  • Admissibility of claims in investment treaty arbitration

      Abstract: (In)admissibility of claims is a well-known doctrine in international litigation, which allows international courts or tribunals, having assumed jurisdiction over an international claim, to refuse exercising that jurisdiction.Investment treaties, as well as the International Center for the Settlement of Investment Disputes (ICSID) Convention, prescribe detailed jurisdictional requirements covering various issues that are commonly regarded as relating to the admissibility of claims in general international law (e.g. nationality). Accordingly, questions arise as to what role (if any) the concept of admissibility has to play in investment treaty arbitration. Cases and scholarly writings are divergent and inconsistent as regards this question.The article suggests some guidelines in this respect. Generally, and subject to any treaty provision to the contrary, it argues that recourse for the doctrine of admissibility as a bar or limitation to the exercise of jurisdiction over investors’ claims should be made with considerable caution.It is further suggested that the ‘ancestral roots’ of various conditions for the State’s consent (eg the prior local recourse period), while not altering the jurisdictional nature of such requirements, justify adopting median solutions, such as staying the proceedings for a certain period of time, instead of dismissing the claim.

  • Adverse inferences in investor–state arbitration

      Abstract: This article surveys investor–state arbitration decisions regarding the use of adverse inferences. There is a jurisprudence constante on the treatment of the adverse inference. Absent an agreement by the parties, international investor–state arbitrators have the inherent authority to draw adverse inferences from a party’s unjustified non-compliance with an order to produce information. The authority derives from the actual authority in admitting and weighing the evidence, and in establishing the arbitration procedure. Despite the authority, investor–state arbitration awards have been reluctant to emphasize a recalcitrant party’s failure to cooperate in the production of evidence as a basis for the award. Understanding that adverse inferences are inferior quality evidence, the particular inference can be attenuated by the evidentiary record or rendered irrelevant altogether because the underlying evidence that was not produced is determined does not tend to support a material fact at issue inter partes. In any event, a tribunal need not rely on adverse inferences if it can arrive at a decision on an independent basis.

      Abstract: Conflict of interest is one of the greatest challenges faced today by law firms with wide-reaching international scope which offer a special transcendence in arbitration. In recent years, arbitration laws and regulations and ethical codes have addressed this issue, although there are still many voids and questions left to be solved. The purpose of this article is to study international practice regarding conflicts of interest arising from arbitrators’ membership of large law firms and the appropriate solutions for resolving them.

      Abstract: If arbitration proceedings are not terminated by an arbitral award, but otherwise, the arbitral tribunal (or in some cases an institution) shall usually render a decision only on the costs of arbitration. The criteria according to which a reduction of these costs is to be determined are often uncertain. The arbitrators’ decision is made more intricate by the fact that they have to decide on their own fees, which can lead to conflicts of interest with the parties. It is therefore important to identify criteria for doing so that are appropriate, transparent, and manageable in practice. The following article aims at investigating this issue for institutional as well as ad hoc-arbitration and to offer guidelines for an appropriate decision.

  • Arbitrators’ impartiality and independence: commentary on Gobowen v
           AXXIS

      Abstract: The recent decision of the Federal High Court, a court of first instance, in Gobowen has brought to the fore the issue of arbitrators’ impartiality and independence. The court annulled an award because one of the arbitrators failed to disclose his family relationship with the lead counsel for the party who appointed him. This is possibly the first case in Nigeria where the issue for determination turned on the question of arbitrators’ impartiality and independence. The article interrogates the rationale for the court’s conclusion. Although the authors agree with the court, they query certain aspects of the court’s analyses. Judgments of courts of first instance are hardly reported in Nigeria. Yet, they establish precedents on the points decided. The commentary is intended to give the decision a wider audience, especially in the light of the increased use of arbitration as a means of resolving disputes in Nigeria

  • Breach of arbitration agreement and its costs consequences

      Abstract: This article discusses two recent cases of the Supreme Court of Western Australia, namely KNM Process Systems SDN BHD v Mission Newenergy Ltd Formerly Known as Mission Biofuels Ltd (the KNM case) [2014] WASC 437 and Pipeline Services WA Pty Ltd v ATCO Gas Australia Pty Ltd (the Pipeline Services case) [2014] WASC 10. In both cases, court proceedings were commenced despite the presence of an arbitration agreement. The defendants in both cases applied for a stay of proceedings mainly on the ground that the cases should have been resolved by arbitration. In terms of costs, the judge followed and applied the approach taken by Colman J in the English case of A v B [2007] EWHC 54 (Comm), and ordered that the party that breached the arbitration agreement pay indemnity costs. Whilst the making of an indemnity costs order in such circumstances is welcomed, this article raises the question as to whether the use of indemnity costs against all unsuccessful challenges to arbitral awards is correct in principle and thus should be encouraged, or even be the norm.

  • Interlocutory judicial challenges to arbitrators in India: HRD Corporation
           v GAIL and TRF v Energo from a comparative perspective

      Abstract: In the two recent cases of HRD Corporation v GAIL (2017) and TRF v Energo (2017), the Supreme Court of India has provided useful guidance as to the 2015 amendments to the Arbitration and Conciliation Act 1996 Act relating to the appointment and challenge of arbitrators. This case note critically analyses both decisions, focussing in particular on the structural issue of the availability of interlocutory judicial challenges to arbitrators. Following a comparative study of this issue, the note concludes that there is a strong argument for a further amendment to the 1996 Act to bring it into line with both the UNCITRAL Model Law and the arbitration laws of many other States.
