  • Transitional Justice from the Margins: Intersections of Identities, Power
           and Human Rights

      Abstract: The call for papers for this special 10th anniversary issue was launched with high hopes and a commitment that voices from the margins would take up the invitation, not only to be heard, but to shape the Journal’s agenda in the coming years. This issue is positioned at the intersection of transitional justice, social repression and everyday lives. It reclaims and reaffirms the necessity of addressing marginality, vulnerability and exclusion, and engaging with the conditions that have produced systematic and sustained human rights violations in transitional societies. It also affirms the capacity of individuals and groups at the margins to exercise agency in everyday acts and ordinary but embedded resistance. As transitional justice has become part of mainstream thinking and an international patois that has emerged in response to atrocities and violent repression, the Journal has increasingly returned to foundational questions of knowledge production and justice practice in the field. This special issue opens a conversation that starts not from a series of normative assumptions about truth, justice and reparation but rather by paying attention to how transitional justice intersects with and may reinforce structural dimensions of marginalization in everyday lives.

  • Against Loveless Judging: Fritz Bauer and Transitional Justice in Postwar
           Germany

      Abstract: ∞Fritz Bauer (1903–1968) is a key actor in postwar (West) Germany’s arduous transitional justice process. His remembrance is embroiled in controversies of late due to his multiple minority identities as depicted in a number of recent academic works and cultural representations about his life. This article examines Bauer’s original writings and speeches to deduce a neglected aspect of his ‘intersectionality’ – his conception of judicial reform based on his interpretation of biblical and theological sources. It proposes that ‘loveful judging,’ or judging with love, as derived from his critique against the ‘loveless judging’ during the Nazi era, is a fitting encapsulation of Bauer’s thoughts on issues of punishment, resistance, reparation and resocialization. As such, the concept is useful both as an internal standard to evaluate Bauer’s achievements, and as a unique contribution, based on the West German context, to the wider discussion on retributive and restorative justice.

  • Intersectionality and the Arts: Counterpublic Memory-Making in
           Postconflict Peru

      Abstract: ∞Producing memories through the creation of art has been one of many outcomes of the transnational justice period in Peru by both state and nonstate social actors. Art projects that are independent from state-led transitional justice initiatives convey a perspective about the internal conflict and the state’s legacies of marginalization that is in tension with a dominant discourse that seeks to absolve the state and urban elites of culpability. This article examines three public art projects that are conducive to applying an intersectionality feminist analysis to consider how widespread structural and systemic violence is rooted in a lengthy history of societal exclusions based on a combination of gender, race/ethnicity and socioeconomic class.

  • The Hollow Shell: Children Born of War and the Realities of the Armed
           Conflict in Colombia

      Abstract: ∞This article discusses tensions and dynamics around configuring children born as a result of wartime sexual violence as subjects within the realities in which transitional justice operates. Based on ethnographic research in Colombia, the article explores how a victimhood discourse and an explanatory framing to understand gender-based violence and sexual violence as a weapon of war, have restricted the emergence of these children as independent war-affected subjects. Instead, they have emerged as subjects that play a part in the social negotiations around victims of wartime sexual violence – for instance, gender and forced maternity – or around perpetrators and their constant presence in the history of the communities. To understand the plight and role of these subjects within the political community, transitional justice frameworks must contest the normative approach to harm, as these women and men were conceived by war but are not defined by it.

  • Intersectionality as Locality: Children and Transitional Justice in Nepal

      Abstract: ∞Transitional justice policy, although predicated on an ideology of transition, often homogenizes victims and fails to respond to victims’ diverse and dynamic needs during the ‘transitional period.’ In this article, based on 14 months of ethnographic research in Nepal, I examine the perceptions and experiences of adults who were children when their fathers were killed or disappeared during the decade-long internal armed conflict between the Communist Party of Nepal-Maoists and the Nepali government. Through their varied experiences and ongoing transitions, I challenge homogeneous and fixed conceptualizations of ‘children’ and ‘the local’ and argue for greater attention to the intersectional experiences of victims and the redress of entrenched systems of domination and inequality.

  • From Victims and Mothers to Citizens: Gender-Just Transformative
           Reparations and the Need for Public and Private Transitions

      Abstract: ∞Colombia’s 2011 Victims’ Law is often seen as an example of best practice in transitional justice, combining land restitution and individual and collective reparations. This law builds on the increasingly popular concept of transformative reparations and moreover prescribes a ‘differential focus’ to guarantee the inclusion and protection of groups considered to be especially vulnerable. Based on nine months of ethnographic and participatory visual fieldwork in two villages in Colombia’s Caribbean coast, this article discusses how this ‘differential focus’ plays out in practice by critiquing the way in which it is based on a highly essentialized and narrow understanding of gender. Based on the experiences and ideas of women involved in the Victims’ Law process, the article suggests how a focus on citizenship could offer a new approach to reparations, with more potential for transforming gender inequality.

  • The Colombian Transitional Process: Comparative Perspectives on Violence
           against Indigenous Women

      Abstract: ∞Colombia has a comprehensive system of truth, justice and reparation stemming from its history with the justice and peace process and its most recent peace agreement. Although indigenous women are the most affected before, during and after conflict, their participation is marginalized within this political context. This article discusses how Colombian transitional justice can be reconfigured when indigenous women’s practices and knowledge travel ‘from the margins’ to the center. We seek to demonstrate how these practices legitimize gender and other types of violence in the name of tradition and also how indigenous women’s experiences go beyond the gendered perspective of violence as a ‘weapon of war.’ Working within the context of the peace process, we gathered data through learning and teaching techniques with indigenous women in three indigenous contexts (Sierra, Pan-Amazon region and Chocó). Our focus is on the interaction between local transitional justice practices and the violence against indigenous women, their resistance practices and the peacebuilding agendas used to implement transitional justice in Colombia.

  • The Emerging LGBTI Rights Challenge to Transitional Justice in Latin
           America

      Abstract: ∞Latin American truth commissions have recently expanded their purview to include cases of violence against gender and sexual minorities as human rights violations worthy of investigation. This article proposes that grappling with this emerging LGBTI (lesbian, gay, bisexual, transgender and intersex) rights challenge requires a queer, intersectional and decolonial analytical lens that underscores the relevance of global LGBTI politics, and critiques transitional justice foundational assumptions regarding temporality and binary logics. In practical terms, this analytical lens enacts a double move by unearthing the deeply tangled and life-extinguishing roots of impunity surrounding violence against gender and sexual minorities while advocating for the realization of LGBTI people’s full citizenship.

  • Gender Perspective in UN Framework for Peace Processes and Transitional
           Justice: The Need for a Clearer and More Inclusive Notion of Gender

      Abstract: ∞Gender influences the experiences of war and periods of large-scale abuses, and as such it needs to inform peace processes and transitional justice mechanisms. In the past 15 years, the UN Security Council has provided a framework for the inclusion of a gender perspective in peace processes, which includes attention to conflict-related gender-based violence (GBV) through the establishment of the Women Peace and Security (WPS) agenda. This article analyzes how gender is framed and understood in this context and how it impacts the practice of peace processes. It is suggested that in order to effectively tackle the root causes of conflict-related GBV, the WPS architecture should allow for an expansive understanding of gender, avoiding the reproduction of gender stereotypes. This should include the recognition of intersectional experiences of women with violence during conflict, violence based on sexual orientation and gender identity, and gendered violence committed against men.
