      Abstract: Now that we are starting our third volume as co-editors of the relaunched American Journal of Legal History we want to write with news of some transitions and also about what the journal and its authors have achieved over the past two years. First the transitions. Roman Hoyos, who has been our book review editor for the Americas for the past two years, is leaving us. Roman is looking forward to spending time completing his forthcoming book on the “people” in state constitutional conventions in the middle of the nineteenth century. We have been fortunate to have his energy and his thoughtfulness in putting interesting reviewers together with exciting recent books in the Americas. Moreover, Frédéric Audren, who has been our book review editor for the rest of the world for the past two years, is leaving us. We very much appreciate Frédéric’s dedication. The book reviews have been some of the most exciting and most-read parts of the American Journal of Legal History over the past two years.

  • “In a Democracy We Should Distribute the Lawyers”: The Campaign for a
           Federal Legal Service, 1933--1945

      Abstract: ABSTRACTTo build its many unprecedented bureaucracies, the American New Deal heavily relied upon recent graduates of elite law schools, in a break with prior practice and to the increasing annoyance of congressmen and senators. To head off an attempt to entrust the selection of government lawyers to the Civil Service Commission, in January 1939, President Franklin D. Roosevelt appointed a committee, chaired by Stanley Reed and including two other Supreme Court Justices, Felix Frankfurter and Frank Murphy, to study the question. In April 1941, he accepted the recommendation of the lawyers on the “Reed Committee” and created the Board of Legal Examiners, headed by Solicitor General Francis Biddle (soon replaced by Charles Fahy) and managed during its first, crucial year by Herbert Wechsler, who was on leave from the Columbia Law School. As conceived especially by Frankfurter, the Board’s mission was to create an American counterpart to the British Civil Service, in which lawyers advanced to increasingly important posts throughout the executive branch. Although wartime conditions hampered the Board, it administered a national exam that provided greater access to government jobs than had the New Deal’s version of an “old boys network,” which drew heavily upon the law faculties of Harvard, Columbia, and Yale. Congressional hostility persisted, however, and was joined by the opposition of a powerful veterans’ lobby. The Board’s response to this pressure is instructive for a time when government lawyers and other professionals are being denounced as members of an anti-democratic, Deep State.

      Abstract: ABSTRACTThe concept of the “outlaw” provided antebellum abolitionists with a powerful rhetorical weapon in their challenge to the Southern slave system. They vigorously condemned the practice of placing slaves and free blacks outside the law through official and informal outlawry. Calling attention to racial discrimination in criminal laws and the under-protection of African Americans against violence, critics contended that systematically excluding a large category of people from the protection of law flouted foundational American values, most notably rule of law, equal protection, and due process. Yet there were variations in the ways abolitionists used the outlaw concept. Particularly sharp distinctions in tactics and standpoints are evident between blacks and whites, as well as between lawyers and clergymen. Differences are also apparent between those willing to work within the political system and those eschewing politics. Some abolitionists used outlaw rhetoric in an abstract manner to demonize slaveholder regimes and provide ideological support for rule of law, while others used it to encourage an active role by African Americans in ending slavery and achieving racial equality through resistance on Southern plantations and in Northern streets. Tactically, some insisted on the importance of obedience to law while others declared the illegitimacy of oppressive laws and the need to defy them with violence if necessary in order to achieve justice. Analysis of abolitionists’ use of the concept of the outlaw, which reveals a previously unexamined element of legal rhetoric, not only exemplifies divergent approaches within the abolitionist campaign but also illuminates early American critical perspectives on racial issues that persisted long after the Civil War.11

  • The Lawfulness of Gender Reassignment Surgery

      Abstract: ABSTRACTIn the common law world, both the medical and legal professions initially considered gender reassignment surgery to be unlawful when first practised and discussed in the first half of the twentieth century. While most medical procedures are covered by the medical exception to the law governing serious offences against the person, many doctors and the lawyers they consulted doubted that this exception applied to gender reassignment surgery. In this article I trace the differing and changing interpretations of the medical exception as applied to gender reassignment surgery, and the shift towards legal acceptance in the two common law jurisdictions that led the way in both performing gender reassignment surgery and debating its legality, the United States and the United Kingdom. Although this shift occurred without formal legal intervention either through legislation or judicial decision (for example on a test case), inferences of legality drawn from related civil-law decisions bolstered the legal acceptance of gender reassignment surgery.By increasing the suffering of patients and potential patients, the criminal law played both an important and primarily malign role prior to the eventual public, professional and legal acceptance of GRS. A real threat of criminal prosecution inhibited doctors from proceeding, distorted diagnoses and affected the kinds of procedures performed. After-care was expanded and manipulated to avoid the risk of prosecution or the appearance of unlawful surgery. By contrast, civil and administrative law played a more positive, albeit indirect, role in interpreting the medical exception and its application to gender reassignment surgery.

           Progress

      Abstract: ABSTRACTCadwallader D. Colden and Thomas Addis Emmet could not help but practice intellectual property law: Robert Fulton was their client. Yet their engagement with the subject went far beyond what professional expediency demanded. Their transatlantic backgrounds and careers encouraged their affinity for liberal political economy and for entrepreneurial adventure. On the frontier, in the shadowy zones between early-nineteenth-century empires and land speculations, the line between enterprise and piratical intrigue was easily leapt, and Colden and Emmet were involved in the era’s cross-border confusions. More typically, their work anticipated a world where private business and public improvement were managed in tandem, by interested franchisees, and underwritten by more sophisticated financial arrangements. The defense of Fulton’s patent privileges was an unabashed apology for banks, corporations, and wealth. These lawyers celebrated canals and steamboats and argued that such tangible achievements were impossible without a flexible understanding of property. Their practice was bound up in the franchise model of development and reconciled government patronage with what was then, and is still, a controversial and liberal vision of progress.
