  • The Threat to Facility Time in the Trade Union Act 2016—A Necessary
           Austerity Measure?

      Abstract: The various provisions of the Trade Union Act 2016 (TUA) pose possibly the greatest threat to trade union freedom since the raft of anti-union Conservative legislation enacted between 1979 and 1997. These new restrictions have been comprehensively documented and analysed in the recent special issue of the Industrial Law Journal. Nevertheless, the threat to facility time for trade union workplace representatives, those at the coalface of trade union activism, is less well publicised. The Act puts at risk the paid time off which union representatives have come to expect as a right, and a vital adjunct to their role and responsibilities. This particular aspect of the new legislation carries potentially the greatest threat to the ability of trade unions to organise and bargain collectively, as it could undermine the ability of representatives to represent their members effectively and to promote membership in the workplace.

  • Introduction: Contemporary Issues in Collective Labour Law

      Abstract: The papers in this special issue were first presented at a conference held in Mander Hall, London, in October 2013, with financial support from the Modern Law Review and the Institute of Employment Rights. The title of the conference was ‘The Changing Face of Collective Labour Law’, and its purpose was to celebrate the scholarly contribution of Bob Simpson to the development of collective labour law across a career spanning four decades. The title for the conference echoed the title of a well-known article by Bob Simpson from 2001 and was chosen to reflect the focus of much of his work on collective labour law and the history of collective labour law.11 The Industrial Law Journal was keen to publish a selection of these papers as a symposium on ‘Contemporary Issues in Collective Labour Law’. In all of the articles, the scholarship of Bob Simpson is taken as a point of departure for the authors. Nevertheless, each article is concerned with broader issues of legal and theoretical significance in collective labour law. In this way, the special issue is concerned to look to the current and future challenges of collective labour law, rather than to lament the fading of its past glories and to mourn the Twilight of the Gods.

  • Collective Bargaining, Equality and Migration: The Journey to and from
           Brexit

      Abstract: Bob Simpson has documented the evolution of collective labour laws in the UK over several decades and his scholarship reminds us of their intended and unintended consequences. In the highly politically charged context of the 2016 Brexit vote, this article considers how UK and European Union (EU) laws have shaped the nature and scope of collective bargaining in the UK and, thereby, income differentials and equal treatment in the workplace. While it would be possible to provide for equality of treatment between local British and migrant labour in ways that reduce social tensions, instead we have witnessed the imposition of legal frameworks that place workers in a position of competition rather than solidarity. The mistrust of current forms of migration from the EU seems to have been one key part of the journey towards the Brexit vote. An important question is what comes afterwards. If Brexit does not proceed, we should be contemplating reform at both UK and EU levels; but the problems identified here seem unlikely to evaporate in the event of either ‘soft’ or ‘hard’ Brexit. The article concludes that the UK situation offers a salutary reminder to other EU States of the dangers of dismantling systems of sectoral bargaining and mechanisms for extension of collective agreements.

  • New Perspectives on Collective Labour Law: Trade Union Recognition and
           Collective Bargaining

      Abstract: Drawing on the Manifesto for Labour Law published earlier this year, we consider Kahn-Freund’s assessment of British labour law (for the first three quarters of the twentieth century) as voluntarist, abstentionist collective laissez faire as espoused by Bob Simpson. In contrast (and utilising Simpson’s tool of ‘law in context’), we point up the role of the state during this period in implementing labour law policy in support of extensive collective bargaining by the use of public law powers (in the contemporaneous sense in which such law was understood). Drawing on this legacy, we set out the measures by which collective bargaining, in particular at sectoral level, might be restored. We deal with the establishment of Sectoral Employment Commissions consisting of equal numbers of employers and union representatives (similar to the old Joint Industrial Councils). In default, tripartite bodies based on the extinct Wages Councils would be established. We propose the (re) use of ‘fair wages clauses’ (ie public procurement arrangements) to require participation in collective bargaining and the observance of collective agreements. We consider the reciprocal issues of representation at the workplace, union access thereto and reform of the recognition machinery, taking in Simpson’s analysis of the current and earlier recognition legislation.

  • Some Reflections on the ‘Personal Scope’ of Collective Labour
           Law

      Abstract: The purpose of this article is to focus on a very topical aspect of labour/employment law, namely that of its personal or relational scope, which is usually regarded as an individual one, but which we argue has a significant and largely neglected collective dimension. A first introductory section proposes a normative framework for this inquiry, arguing for a more inclusive approach to relational scope where collective labour rights are engaged and finding a basis for this approach in ILO Recommendation No 198. A second section demonstrates the way in which the relevant jurisprudence of UK labour/employment law has seemed to be out of accord with that normative approach. A third section demonstrates how the case law of the ECJ and CJEU has also in its own way been unsympathetic to claims that self-employed workers should be brought within the fold of collective labour law, particularly with regard to collective bargaining. A fourth section further develops a supranational perspective upon these arguments, concentrating on arguments and pronouncements emanating from the European Committee for Social Rights. A fifth section considers ways in which novel scenarios of differentiation between ‘labour’ and ‘capital’ are presenting themselves in the context of the so-called ‘gig economy’, focusing on the very recent UK Employment Tribunal decision in the Uber case. A sixth concluding section expresses the hope that the article has opened up a largely untrodden path towards an authentically collective view of the debate about the personal scope of labour/employment law.

  • The Impact of the Law on Industrial Disputes Revisited: A Perspective on
           Developments over the Last Two Decades

      Abstract: This article revisits research carried out by the authors in the 1990s into the impact of the law on industrial disputes. A resumé of that work recalls the responses of union negotiators; this demonstrated considerable success in adapting their strategies in both negotiations and disputes in which industrial action was threatened in order to avoid or minimise the adverse impact of the changing legal requirements—or even adopt these requirements to their advantage. A further survey of union negotiators in the mid-1990s disclosed relatively optimistic expectations for amendments to the law by a Labour government which would make the legal framework for negotiations and disputes broadly acceptable. Our small survey of national union officials carried out during the period of the 2010–15 coalition government reflected the failure of the 1997–2010 Labour governments to make the requirements of the law on, in particular industrial action ballots, both more certain and less demanding on union resources. While the relative optimism of the 1990s had not come to fruition, trade unions’ ability to adapt to changing circumstances, which was a central feature of our earlier work, was still evident, albeit at a greater cost to their resources in a more restrictive legal environment.

  • ‘Individualism’ and ‘Collectivism’ in Collective
           Labour Law

      Abstract: This article examines the concepts of ‘individualism’ and ‘collectivism’ in collective labour law. A popular critique of freedom of association norms characterises such norms as ‘individualist’ or ‘individualistic’. This individualist bias undermines the institutions of collective labour relations. The ‘individualist’ critique is often coupled with the development of an alternative positive account of collective labour law that is based upon a foundation of ‘collectivism’. ‘Collectivist’ labour law encompasses a concern for collective or group rights, rather than rights for individuals; it affirms collective values; and the metric of legitimacy of a legal regime of freedom of association is the extent to which it supports collective bargaining through independent trade unions. On this conventional approach, ‘individualism’ and ‘collectivism’ stand in opposition to each other. This article argues against this dichotomous understanding of ‘individualism’ and ‘collectivism’. A comparative perspective on the ‘right to organise’ supports the view that individual and collective rights can stand in a complementary relation to each other. Furthermore, the union’s right to exclude may sometimes legitimately yield to competing individual rights, such as the right not to be subjected to unjust discriminatory treatment. The important task for labour lawyers is to identify an effective combination of collective and individual rights in order to promote just and decent outcomes in the workplace.
