer, terwyl die geskiktheid van skole as ruimtes waarbinne die implementering kan plaasvind, ondersoek word.Die grootste gedeelte van die artikel handel oor die basiese elemente van die herstellende benadering wat in 'n skoleprogram ingesluit behoort te word. Die artikel sluit af met 'n voorgestelde implementeringsprogram.The development of a restorative justice programme as innovative approach to address challenging learner behaviour in South African schoolsAccording to the literature, the punitive approaches that are predominantly being used in schools today are inadequate for solving the escalating problems with regard to discipline and for fostering responsible behaviour in learners. In this article, therefore, which comprises mainly a conceptual study, the authors investigate how the philosophy and key elements of the restorative approach can be collated into a programme that can serve as an alternative to punitive approaches in schools.The current situation regarding defiant behaviour and contributing factors thereto are stated, some of the current burning issues in South African schools are investigated and the historical context which substantially impacted on the education system and communities in general are interrogated. The motto of "liberation before education" from the 1980s embedded a negativity and feeling of disrespect towards structures and discipline (Beets and Van Louw 2005; Smit 2010). The remnants of these trends are still experienced in the current education community when bullying and disrespect towards authority and even among learners themselves are taken into consideration. These factors seem to have an impact on the lack of discipline experienced in a majority of South African schools.Not only is discipline defined by using the views of different authors, but terminology is also clarified through utilising a holistic approach when looking at abnormal behaviour. School communities daily face problems such as bullying, gangsterism, sexual misbehaviour, drug abuse, disobedience and assault and are in dire need of support.

      Abstract: Hierdie artikel fokus op hoe die faktore wat aan onderwysermotivering ten grondslag lê, as 'n verweefdheid van sosiale kapitaal met onderwyserdoelwitte en toepaslike motiveringsteorieë verstaan kan word. 'n Kwalitatiewe gevallestudie-ondersoek is gedoen, gebaseer op individuele onderhoude wat met 12 onderwysers van vier openbare laerskole in Gauteng, KwaZulu-Natal, Noordwes en Limpopo gevoer is. Die geselekteerde skole is op grond van goeie akademiese leerlingprestasie gekies met die aanname dat goeie prestasie 'n goedfunksionerende skool met 'n toegewyde leerkragkorps verteenwoordig. As motivering vir die onderwysberoep het deelnemers die faktore van roepingsbewustheid, finansiële vergoeding, werkverrigting, werksekerheid, die fisiese werksomgewing, en werksverhoudinge met rolspelers as die mees dominante geïdentifiseer. Hierdie motiveringsfaktore is deur die teoretiese lens van sosiale kapitaal soos deur Bourdieu en Putnam ontwikkel, onderwyserdoelwitte soos deur Deemer en Butler beskryf, en die toepaslike motiveringsteorieë van Maslow, McGregor, Herzberg, Thomas en Velthouse, en Vroom ontleed. Die bevindinge dra by tot die diskoers oor die wat en die waarom van onderwysermotivering.Teacher motivation as the intertwining of social capital, teacher goals and applicable motivational theoriesThis article focuses on teacher motivation as an intertwining of social capital, teacher goals and applicable motivational theories. A qualitative investigation was undertaken based on individual interviews with 12 teachers from four public primary schools in Gauteng, KwaZulu-Natal, Limpopo and North-West. The schools were selected according to the criterion of good academic performance. This criterion was motivated by the fact that learners' own ability and the influence of parents as primary educators of their children are complemented by dedicated teachers as a contributing factor to good academic performance.Teachers identified the main factors for teacher motivation as those related to a vocational calling, financial compensation, work performance, job security, the physical work environment and working relationships with stakeholders. These factors were jointly interpreted through the theoretical lens of social capital as developed by Bourdieu and Putnam, teacher goals as described by Butler and Deemer, and the motivational theories of Maslow, McGregor, Herzberg, Thomas and Velthouse, and Vroom. It became clear that teacher motivation is concurrently directed by a satisfying of needs and a vocational calling that manifests as an interweaving of habitus with mastery and relationship goals in order to arrange for group-related cooperation that engenders group-related benefits.

