      Abstract: The Irish Tax Institute in conjunction with the Harvard Kennedy School of Government, recently hosted the 2016 annual Global Tax Conference in Dublin. Besides drawing experts from fellow tax institutes, the conference was also attended by key policy role players in the field of international tax. Notable participants included Pascal Saint- Amans, the director of the Center for Tax Policy and Administration at the OECD, as well as Robert Stack, the U.S. Assistant Secretary ofTax Policy. Valere Moutarlier from the European Commission also attended. Unsurprisingly, speakers from the public sector made most of the headlines.

  • Pay now, argue later - principle : when must you pay SARS? : tax
           administration disputes

      Abstract: In general commercial litigation where a claim for an outstanding amount is brought against a person, the person is not required to make payment to the claimant until a court has adjudicated on the issue. However, in terms of tax matters SARS is entitled to collect amounts owing by a tax payerin terms of an assessment. Although there are various remedies that the taxpayer can follow if they disagree with the assessment, in most instances the taxpayer will be required to pay the amount claimed by SARS regardless of the validity of their objection and hope to later reclaim the amount disputed.

  • SVDP - start preparing now : maitland

      Abstract: The Special Voluntary Disclosure Programme (SVDP) will be a joint tax and Exchange Control (Excon) process and will be open for a six-month period from 1 October 2016 to 31 March2017. It serves as a final window of opportunity for taxpayers to regularise their offshore affairs before the tidal wave of reporting in terms of the OECD Common Reporting Standard (CRS) reaches the SA Revenue Service (SARS) from 2017 onwards. Regularising under the SVDP program would in most cases result in the applicant's overall cost of compliance - for both tax and Excon - being half of what it would have been had the applicant regularised under the current voluntary disclosure programme (VDP) and Excon regimes. The SVDP could therefore, in broad terms, be said to have brought about an additional 50% relief, which is a concession welcomed by many. The sting in the tail, however, is that if the assets concerned are in a trust, then the applicant has to elect that the assets be treated as his own for all tax purposes (which, unlike the 2003 Amnesty, will include Estate Duty).

  • Do revised prescription rules bear serious consequences for the taxpayer?

      Abstract: The tax authority now has more powers to decide on the prescription of an assessment, following recent amendments to the Tax Administration Act (TAA), No 28 of 2011. Prior to the amendment of Section 99, an assessment prescribed after three years in respect of returns assessed by SARS and after five years in respect of self-assessment taxes. However, it has become common practice for SARS to negotiate the extension of the prescription period with taxpayers. It has not always been clear why SARS required this extension, given the amount of time they had to perform the audit, ask for information and make enquiries after the assessment date.

  • Common myths regarding "pay now, argue later" : tax administration
           disputes

      Abstract: Since last year January, when the number of factors that SARS is required for take into account when considering an application to suspend the "pay now, argue later" principle was reduced from eight to five, it seems to have had an effect on the mindset of taxpayers seeking to suspend the "pay now, argue later" principle. In many people's minds, it has created the impression that the taxpayer now carries a greater evidential burden when it comes to successfully proving that SARS should suspend the principle. However, these changes should not cause taxpayers to think that they have no option but to pay, pending finalisation of the dispute. "Pay now, argue later" is not set in stone and many misconceptions exist regarding the burden of proof required to successfully appeal against pay now argue later.

      Abstract: Gone are the days when taxpayers could conceal income and assets from the taxman. The advent of the Tax Administration Act (the Act), coupled with a number of international tax initiatives has handed SARS an expansive set of powers to gather information. The volume and detail of the information that is available to SARS through various provisions under the Act is extensive. SARS is able together information directly from taxpayers, third parties and will soon be exchanging data with foreign revenue authorities.

  • Understanding the Tax implications of the youth wage subsidy : employees

      Abstract: The Youth Wage Subsidy,which came into being through the Employment Incentive Act No 26 of 2013 (ETIA), allows employers to claim a deduction on the amount of PAYE they have to pay over to SARS based on the number and salary of qualifying employees, provided that certain conditions are met. Since its inception in January 2014, the Employment Tax Incentive (ETI) has been both fiercely criticised and praised. It will no doubt again draw the political spotlight before it either comes to an end in December 2016 or is extended.

      Abstract: In general, South Africa imposes VAT at the standard rate of 14 percent on the supply of goods or services on a destination basis, that is, VAT is borne by the final consumer of goods or services within the country. The primary mechanism to ensure that only local consumption is taxed in SA is through the zero rating (0 per cent) of goods and services exported from SA and the levying of VAT on the importation of goods and certain services.

      Abstract: As any child with a neighbourhood clan and some ball-sense will tell you, the first rule of backyard cricket is that you allow the kid whose bat and ball you're playing with some leeway when it comes to obeying the rules that dictate the sport. Failure to do so will probably result in Johnny or Jane storming off, bat in hand and screeching something along the lines of, "you're not nice, you can't play any more". So when Barack Obama issued South Africa with an ultimatum in November 2015, the South African government wisely began to show signs that it would step away from what it believed was a justified position with regards to how it taxes and tests chicken imports.

  • Are you being tax wise when it comes to your retirement? : business

      Abstract: South Africans are notorious procrastinators when it comes to saving for retirement. One study showed that upon reaching retirement age, 64 percent of people had to cut back on their expenses; 31 percent had to carry on working in order to make ends meet; and 16 percent of people are entirely dependent on state pensions. This is not a sustainable situation, and government has enacted a number of laws to try and encourage retirement saving in particular, as well as savings in general.

      Abstract: Once, I went swimming in the sea and turned my ankle on a rock. The water was too cold for me to feel it, so it was only the next day that it swelled up so much I couldn't walk. Imagine this moment as a metaphor for most of my adult life : so distracted, so detached from feeling that I didn't know my body was broken until I couldn't use it. This is how I fixed it and how you can too.

      Abstract: Although the Dog and Fig Brewery outside Parys is little more than an hour away from Johannesburg, you may as well have bought an aeroplane ticket, had your passport stamped, and then stumbled upon a foreign brewery where conventions and corporate life have been deported from memory. You should not expect to find beer sold to you in standard 340ml bottles. Here the liquid gold is housed in 750ml "champagne" bottles topped with cork and wire.

  • Thuli Madonsela - protecting the public : ICON
    • Abstract: Thuli Mandonsela has played a pivotal role in the shaping of South Africa's post-apartheid history. Sure, she has struggle credentials, but she has also been part of drafting the Constitution, considered to be one of the best in the world. As the third Public Protector, she has dealt with complaints without fear or favour. President Jacob Zuma, who appointed her in 2009, can attest for this. She was selected as the winner of Transparency International's Integrity award for 2014 and in 2015 the African Women Chartered Accountants (AWCA) honoured her with the Woman of Substance Award.

      Abstract: The old RSA was as broke as two short planks. Mandela and Mbeki placed enormous emphasis on education as the solution to South Africa's problems. The money followed, to the extent that today more than 20 percent of the tax Rand is spent one ducation. The biggest spend of all. And it doesn't seem to be solving the problem.
