  • Law, Religion, and Debt Relief: Balancing above the ‘Abyss of Despair’
           in Early Modern Canon Law and Theology

      Abstract: AbstractDebt forgiveness is at the heart of the gospel message. The Lord sent His Son to redeem the debts of the world created by Adam and Eve and that were transmitted to subsequent generations of humanity. The New Testament restored older biblical ideas of debt relief, such as the Jubilee. The Lord’s Prayer begs God to forgive the pious their debts, as they also forgive their debtors (Mt 6:12). Yet what, if anything, does that mean for legal practice' Is there a Christian mode of debt collection and enforcing contractual promises' Should Christian creditors refrain from exercising their rights' This paper explores the responses to these questions given by canon lawyers and moral theologians in sixteenth- and seventeenth-century Europe, many of whom belonged to the so-called ‘School of Salamanca’. They took natural law as the ultimate measure to evaluate the lawfulness of man’s actions in the world. I conclude that these moral and legal experts were sensitive to the needs of indigent debtors, but certainly not to the point of promoting debt cancellation. They insisted upon the bindingness of contractual promises (pacta sunt servanda) and considered postponing repayment to be the most appropriate manner to deal with insolvent debtors. Debt relief in the strict sense was viewed suspiciously, since the marketplace is subject to the dictates of justice, not charity.

  • A Miscellaneous Network: The History of FIDE 1961-94

      Abstract: AbstractThe article provides new insights into the nature, functioning, and academic output of the Fédération international pour le droit européen. It concludes that the federation provided a space for contestation inside the transnational field of European law. While the congresses under the auspices of the federation did constitute a setting for legal mobilisation, diffusing knowledge on European law, and networking among judges, academics, private practice lawyers, and business representatives, these practices were subjected to the organisational and ideologically diverse character of the federation and changing institutional affiliations. Neither organisationally nor ideologically did the federation and the ‘Euro-law associations’ constitute a cohesive network in an ideological confrontation with sceptical national actors, despite the close affiliation between the federation and the Commission’s Legal Service in the 1960s, the European Court of Justice in the 1970s, and banks and corporations in the 1980s.

  • The Poll Tax before Jim Crow

      Abstract: AbstractThe poll tax is best known as a tool of disenfranchisement. Before Jim Crow, however, the poll tax served a variety of other fiscal and social purposes. Initially, the poll tax was a mainstay of colonial taxation, especially in the southern colonies. After independence, the fiscal importance of the poll tax waned, but its role as a tool of social control grew. Local government imposed its own poll taxes, contributing to a large cumulative burden. During presidential Reconstruction, state and local governments returned to antebellum tax practices. Poll taxes were supplemented with occupational taxes, often imposing a larger burden on tradesmen than large landowners. With the advent of universal manhood suffrage, new state constitutions limited poll taxes, while directing the revenue raised to education. The end of the congressional Reconstruction brought a gradual increase in poll taxes. Decades later, the poll tax became a prerequisite for voting across the South.

      Abstract: AbstractThe emergence of a new form of originalism has sparked an interest in the theory’s past that is particularly welcome as developments on the Supreme Court and in the Republican Party unsettle the theory’s place in American law and politics. Our understanding of the theory’s development, however, has been limited by an unfortunate and unnecessary division between what are now two separate histories of originalism. One history examines the theory’s development in academia and emphasizes the influence of principled argument. A second investigates its role in politics and highlights the role of conservative interests. This review essay identifies this division and offers two ways to create a productive dialogue. It first suggests we consider how political interests have shaped the academic debates over originalism by influencing the institutions that produce those debates. Second, it urges a reconsideration of how and why academic debates have shaped the theory’s political uses. There is good reason to consider whether principled constitutional argument, and thus the debates of academics, has shaped the political uses of originalism even if the theory’s most important advocates were motivated mostly–or even entirely–by the pursuit of political advantage. Using these approaches to identify the reciprocal influence of politics and principle on originalism’s past can help produce the new history of originalism we need to understand, evaluate, and influence the theory’s role in American law and politics.

      Abstract: We are fortunate to present in this issue a retrospective of William Novak’s book The People’s Welfare: Law and Regulation in Nineteenth-Century America. The essays published here were presented originally as a panel at the Policy History Conference in Nashville in June 2016, entitled “The People’s Welfare at 20: William J. Novak’s Pioneering History of the Early American State.” Publishing these essays affords us an opportunity to assess not only the impact of an important book two decades in to its existence, but also the state of a field. Legal history is a becoming a vibrant field of both history and law, and Novak’s book has played an important role in that development.

      Abstract: In 1838, the Massachusetts legislature banned the sale of alcohol in quantities smaller than fifteen gallons. The temperance crusaders who had lobbied for the law hoped to curb the consumption of whiskey in taverns and grog shops. This goal was hardly lost on the workingmen and immigrants who drank at these places, and they didn’t hesitate to object. And infamously on militia day in Dedham, Massachusetts in 1838—a day traditionally filled with hard drinking and revelry—an enterprising businessman painted stripes on a pig and invited the men to view his freak of nature for the cost of six cents. They came in droves to view the strange beast, in no small part because any paying viewer was treated to a complimentary glass of whiskey. With no alcohol sold, no law was broken. By all reports, the “striped pig” proved such an interesting sight that the men returned again and again to catch a glimpse. Militia day remained a wet affair in Dedham; liquor dealers throughout the Bay State resourcefully circumvented the new regulation; and the Massachusetts legislature soon repealed the Fifteen Gallon Law and returned to licensing the sale of liquor.11

      Abstract: In addition to offering hilariously long lists of local regulations, The People’s Welfare addresses some of the largest and most interesting questions in the field of U.S. history, for instance what Novak calls the “fundamental tension in the coexistence of a heightened American rhetoric of individual liberty with a constant and historic readiness to employ the coercive state powers of regulation and police.”11 In the legal history context, Novak challenged those who believed the purpose of state and local lawmaking in the nineteenth century was to destroy barriers to commerce and to unleash the nascent energy of the new nation. Rather, Novak plumbed the myriad ways policymakers regulated and restricted not only in the name of economic development but also with the goal of promoting community well-being, that is, to create a “well-regulated society.”

      Abstract: I am very much indebted to the participants in this AJLH Retrospective for their thoughtful commentaries and reflections. To have such a diverse group of cutting-edge and creative scholars like this one organizing a roundtable around the continued impact of a 20-year-old legal-history monograph is an honor indeed. For much has changed in the intervening two decades concerning the primary fields and questions originally addressed in The People’s Welfare. As Roman Hoyos notes in his “Introduction,” legal history has long since become an extraordinarily “vibrant field” of inquiry in both history as well as law. A recent directory of American law teachers noted that almost twice as many law professors declared a subject matter interest in legal history than in “law and economics,” or “law and literature.”11 Gautham Rao’s excellent survey of current developments in the historiography of federal policymaking testifies to a similar recent explosion of interest in the history of the American state.