      Abstract: Die doel van die navorsing waarop hierdie artikel gegrond is, is ingebed in die navorsingsvraag: Wat was die belewing van adolessente seuns van die dood van 'n ouer en watter ondersteuning het hulle ontvang in die verwerking van hulle hartseer? Vyf seuns is doelgerig geselekteer om aan 'n kwalitatiewe fenomenologiese navorsingprojek deel te neem. 'n Verskeidenheid tegnieke is gebruik vir die insameling van die inligting. Die individuele semigestruktureerde onderhoude wat met die seuns oor die dood van 'n ouer gevoer is, is aangevul deur 'n fokusgroeponderhoud waartydens hulle gereflekteer het op 'n collage wat hulle oor hulle belewing van die dood van 'n ouer gedoen het. 'n Teoretiese raamwerk en literatuurkontrole is aan die hand van 'n literatuurstudie verkry en die empiriese inligting wat ingesamel is, is op 'n kwalitatiewe wyse verwerk om tot 'n slotsom te kom. A theoretical framework and literature control were obtained by a literature study and the empirical information that was collected was processed to reach a conclusion.The death of a parent is one of the most painful and disrupting experiences for a child. It is important that a child be supported during the mourning process to prevent prolonged grief disorder, complicated or traumatic mourning which is characterised by emotional numbness, feelings of emptiness, decreasing self-awareness, confusion about one's personal role in life, detachment from others, problems regarding acceptance of loss and beliefs in a futile future (McClatchey and Wimmer 2012:32; McClatchey, Vonk, Lee and Bride 2014:70; Schaal, Richter and Thomas 2014:476). The peer group and the people in the environment of the adolescent (the micro-system) play an important role in supporting the bereaved.

  • 'n Ondersoek na die verwerwing van klanke deur middel van musiek deur
           vreemdetaalstudente van Afrikaans : opvoedkunde

