  • In Pursuit of Truth

      Abstract: In the past few years a wave of right-wing populism has swept the western world and we have seen emotions take the political helm. The voting booth triumphs of Donald Trump in the United States and Brexit in the United Kingdom were affective: they stoked racist, sexist and nativist sentiments while campaigning on social, economic and legal issues. In short: they moved the electorate, and thereby gained control. As Hillary Clinton explains, these tactics are designed to ‘keep people off balance and make them think that this will, if not make their lives better, make them feel better’ (emphasis ours).11 We might therefore say that feelings brought Trump to power and propelled the Brexit campaign in Britain. We might equally suggest that they continue to drive these political and legislative agendas. The Trump administration has already demonstrated an unprecedented reliance on the executive order as an exercise of presidential will, issuing an abundance of executive actions – legally enforceable actions – that have predominantly targeted Muslims, immigrants, LGBTQIA+ people, and women, groups who were also the focus of emotionally-charged, hateful rhetoric on the campaign trail.22 Meanwhile, in the UK, the Brexiteers continue to insist, as they did throughout the referendum campaign to leave the European Union, upon the need to reclaim ‘sovereignty’. This is an amorphous concept which they characterize, in explicitly legal terms, as the act of taking jurisdiction (and thereby control) back from the courts of the European Union; in practice it has come to stand in popular parlance for a certain brand of nationalistic fellow-feeling.33 Feelings also inform the forces resisting those agendas. Consider, for example, the crowd-sourced legal action to challenge the British government’s attempts to initiate Brexit without parliamentary involvement.44 Or the countless immigration lawyers who waited for hours with fellow protesters in American airports following the issuance of Trump’s ‘travel’ ban, ready to represent those whose arrival in the country might be impeded.55 These cases all dealt with constitutional issues, and even in the word ‘constitutional’, a word we have heard a great deal in recent months, we can see the interplay of emotional and legal connotations. This word encompasses a technical legal meaning in the notion of a country’s founding legal document or principles, but it also bears the idea of a human constitution, a disposition or emotional make-up. Ours is a moment in which we are forcefully reminded of the emotional content of law.66

  • Emotion, Deliberation and Political Authority in Philip Massinger’s
           the Roman Actor

      Abstract: In carefully distinguishing between the immediacy of emotive impulses and the deliberation that transforms intent into action, Philip Massinger’s The Roman Actor details the limits of both theatrical efficacy and royal authority in Caroline England. Massinger pursues this argument initially through a juxtaposition of two key scenes – the private embassy of Parthenius to Domitia and the actor Paris’ defence of the theatre – and then in a series of inset dramas. The result is a play that rejects the immediacy of tyrannical authority in favour of a conceptualization of both theatrical and political power whose emphasis on delay yields a dynamic that is fundamentally collaborative rather than imperial. In staking such a claim, Massinger also foreshadows modern arguments for the centrality of emotions to juridical and political judgment.

He is the author of Imagination and Politics in Seventeenth-Century England (Ashgate, 2008) as well as of numerous articles on the intersections of law, early modern literature and political history in such journals as Studies in English Literature, Journal of British Studies, Huntington Library Quarterly, University of Toronto Quarterly and Milton Studies. He has recently completed a monograph-length project on deliberation and political change in seventeenth-century literature.

      Abstract: This essay traces the intersections of truth, law and emotion in Thomas Tomkis’s 1606 play Lingua: Or the Combat of the Tongue and the Five Senses for Superiority, in which the title character appeals for full status as a Sense. Moments of judgment structure the play, and suggest an overarching effort to seek truth in spite of the muddiness introduced by deceitful senses and heightened emotion. Although the bulk of the play emphasizes the volatility of the Five Senses, their susceptibility to emotion, and the unreliability of the ‘truths’ they report, it is Lingua who is ultimately ‘contained’ by the play’s legal structures. Nonetheless, Tomkis invites us to consider this vision of law’s power as little more than a fantasy.

  • Revenge and its Attenuation: Honour and Affect in Cervantes and

      Abstract: For Miguel de Cervantes and Mateo Alemán, honour culture generates an excessively volatile interplay of shame and anger. More often than justice, the results are deception, vindictiveness and disproportionate violence. Alemán depicts such agonistic passions as deeply embedded in human nature, and attempts to channel them to positive effect via rational reflection, creating the conditions for empathy and even compassion. Cervantes, also recognizing the common inclination to anger, revenge and duplicity, proposes the affective bonds of friendship as an antidote to the divisive operations of honour. The medieval Cantar de mío Cid, which suggests a transition from personal, zealous vengeance towards collective, rational justice, is an important background work for both early modern authors.

      Abstract: Letters in early modern England were quotidian, especially amongst Inns of Court men. This article focuses on 1612–13, a year of political crisis leading to the arrest of Thomas Overbury. It considers the fear generated by epistolary practice, and the creation of emotional bonds, in a selection of letters written by legally trained men. Used regularly as proof in legal cases, letters could lead to imprisonment or execution, and their preservation or eradication was vital. The article examines the dramatic representation of letters as part of legal discourse in The White Devil (1612) by John Webster, himself a Middle Temple man. As the article concludes, the context and circumstance of epistolarity are vital to a consideration of their truth.

  • ‘The Vow is Made’: Communal Swearing and Succession in Titus

      Abstract: This article considers the extent to which William Shakespeare’s Titus Andronicus endorses a politico-legal system in which succession can be authorized by communal swearing. Through exploring instances of vowing in relation to the rhetorical and affective properties delineated by the Bond of Association, this article debates whether the transference of power from one regime to another is as smooth as it first appears when sovereignty is legitimized by the emotional component of a group vow. The sustained emphasis on fellow-feeling as a central aspect of group vowing does not always result in implementation of the conciliar power structures emblematized by the spectacle of communal swearing on stage. Rather, it can be a method by which personal ambition is fostered through manipulation of the perceived association between mass pledging and political consent by ambitious claimants.

  • Emotional Justice in Agrippa d’AubignÉ’s Tragiques

      Abstract: In his 1616 Tragiques, a long poem on the French Wars of Religion published in the wake of the Edict of Nantes, Agrippa d’Aubigné articulates his position as a witness through a poetics of justice, which he identifies by its capacity to move readers (rather than simply teach them). The aim of Aubigné’s testimony is esmouvoir, to move in the service of justice. Whether this be from the perspective of the historical eyewitness, the martyrologist or the divinely inspired prophet, the poet continually strives to conjugate emotion and justice in the context of post-civil-war France. Staging a struggle to identify ‘just’ emotions across genres, ethical positions and historical moments within a single work, the Tragiques register the multiple and contradictory forces that constrained Protestant memory of the wars of Religion.

  • ‘What’s the Matter'’ Murderous Husbands and ‘Adulterous’
           Wives in Early Modern English and Spanish Drama

      Abstract: This essay situates two wife-murder plays, Shakespeare’s Othello and Calderón’s El médico de su honra, in a transnational cultural context of anxieties about adultery, cuckoldry and female sexuality, all of which are both affective and legal. Neither Shakespeare’s Desdemona nor Calderón’s Mencía has committed adultery, but in these plays that does not matter. Mere suggestion is enough to convince husbands of their wives’ guilt and, fuelled by a dangerous combination of rhetoric and passion, suspicion all too easily becomes proof. Quintilian’s idea of vividness, or enargeia, is central to this process, and this essay considers enargeia’s role in creating belief in early modern drama, its legal afterlife in a nineteenth-century adultery case, and its role in the modern courtroom.
