  • The Thabametsi Case: Case No 65662/16 Earthlife Africa Johannesburg v

      Abstract: ABSTRACTThis analysis considers South Africa’s first climate change-related judicial decision, the Thabametsi case, in which the court considered the quality and form of climate change impact assessment required when a competent authority assesses an application for environmental authorisation in South Africa. Notwithstanding the lack of an express legal obligation to conduct a focused climate change impact assessment, the court ruled that climate change is a relevant consideration when granting an environmental authorisation, and a formal expert report on climate change impacts is the best evidentiary means to consider climate change impacts in their multifaceted dimensions. Drawing upon a theoretical framework recently put forward by Preston, the analysis argues that the Thabametsi bench has made a meaningful contribution to climate change litigation, particularly through the manner in which the court addressed equality before the law and the rule of law.

  • Unpacking the Diversity of Procedural Environmental Rights: The European
           Convention on Human Rights and the Aarhus Convention

      Abstract: ABSTRACTProcedural environmental rights have been found to be an effective way of securing environmental protection, but they are often discussed as a single, uniform standard and are associated with similar effects on environmental decision-making. This view needs reconsideration. Comparing the procedural environmental rights guaranteed in Europe by the European Convention on Human Rights (ECHR) and the Aarhus Convention (AC), this article argues that these rights differ considerably in objective, content, and scope. Taking note of these differences helps to concretise the doctrine of procedural environmental rights and supports more realistic conclusions about the contribution of procedural environmental rights to environmental governance.

  • Growing Together: The Impact of the Regulation of Non-Innovative
           Activities on Agricultural Innovation Governance

      Abstract: ABSTRACTThis article focuses on one of the most hotly contested interfaces around innovation—that between the organic sector and agricultural sectors that adopt innovation, using two case studies: genetically modified crops and nanotechnology. Through an analysis of four supranational and national regulatory frameworks for organic agriculture the article demonstrates how important difficulties are caused for innovation governance by regulations meant for non-innovative activities. These difficulties adversely impact consumers and the feasibility of coexistence between innovation adopters and non-adopters. More broadly, the article demonstrates why regulatory frameworks for non-innovators should be included in innovation policy considerations.

  • Narratives of Capital versus Narratives of Community: Conservation
           Covenants and the Private Regulation of Land Use

      Abstract: ABSTRACTDrawing on experiences in other jurisdictions, this article takes the Law Commission’s 2014 proposals for the introduction of a ‘conservation covenant’ as occasion for reflection on the problems with utilising private law mechanisms as vehicles for furthering the collective interest in environmental protection. It argues that the certainty and security provided by private property relations may come at the expense of openness to environmental and social complexity, raising concerns regarding environmental justice. It considers how the legitimacy of any reform might be increased, arguing that fairer provision of opportunities for public involvement would be necessary to secure the promised public environmental benefits. It highlights the potential for better collection and dissemination of information about covenants and for the involvement of a more diverse range of actors in monitoring and enforcement. Overall, however, the primary role of the parties to a conservation covenant limits the extent to which it could be a suitable mechanism for setting or securing public conservation priorities.

      Abstract: ABSTRACTEnvironmental Justice, as an influential movement in the USA, has generated significant policy outcomes because of executive mandate of its adoption in federal agencies. Whilst its initial premise emphasised health consequences of pollutants on underprivileged communities—particularly communities of colour—the concept has additional resonance as a correction to the dominant neo-liberal paradigm in natural resource management, particularly as it applies to rural and remote communities in Australia. This article uses the lense of environmental justice to consider climate change in Australia, considering in particular the effects of marketisation of the natural resource management issues.

  • Three Years After the French Energy Transition for Green Growth Law: Has
           the ‘Energy Transition’ Actually Started at the Local Level'

      Abstract: ABSTRACTIn August 2015, the French Parliament adopted the Energy Transition for Green Growth Law. This law contains ambitious qualitative and quantitative targets to be implemented by 2030. In line with what literature has shown, an important share of the success of this energy and climate policy relies on local governments. The law, which was adopted at the same time with decentralisation reforms, creates a lot of new opportunities for local authorities to take action. Thus, there is wholesale energy governance reform. Almost three years after the adoption of the Energy Transition for Green Growth Law, this article aims at presenting the new energy governance framework in France. It also examines how local governments have used their new powers and to what extent they can contribute to the national energy transition. Indeed, although a lot is expected from them, several barriers and challenges stand on their way.

  • At the Intersection of the Sacred and the Legal: Rights for Nature in
           Uttarakhand, India

      Abstract: ABSTRACTIn March 2017, the High Court of Uttarakhand in India ruled in the Ganges and Yamuna and the Glaciers cases that the Ganges and Yamuna rivers, the Gangotri and Yamunotri glaciers, as well as other natural objects in the state of Uttarakhand enjoy legal rights. In both cases, the High Court established the natural objects as legal minors and conferred guardianship responsibilities on several individuals within the state government of Uttarakhand. These judgments create novel legal rights for nature and, as such, present powerful examples of the increasing relevance of rights-centred environmental protection. The impact of this case law, however, is uncertain. As a start, the legal rights entrusted to nature are underpinned by such broad definitions of ‘harm’ that it is difficult to envision successful implementation. Further, the Ganges and Yamuna case is currently stayed pending appeal to the Supreme Court, which may decide to overturn the High Court’s findings. Still, these cases are important to analyse, especially in light of how constructing nature as a legal subject/legal person shifts environmental law away from public law and into the sphere of private law. Also, the Ganges and Yamuna case draws explicitly on Hinduism to support the sacred status of the Ganges and Yamuna rivers, which, in the current context of the Hindu Nationalist Movement, may prove controversial.