      Abstract: Die verwerwing van Afrikaanse klanke en die uitspraak daarvan vorm dikwels die basis van taalverwerwingskursusse. Uitspraak is 'n belangrike aspek in die verwerwing van 'n nuwe taal en daarom behoort die onderrig van uitspraak 'n vername rol in die taalverwerwingsklaskamer te speel. Uitspraak is dikwels vir taalverwerwingstudente die moeilikste aspek om te bemeester. Die gebruik van musiek as hulpmiddel in taalverwerwing is geen nuwe verskynsel nie. Die gebruik daarvan in die onderrig en leer van nuwe tale fokus dikwels op die verwerwing van woordeskat en begrip terwyl die gebruik daarvan om uitspraak en klanke te verwerf, min plaasvind. Min studies oor die gebruik van Afrikaanse musiek om kenmerkende Afrikaanse klanke te verwerf, is al onderneem. Hierdie artikel lewer verslag oor so 'n studie wat onderneem is met vreemdetaalstudente wat Afrikaans op universiteit volg. 'n Gemengde metodologie van kwantitatiewe en kwalitatiewe navorsing is onderneem deurdat vraelyste, klaswaarnemings, musiekroosters en klankopnames in die ondersoek gebruik is om vas te stel of die luister na Afrikaanse musiek die studente help om Afrikaanse klanke te verwerf, asook of dit hulle Afrikaanse uitspraak verbeter. Vier-en-dertig eerstejaarstudente wat vir die taalverwerwingsmodule geregistreer het, het die vraelys, wat hulle onder meer oor hulle eerste taal, hulle algemene Afrikaans-vaardigheid en hulle houding teenoor Afrikaans en Afrikaanse musiek gevra het, voltooi. Twee-en-twintig studente is vir die klankopnames in 'n proefgroep (12 studente) en 'n kontrolegroep (10 studente) verdeel. Die proefgroep moes op hulle eie buite klasverband vir 30 minute per dag vir sewe dae na aanbevole Afrikaanse musiek met lirieke luister en 'n rooster voltooi van die musiek en hoe lank hulle daarna geluister het. Die kontrolegroep het slegs in klasverband blootstelling aan uitspraak en klanke gekry. Die hoofbevindinge is dat die studente baat gevind het daarby om na Afrikaanse musiek met lirieke te luister deurdat 61% van klanke wat aanvanklik nie korrek uitgespreek is nie, na die luister na Afrikaanse musiek wel korrek uitgespreek is.An investigation into the acquisition of sounds through the use of music by foreign language students learning AfrikaansThe acquisition of sounds and the pronunciation of these sounds usually form the basis of language acquisition courses. Pronunciation is an important aspect of the acquisition of a new language and therefore the teaching and learning of pronunciation should play a major role in language acquisition classrooms. Pronunciation is often seen as one of the most difficult aspects to acquire by language learners (Gilakjani and Ahmadi 2011:81) and is often seen as the "Cinderella" of language acquisition courses (Kelly 1969 and Dalton 1997 in Thanasoulas 2000). According to Gilbert (2008:42) there are several reasons for not teaching pronunciation.The use of music as a resource in language acquisition is not a new feature, as seen in Engh (2012), where he reports on the use of music in the '50s through the audiolingual method of teaching and in the '70s in the use of the suggestopedia method. The use of music in the teaching and learning of new languages often focuses on the acquisition of vocabulary and comprehension as well as for creating a relaxed atmosphere in class. The use of music to learn and acquire sounds and pronunciation is not frequent in classrooms and is also not an acknowledged research area in language acquisition. A few studies on the use of music and lyrics to teach and acquire sounds and pronunciation are: Ulate (2007), Brand and Li (2009), Chen (2011) and Romero, Bernal en Olivares (2012). Not a lot of research on the use of Afrikaans music with lyrics to learn characteristic Afrikaans sounds have been undertaken.

  • Dronkenskap as verweer in die Suid-Afrikaanse strafreg : 'n sober
           benadering? : regte

