      Abstract: The Grand Chamber of the Court of Justice of the European Union (EU) (CJEU/Luxembourg Court), the EU’s highest court, is gaining a reputation for its more purposive and expansive interpretation and application of EU data protection law. This is particularly so in relation to the right to data protection, as guaranteed by Article 8 of the EU Charter of Fundamental Rights (EU CFR) which became part of EU law in 2009 following the entering into force of the Lisbon Treaty [Treaty on the Functioning of the EU (TFEU)].

  • Shattering one-way mirrors – data subject access rights in practice

      Abstract: Key PointsThe right of access occupies a central role in EU data protection law’s arsenal of data subject empowerment measures. It can be seen as a necessary enabler for most other data subject rights as well as an important role in monitoring operations and (en)forcing compliance.Despite some high-profile revelations regarding unsavoury data processing practices over the past few years, access rights still appear to be underused and not properly accommodated. It is especially this last hypothesis we tried to investigate and substantiate through a legal empirical study.During the first half of 2017, around 60 information society service providers were contacted with data subject access requests. Eventually, the study confirmed the general suspicion that access rights are by and large not adequately accommodated. The systematic approach did allow for a more granular identification of key issues and broader problematic trends. Notably, it uncovered an often-flagrant lack of awareness; organization; motivation; and harmonization.Despite the poor results of the empirical study, we still believe there to be an important role for data subject empowerment tools in a hyper-complex, automated, and ubiquitous data-processing ecosystem. Even if only used marginally, they provide a checks and balances infrastructure overseeing controllers’ processing operations, both on an individual basis as well as collectively. The empirical findings also allow identifying concrete suggestions aimed at controllers, such as relatively easy fixes in privacy policies and access rights templates.

      Abstract: Key PointsGovernments and businesses are increasingly collecting, analysing, and sharing detailed information about individuals over long periods of time.Vast quantities of data from new sources and novel methods for large-scale data analysis promise to yield deeper understanding of human characteristics, behaviour, and relationships and advance the state of science, public policy, and innovation.The collection and use of fine-grained personal data over time, at the same time, is associated with significant risks to individuals, groups, and society at large.This article examines a range of long-term research studies in order to identify the characteristics that drive their unique sets of risks and benefits and the practices established to protect research data subjects from long-term privacy risks.We find that many big data activities in government and industry settings have characteristics and risks similar to those of long-term research studies, but are subject to less oversight and control.We argue that the risks posed by big data over time can best be understood as a function of temporal factors comprising age, period, and frequency and non-temporal factors such as population diversity, sample size, dimensionality, and intended analytic use.Increasing complexity in any of these factors, individually or in combination, creates heightened risks that are not readily addressable through traditional de-identification and process controls.We provide practical recommendations for big data privacy controls based on the risk factors present in a specific case and informed by recent insights from the state of the art and practice.

           information sharing in public–private partnerships

      Abstract: Key PointsLegitimacy of public–private partnerships (PPPs) for combatting cybercrime partially depends on whether or not law enforcement data processing is subject to the same data protection-related restrictions, whether they involve cooperation of private parties or not.Information sharing within PPPs is a complex phenomenon with various configurations and power structures. This complexity needs to be accounted for in the analysis of the applicability of the two data protection regimes.The GDPR as a general data protection instrument and the Police Directive as a lex specialis are meant not to let the private–public data transfers fall through the cracks. However, which legal regime applies when private entities and law enforcement act as joint controllers is a grey area of the dual EU data protection regime and may seriously undermine legitimacy of PPPs.Private parties may be subject to less data protection restrictions, eg exempted from the purpose limitation principle, when collaborating with the law enforcement. This may create motivation for the public law enforcement to actively seek such collaboration to avoid legal constraints.It is recommended that the legislative measures creating such exemptions subject private–public data transfers to at least the same conditions of legality of processing as the processing by competent authorities.

      Abstract: Key PointsVarious smartphone apps and services are available which encourage users to report where and when they feel they are in an unsafe or threatening environment.This user generated content may be used to build datasets, which can show areas that are considered ‘bad,’ and to map out ‘safe’ routes through such neighbourhoods.Despite certain advantages, this data inherently carries the danger that streets or neighbourhoods become stigmatized and already existing prejudices might be reinforced.Such stigmas might also result in negative consequences for property values and businesses, causing irreversible damage to certain parts of a municipality.Overcoming such an ‘evidence-based stigma’—even if based on biased, unreviewed, outdated, or inaccurate data—becomes nearly impossible and raises the question how such data should be managed.

      Abstract: Key PointsCompared to the 1995 Data Protection Directive, the General Data Protection Regulation (GDPR) reflects a more developed understanding of de-identification as encompassing a spectrum of different techniques and strengths.And under the GDPR, different levels of de-identification have concrete implications for organizations’ compliance obligations—including, in some cases, relief from certain obligations.Thus, de-identification offers a pragmatic tool to help organizations meet several of their GDPR compliance obligations.Regulators can and should provide additional clarity to new GDPR obligations by interpreting, applying, and enforcing them in a way that encourages and rewards the appropriate use of de-identification.Such an approach will bring clarity to the rules, enable practical tools for compliance, help foster greater consistency with data protection regimes in other jurisdictions, and advance the purposes of the regulation.
