      Abstract: This article traces the development of the adjudicatory jurisdiction of the English courts between the seventeenth and twentieth centuries. The account provides, it is submitted, a number of valuable insights, which call into question current accounts of the common law rules governing both the adjudicatory jurisdiction of local courts and the recognition and enforcement of foreign judgments. The author’s principal contention is that the so-called ‘principles’ of presence and submission, which are central tenets of English private international law, are not only unsatisfactory in principle, but lacking in historical support as elements of the common law landscape.

  • Regulating the Past: The European Court of Human Rights’ Approach to the
           Investigation of Historical Deaths under Article 2 ECHR

      Abstract: This article considers the circumstances in which the European Convention on Human Rights imposes a duty on contracting states to investigate a death that occurred before the state concerned became a party to the Convention. There is a need for clear and coherent rules in this developing area, but the issue of what triggers the requirement for an investigation into the past, and the tests that apply, remain a controversial and uncertain area of Convention law. This paper critically reviews the case law of the European Court of Human Rights on the duty under article 2 of the Convention to investigate historical deaths. In particular, it analyses the ‘genuine connection’ and ‘Convention values’ tests first established by the Court in the case of Šilih v Slovenia (2009), and subsequently refined in Janowiec v Russia (2013), as a means of circumscribing the temporal limits of the procedural duty. It highlights some of the challenges, both theoretical and practical, to which they give rise and considers the potential implications of the Court’s approach on this issue for contracting states. This issue is highly topical in the context of the widening obligation on states under international human rights law to investigate deaths properly, and the increasing use of litigation to seek a remedy for historical injustices.

      Abstract: The dispute over the waters that surround Gibraltar is a major flashpoint in the broader Anglo-Spanish dispute over Gibraltar’s sovereignty. This is to be expected given Gibraltar’s geographical location and its strategic importance as a naval base. This article charts the history of the dispute comprehensively, from the conclusion of the Treaty of Utrecht in 1713 to the present day. It also evaluates the arguments of the parties in accordance with contemporary international law.

  • Jurisdiction by Estoppel and Acquiescence in International Courts and

      Abstract: The doctrines of estoppel and acquiescence, which derive from the general principle of good faith, are well established in certain spheres of public international law, such as disputes over territory. This article examines whether they have a role to play in disputes over the jurisdiction of an international court or tribunal. Can it be said that a respondent has acquiesced in the jurisdiction of a tribunal, or is estopped from denying its jurisdiction' That question is contentious because it is sometimes said that the consensual nature of international jurisdiction excludes the operation of those doctrines. This article submits that the doctrines may be invoked in the establishment of a tribunal’s jurisdiction. While acquiescence is an expression of consent (through silence or conduct), estoppel precludes a respondent from denying that it has consented to the tribunal’s jurisdiction. Both doctrines have a legitimate role to play, and reinforce, rather than undermine, the consensual nature of international jurisdiction.