      Abstract: Die Suid-Afrikaanse strafreg het histories 'n ontoegeeflike benadering tot die dronkenskapverweer gevolg, maar later die Engelsregtelike reël van spesifieke opset aanvaar, wat 'n middeweg tussen die ontoegeeflike en toegeeflike benadering bied. Nadat die uitspraak in S v Chretien 1981 1 SA 1097 (A) in wese die reël van spesifieke opset afgeskaf het, moes die wetgewer noodgedwonge ingryp om die gevolge van die uitspraak te beheer. Hierdie artikel ondersoek of die daargestelde Strafregwysigingswet 1 van 1998, en bepaald artikel 1, na wense geformuleer is en 'n sober strafregtelike benadering tot die dronkenskapverweer bied. Dít geskied aan die hand van 'n uiteensetting en vergelyking van die historiese en huidige regstandpunte en wetgewing in Suid-Afrika en Kanada, waarvan die regsontwikkeling in dié opsig duidelike ooreenkomste met die Suid-Afrikaanse toon. In albei jurisdiksies is die spesifieke-opset-reël na ingrypende hofsake afgeskaf en het dit moontlik geword om die dronkenskapverweer te opper vir misdade wat spesifieke opset en dié wat slegs gewone opset vereis. Aanbevelings ter versterking van De Chermont se voorstelle word ook gedoen, naamlik groter duidelikheid oor of artikel 1 vir iemand geld wat weens dronkenskap nie willekeurig kon handel nie, en 'n pertinente bepaling dat artikel 1 toegepas moet word op misdade wat tydens die ligste graad van dronkenskap gepleeg word maar opset nie gevorm kon word nie, indien 'n nalatigheidsopsie ontbreek.Intoxication as a defence in South African criminal law : a sober approach?In the main, a jurisdiction can take one of two approaches to intoxication as a defence in criminal law: the lenient or the unyielding approach. According to the lenient approach, the rules of criminal liability apply to intoxication as they would to any other crime. Perpetrators of crime who were intoxicated to such an extent that they did not act in the juristic sense of the word, were not accountable or could not form intent and may therefore be found not guilty of the offence charged. Thus intoxication may serve as a complete defence. On the other hand, the unyielding approach is based on the premise that it is unacceptable for a sober person to be punished for a crime while an intoxicated person who commits the very same crime goes scot-free. Therefore intoxication does not constitute a complete defence in countries which take the unyielding approach. In a crime-ridden country such as South Africa, which has some of the highest crime statistics in the world, choosing the correct approach is of the utmost importance.Historically, South African criminal law followed the unyielding route, but later adopted the rule of specific intent from English law, which constituted a middle course between the unyielding and more lenient approach. However, after the notorious Chretien judgment in essence disposed of the rule of specific intent, South Africa leaned towards the lenient approach. The legislature had no choice but to promulgate legislation in an attempt to contain the effects of that judgment.This article explores whether that legislation, the Criminal Law Amendment Act 1 of 1988, and in particular section 1, has been optimally formulated to provide a sober criminal law approach to intoxication as a defence. This occurs by way of analysing and comparing the historical and current legal positions and legislation in South Africa and Canada, as the development of this aspect of the law in the two jurisdictions shows certain striking similarities. In both jurisdictions the rule of specific intent was abolished following radical court rulings - Chretien in South Africa and R v Daviault 1994 3 SCR 63 (1994) in Canada - which paved the way for the defence of intoxication to be raised both in respect of crimes that require specific intent and in respect of those that require only general intent. For the sake of order, both jurisdictions had to promulgate legislation: The South African Criminal Law Amendment Act has created a statutory crime in section 1, of which an accused who committed a crime while intoxicated may be convicted. The amended Canadian Criminal Code, in turn, has codified the defence of voluntary intoxication, clearly stipulating the requirements for its use.

      Abstract: Rehabilitasie na sekwestrasie ingevolge die Insolvensiewet 24 van 1936 is die enigste wyse waarop 'n natuurlike persoon ingevolge die Suid-Afrikaanse verbruikersinsolvensiereg 'n kwytskelding van voorinsolvensie skuld op sy of haar skuldeisers kan afdwing. Alhoewel skuldenaars ook skuldverligting kan bekom deur die prosesse van administrasie en skuldhersiening te inisieer, maak hierdie prosesse nie vir enige kwytskelding voorsiening nie. Verder: alhoewel 'n kwytskelding een van die gevolge van rehabilitasie is, is dit nie 'n hoofdoelwit van die Insolvensiewet om skuldverligting aan skuldenaars te verleen nie en is 'n kwytskelding beskore slegs vir skuldenaars wat oor voldoende bates beskik om voordeel vir skuldeisers te bewys. Insolvensiebeperkings en onbevoegdhede wat voor en na rehabilitasie op skuldenaars van toepassing is, moet sover moontlik afgeskaal word en die wetgewer moet aandag gee aan wetgewing en meganismes wat op die bevordering van verantwoordelike kredietgebruik gerig is.Rehabilitation in South African consumer insolvency law : international trends and guidelinesRehabilitation after sequestration in terms of the Insolvency Act 24 of 1936 is the only way in which a natural-person debtor may force a discharge of pre-sequestration debts on his or her creditors. Although a debtor may obtain debt relief by implementing the income restructuring procedures of administration in terms of section 74 of the Magistrates' Courts Act 32 of 1944 and debt review in terms of section 86 of the National Credit Act 34 of 2005, these procedures do not provide for any discharge of debt. Moreover, although a discharge of debt is one of the consequences of rehabilitation, the primary object of the Insolvency Act is not to grant debt relief to harassed debtors, but rather to benefit creditors. The act lays down advantage to creditors as a prerequisite for sequestration applications and rehabilitation and the concomitant discharge of pre-sequestration debts are thus only available to debtors who have sufficient disposable assets to prove advantage. As opposed to this, rehabilitation, and thus the opportunity to obtain a so-called fresh start, is an important feature of consumer insolvency systems worldwide.Over the past few decades the world has witnessed not only a strong increase in the granting of credit to individuals, but also a sharp increase in the levels of consumer over-indebtedness. However, the South African situation is unique as the system has to deal with a developed first world economy as well as a developing third world economy that reflects in consumer patterns and needs. Probably as a consequence of apartheid, the position is still that some consumers can obtain credit from the conventional financial institutions while the majority have to approach the so-called micro-lenders that grant loans at high interest rates. The question thus arises whether the South African system, with an insolvency act that dates from 1936, provides for adequate debt relief measures to comply with all needs. However, it should be clear that the system is extremely creditor-oriented and over the past 20 years several commentators have repeatedly requested law reform that would bring about a more balanced approach. Among other things, the view is that the exclusion of certain debtors, commonly known as the "no income no asset debtors" (NINA debtors), from a discharge procedure merely because they are not able to prove advantage, may be unconstitutional as it infringes their fundamental right of equality.

