  • Institutional arbitration: harmony, disharmony and the ‘Party
           Autonomy Paradox’

      Abstract: Party autonomy has always been regarded as one of the basic axioms on which the international arbitral process is built. In institutional arbitration, the respect for the parties' autonomy is endangered by the autonomy of the arbitral institution. Allowing institutional autonomy to prevail in these circumstances leads to the “party autonomy paradox”: by agreeing to institutional arbitration as an exercise of party autonomy, the parties would at the same time agree to limit that very same autonomy. This article examines the various scenarios in which such a conflict may arise and seeks to strike the right balance beween the respect for the parties’ will and the autonomy of the arbitral institution.

  • Damages for breach of an international arbitration agreement under English
           arbitration law

      Abstract: This essay brings to light—and expands upon—some of Mustill and Boyd’s observations on the remedy of damages for court proceedings wrongly brought. It provides a concise chronological account of the English courts’ power to grant such a remedy, especially, in relation to the infringement of the right to avoid those court proceedings. It also surveys a part of the English arbitration literature as well as various judicial authorities bearing on the subject both before and after the Arbitration Act 1996 came into force. After drawing a distinction between damages for improper initiation of national court proceedings in breach of an arbitration agreement governed by a foreign law and damages for improper initiation of foreign court proceedings in breach of an arbitration agreement governed by English law, the author argues (inter alia) that, as far as English law is concerned, the party against whom court proceedings have been initiated in contravention of an international contract to arbitrate has a common law right to claim compensatory damages in respect of the loss occasioned by the breach. He also argues for the compatibility of this remedy with European Union law and looks at the different fora in which a damages claim can be entertained.

  • International arbitration in a brave new world

      Abstract: This article, based on the keynote address at the AMINZ-ICCA International Arbitration Day held in Queenstown, New Zealand in April 2018, is a thought experiment. There is now considerable friction in the international economic system. Let us imagine that it continues so that political capital is no longer available to defend economic globalization from its discontents. This would affect international arbitration, which has become the mode of international dispute resolution best suited to resolving the commercial and investment disputes to which economic globalization has given rise. The article reasons that, if economic globalization does ebb, then, (i) international dispute resolution institutions will be harder to sustain and build; (ii) new global problems will continue to arise and require resolution; and (iii) it will be in the interests of international arbitration to diversify and align itself to seek these alternative opportunities. The central argument is that successful realignment may require a certain degree of self-reflection by the international arbitration community. It is not easy to be both architects of and adjudicators in the same system. In a brave and uncertain world, we should all take care to avoid perceptions of overreaching our mandate.

  • Hypothetical release damages: a ‘one-size-fits-all’ way to establish a
           loss in international investment disputes'

      Abstract: The article discusses the problem faced by the investors who succeeded in establishing the liability of the states for violating international investment treaties, but failed to prove that they had suffered losses and, accordingly, recover any reparation for the internationally wrongful acts suffered at the hands of the states. The article suggests that some inspiration for resolving this problem arisen in the realm of public international law can be drawn from English private law and, particularly, Wrotham Park Estate Co Ltd v Parkside Homes Ltd [1974] 1 WLR 798. Following this methodology, the article provides a reinterpretation of the Chorzów Factory principle that can potentially help the investors establish a loss where no loss can otherwise be established under more traditional approaches to valuation. The article argues that in such cases, the investors should be able to claim damages for the loss of the investors’ opportunities to charge the states for the investors’ consent to the acts otherwise internationally wrongful.

  • Pope Gregory the Great and the Disputes of Sardinian Women 591–604

      Abstract: Pope Gregory the Great wrote hundreds of letters to all corners of the Roman Catholic world during his papacy AD590–604. They conveyed his wishes concerning the behaviour of his flock, but many of them were also about disputes and his recommendation for their resolution. It is striking that his preference was for mediation and arbitration over litigation, and he was clear how that should be carried out. A discrete example of this preference can be found in letters he wrote to Sardinia, particularly concerning the disputes of women there.

  • Financing arbitration in mainland China: Hong Kong’s legislation as
           a model

      Abstract: Hong Kong has enacted a bill to amend its Arbitration Ordinance, in order to formalize financing arbitration and to make it clear that third-party funding (TPF) for arbitration is not prohibited by the common law doctrines of maintenance and champerty. While Hong Kong takes a courageous step on legislative reform, arbitration industry in mainland China is also flourishing and presents a rapid growth trend. By examining the legislative processes held by Hong Kong as a legal–financial model as well as employing a law–economic research methodology, it can be proved that TPF will enable the parties in dispute with easier access to justice, promote the quality of arbitral awards, as well as increase the welfare of the whole society. Therefore, it is justifiable to introduce TPF into arbitration seated in mainland China. Simultaneously, arbitration professionals should consider establishing a self-discipline mechanism to regulate TPF to maintain the legality of arbitral proceedings involving TPF.
