  • How Much Brandeis Do the Neo-Brandeisians Want'

      Abstract: The Antitrust Bulletin, Volume 64, Issue 4, Page 531-539, December 2019.
      The neo-Brandeis school of antitrust has suddenly emerged as a viable challenger to the reigning consumer welfare establishment. Assuming the mantle of Brandeis gives the neo-Brandeisians a historically grounded brand but also comes with some baggage. Among other things, the neo-Brandeisians need to be prepared to answer the following questions: (1) Will they follow Brandeis in seeing bigness as a curse not only in business but also in government' (2) Will they break cleanly with welfarism and adhere to a moral, social, and political theory of anti-bigness, even at the cost of efficiency' and (3) Will they commit themselves genuinely to Brandeis’s empiricism—that facts on the ground trump theories, wherever the facts may lead'

  • The Profound Nonsense of Consumer Welfare Antitrust

      Abstract: The Antitrust Bulletin, Ahead of Print.
      Despite being the prevailing wisdom, consumer welfare antitrust rests on a bed of nonsense. First, consumer welfare antitrust is built on false history and a rewriting of legislative intent. Second, it relies on a false conception of the market and submerges the state construction of the economy. Third, it depends on, and is informed by, false assumptions about business conduct. While the third falsehood suggests an analytical renovation and better antitrust economics are sorely needed, the first two falsehoods show that empirical improvements are necessary but not enough. These falsehoods together mean that the entire enterprise at present is built on a bed of sand and that a fundamental reconstruction of antitrust is required. An antitrust that promotes an equitable economy and protects democratic institution will be true to legislative intent, recognize the state construction of the marketplace, and informed by empiricism.

  • How Chicago Economics Distorts “Consumer Welfare” in Antitrust

      Since the publication of Robert Bork’s The Antitrust Paradox, lawyers, judges, and many economists have defended “consumer welfare” (CW) as a standard for decisions about antitrust goals and enforcement priorities. This article argues that the CW is actually an empty concept and is an inappropriate goal for antitrust. Judge Bork adopted CW from economics where welfare unambiguously measured utility or well-being. Welfare economists concede that there is no credible measurable link between price and output and human well-being. This means that the concept of CW does not legitimate limited antitrust enforcement nor does it justify the exclusion of other antitrust goals that require more active enforcement practices. This article contends that antitrust policy is not welfare based at all and, that if it were, antitrust policy and enforcement would differ significantly from the Chicago School vision. Without the fiction that economists can establish that in the short run lower price and higher output measurably increase welfare more than other goals, recent defenses of the CW standard resolve down to arguments based on unsupported assumptions.

      Market competition is faltering in important parts of the U.S. economy. Measures commonly used by economists to evaluate firm-level economic performance now indicate that many firms have market power and are earning profits above competitive levels. The expected response—the entry of new firms that want to earn a share of those higher returns in those markets—has not happened. This is a consequence of barriers to entry, arising from a variety of sources including increased market concentration, the increased use of intellectual property protection in the form of patents, the rise of business models dependent on network externalities, and the rising importance of digital data as an input in production. The principal conclusion of this article is that antitrust policy must be reoriented to effectively limit the creation of barriers to entry. An example of how merger policy could be changed is developed.

  • Monopsony Power and Guest Worker Programs

      Guest workers on visas in the United States may be unable to quit bad employers due to barriers to mobility and a lack of labor market competition. Using H-1B, H-2A, and H-2B program data, we calculate the concentration of employers in geographically defined labor markets within occupations. We find that many guest workers face moderately or highly concentrated labor markets, based on federal merger scrutiny guidelines, and that concentration generally decreases wages. For example, moving from a market with a Herfindahl-Hirschman Index of zero to a market comprised of two employers lowers H-1B worker wages approximately 10%, and a pure monopsony (one employer) reduces wages by 13%. A simulation shows that wages under pure monopsony could be 47% lower, suggesting that employers do not use the full extent of their monopsony power. Enforcing wage regulations and decreasing barriers to mobility may better address issues of exploitation than antitrust scrutiny alone.

  • How Much Did Baseball’s Antitrust Exemption Cost Bob Gibson'

      Major League Baseball was granted an exemption to antitrust laws in 1922 by the Supreme Court. This exemption led to the creation of a monopsonistic labor market that prevented baseball players from fielding offers from other organizations once that player signed with any Major League Baseball team. Economic theory predicts that such a market would reduce a worker’s wage below a worker’s marginal revenue product. The question this study seeks to address is how much wage depression existed before the introduction of free agency in baseball in 1976. Specifically, we will examine the Hall-of-Fame career of Bob Gibson, a career that ended in 1975. Our examination will not only explore the standard approach economists have used to answer this question for more than forty years but also a simpler approach that gives a more realistic answer to the question.

  • Antitrust Standing after Apple v. Pepper: Application to the Sports
           Betting Data Market

      In Apple v. Pepper, the U.S. Supreme Court expressed a largely permissive view about whether certain potential plaintiffs have legal standing to pursue antitrust lawsuits in federal court. The Apple v. Pepper ruling provided important clarity about the scope of the so-called indirect purchaser rule set forth forty-plus years earlier in Illinois Brick. This paper first summarizes the key takeaways from the Apple v. Pepper decision released on May 13, 2019, positioning the ruling vis-à-vis other standing-related cases that have sometimes closed the courtroom doors to plaintiffs alleging anticompetitive conduct under the Sherman Act and Clayton Act. This paper then applies the lessons from Apple v. Pepper to sports betting data, an emerging tech-focused market. This paper concludes by outlining how—and why—this market will likely be subject to antitrust scrutiny soon.