      Abstract: Turquand and estoppel : birds of a feather?The representation of companies has always been a problematic and complicated aspect of company law. In this case discussion the approach of the court in One Stop will be critically analysed. It will be argued that the application of the Turquand rule is not dependent on whether the business structure possesses legal personality or whether the doctrine of constructive notice applies. Furthermore, the importance of making a distinction between the doctrine of estoppel and the Turquand rule will be illustrated. The judgment is unclear in many respects - especially in relation to the application of the doctrine of estoppel in light of the fact that the doctrine of constructive notice has been abolished. By describing the Turquand rule as a special application of the presumption of regularity, the court failed to recognise the Turquand rule as an independent rule which forms part of substantive law. Even though some reform has been introduced pertaining to the principles of the representation of companies, the application of these principles is still far too complex and needs to be simplified. A model similar to the one used under the Close Corporations Act 69 of 1984 is suggested.

  • 'n Kritiese betragting van die kieswetgewing ten opsigte van gelyke kanse
           vir politieke partye : regte

      Abstract: Hierdie artikel fokus op drie aspekte van die kieswetgewing wat die reg op gelyke behandeling en geleenthede van politieke partye en die beginsel van vrye en regverdige verkiesings beïnvloed. Die eerste deel van die artikel kyk na sowel die registrasie van partye om aan verkiesings deel te neem, as herregistrasie- en deregistrasievoorskrifte. In dié konteks is 'n ontleding van die statutêre definisie van die begrip politieke party van besondere belang, daar dit die kern van demokratiese wedywering om kiesersteun raak. Die huidige definisie is nie versoenbaar met 'n meerparty-kiesstelsel in 'n parlementêre demokrasie nie, omdat dit aspekte van 'n blokstelsel kondoneer. Tweedens word die voorgeskrewe depositovereiste ontleed. Daar word getoets of ander maatreëls nie meer geskik is om die statutêre doelwit, naamlik die beperking van 'n ooraanbod van partye wat nie 'n werklike kans het om beduidende kiesersteun te wen nie, te bereik nie. Die depositovereiste word hoofsaaklik in state met meerderheidkiesstelsels benut, terwyl state met proporsionele kiesstelsels eerder 'n verkiesingsdrempel of ander metodes benut om die aantal partye tot 'n oorsigtelike demokratiese keuse te beperk. Laastens word gekyk na die statutêre regulering van besware oor ongerymdhede tydens 'n verkiesing. Tans is die termyn waarbinne beswaar aangeteken kan word, uiters kort, wat 'n negatiewe uitwerking op die regverdigheid van verkiesings het omdat die sperdatum vir besware reeds afloop terwyl stemme nog getel word.Equal chances of political partiesThis article focuses on three aspects that affect equal chances for political parties to garner voter support in free and fair elections. The first aspect concerns the registration, reregistration and deregistration of political parties. The statutory definition of political party is of cardinal importance because it is central to democratic competition in a parliamentary democracy. In general it is accepted that a political party is based on voluntary association of persons with the same political goals.In South Africa most political parties are likely to be constituted as a universitas personarum, what can loosely be called a voluntary corporation as opposed to voluntary association. As distinct from voluntary associations, voluntary corporations have legal personality separate from their members and accordingly the capacity to acquire rights and incur obligations separate from their members, as well as the capacity to sue or be sued in their own names. They have perpetual succession in that they continue to exist regardless of changes in their membership. This common law classification, however, does not distinguish political parties from other political organisations such as non-governmental organisations.

      Abstract: Die identiteit van minderjariges word nie bekendgemaak tydens hofverrigtinge nie. Sowel getuies as slagoffers en oortreders kry hierdie vergunning en word deur die wetgewer beskerm. Hierdie beskerming verval egter wanneer hulle 18 jaar oud word. Indien hulle nie die howe nader vir 'n verbod op die publikasie van hul identiteit nie, is daar geen remedie vir sulke persone nie. Hierdie bydrae kyk spesifiek na die posisie van anonieme minderjarige getuies, slagoffers en oortreders wanneer hulle 18-jarige ouderdom bereik. Dit word gedoen om te bepaal of hierdie persone se identiteit met die bereiking van 18 jaar bekendgemaak moet word en of hulle wel geregtig op verdere anonimiteit is. 'n Ander kwessie is of 'n veroordeelde minderjarige misdadiger anders as getuies en slagoffers by die bereiking van meerderjarigheid behandel moet word. Die moontlike effek van media-aanslae op die emosionele ontwikkeling van sulke 18-jariges word ook onder die soeklig geplaas. Die twee uiteenlopende gevalle van Zephany Nurse en die Griekwastad-seun word met mekaar vergelyk. Die een was 'n slagoffer in 'n babadiefstalsaak en die ander 'n veroordeelde minderjarige oortreder. Albei is nou ouer as 18 jaar en waar die een se huidige identiteit deur 'n hofbevel beskerm word, is die ander se identiteit al verskeie kere bekendgemaak nadat hy 18 geword het.Daar word ook verwys na 'n Engelse saak waar beslis is dat twee veroordeelde minderjarige oortreders se nuwe identiteite wel verswyg moet word na hulle 18 jaar oud geword het, omdat die familie en vriende van hul slagoffer moontlik die wet in eie hande kon neem. Daar word aanbeveel dat die wetgewer oorweging daaraan moet skenk om die bekendmaking van die identiteite van minderjarige getuies, slagoffers en oortreders by die bereiking van 18-jarige ouderdom te hersien.The disclosure of the identities of anonymous minors upon the age of majority : clean slate or dismal fate?The identity of all minors is protected during court proceedings. This protection of nondisclosure of identities is available to witnesses, victims and offenders, but expires when they turn 18. Should they desire the further protection of identity, the only option is to approach the courts for the necessary relief. This essay examines whether the identity of these persons should be released at 18 years or whether they are entitled to further anonymity. Another issue is whether a convicted minor criminal should qualify for the same protection as victims and witnesses.Two different cases, one of a victim and the other of a convicted criminal, are analysed. While both persons are now older than 18 years, the one's current identity is protected by a court order, while the other's identity has been published in the media on various occasions. Zephany Nurse was kidnapped when she was a 3-day-old baby and her kidnappers had her registered under a different name, the current name by which she is known. Zephany is the name given to her at birth by her biological parents, but it is her assumed name given to her by her kidnappers which she has requested the court not to reveal. In terms of a court order the media undertook not to disclose Zephany's current name.

           regskliniek - 'n delikate spankoord : regte

      Abstract: Regsklinieke vorm deel van die regsfakulteite van universiteite en vervul 'n belangrike rol in die opleiding van regstudente. Studente word toegerus met kennis van die werk in 'n regspraktyk, welke kennis grotendeels aan hulle oorgedra word deur hulle toe te laat om praktiese diens by regsklinieke te doen as deel van 'n kursus in hul kurrikulum. Een van die onderrigmetodes wat deur regsklinieke gevolg kan word, staan bekend as die lewende-kliënt-onderrigmetode, welke metode die basis van hierdie artikel vorm. Ingevolge hierdie onderrigmetode staan die studente minderbevoorregte persone by deur hulle met regsadvies en ander regswerk te help en verskaf sodoende regstoegang aan die publiek. Op hierdie wyse verkry studente kennis uit dit wat hulle sien en doen, wat as ervaringsleerbekend staan. Aangesien regsklinieke deel van die regsfakulteite van universiteite vorm, is dit vanselfsprekend dat die oordra van praktykskennis aan studente ook 'n akademiese komponent insluit. Beide praktiese en akademiese komponente is belangrik ten einde te verseker dat studente die nodige praktyksopleiding verkry. Hierdie twee komponente vorm gesamentlik wat kliniese regsopleiding genoem word.Dit kan egter gebeur dat een van hierdie komponente voorkeur bo die ander geniet. Dit sou beteken dat die studente nie aan die afgeskeepte komponent blootgestel word nie en hul praktiese opleiding dus nie wesenlik is nie. In hierdie verband moet dit egter nooit uit die oog verloor word dat kliniese regsopleiding, hetsy dit 'n verpligte kursus of 'n keusevak in die LLB-program is, 'n bepaalde kurrikulum het wat gevolg moet word nie. Gevolglik is dit belangrik om toe te sien dat alle komponente waarvoor die betrokke kurrikulum voorsiening maak, noukeurig nagevolg word.Die vertrekpunt is dus dat daar in 'n regskliniek, waar die lewende-kliënt-onderrigmetode gevolg word met betrekking tot aangeleenthede wat litigasie kan vereis, 'n balans moet bestaan tussen regstoegang en studente-opleiding vir doeleindes van die regspraktyk. Die gewenste balans tussen die twee komponente sal bepaal word, asook hoe dit reggestel kan word indien dit nie bestaan nie. Die argument wat die basis van hierdie artikel vorm, is dus dat daar tydens die verlening van regstoegang aan die publiek opleiding aan die studente verskaf moet word. Die uiteindelike bevinding is dat studente-opleiding die belangrikste faktor is en dat regstoegang daaruit voortvloei en dit aanvul.The balance between clinical legal education and access to justice per se in a law clinic - a delicate tightropeLaw clinics form part of the law faculties of universities and play an important role in the practical education of law students. Students, mostly in their final year of legal studies, are educated and trained with regard to aspects of legal practice, which education is to a large extent conveyed to them by letting them do practical work at law clinics. This teaching method - which is not necessarily the only teaching method followed by all law clinics - may form part of the curriculum of the particular law faculty. This article is based on a particular teaching method followed by some law clinics called the live client teaching method. In terms of this teaching method, law students assist indigent members of society by providing them with legal advice, as well as with other legal matters, thus providing access to justice to the public. In doing this, the students gain knowledge by observing and executing certain tasks. This is known as experiential learning. Furthermore, it goes without saying that because law clinics form part of the law faculties of universities, this particular type of teaching and learning must include an academic component. Therefore both practical (providing access to justice) and academic (teaching and learning) components are of importance in ensuring that the students undergo the best possible practical legal training. Together, these two components culminate in clinical legal education.
