  • The UN Guiding Principles on Business and Human Rights and Networked
           Governance: Improving the Role of Human Rights Ombudsman Institutions as
           National Remedies

      Abstract: AbstractNational human rights institutions (NHRIs) fully compliant with the United Nations (UN) Paris Principles are important actors for implementation of the UN Guiding Principles on Business and Human Rights (GPs). Their work is facilitated by networked governance including the Global Alliance of National Human Rights Institutions, the global network of NHRIs, and regional NHRI networks. NHRIs must have mandates to promote and protect a full range of human rights and jurisdiction over public and private sector conduct, although complaints investigation is not required. National human rights ombudsman (HRO) institutions are NHRIs, but their core responsibility is human rights protection through complaints-based and own-motion investigations. Increasing numbers of HRO institutions have some human rights promotion powers and private sector jurisdiction, and some are addressing business and human rights issues. In this article I argue that the HRO institutional ability to implement the GPs can be strengthened through expansion of their human rights promotion powers, expansion of their jurisdiction over the private sector and capacity-building assistance.

  • Protecting the Invisible: An Intersectional Approach to International
           Human Rights Law

      Abstract: AbstractThis article analyses intersectionality in the area of international human rights law. Moving attention away from the field of anti-discrimination law, it examines how an intersectional approach to international human rights law can offer stronger human rights protection to people who share a number of characteristics associated with distinct marginalised groups of people. In order to illustrate the application of this approach the article provides a case study addressing three groups of disabled people who possess such characteristics: first, disabled women; second, disabled people who belong to racial or ethnic minorities; and third, disabled children. It concludes by arguing for the adoption of ‘intersectional mainstreaming’ in international human rights law. Providing a novel scholarship analysis of intersectionality, it proposes an intersectional perspective as an effective tool for accommodating intersectionality. The article thereby aims to close a gap in research on intersectionality in the field of human rights.

  • Intermediary Liability for Online User Comments under the European
           Convention on Human Rights

      Abstract: AbstractIn the recent judgments of Delfi AS v Estonia and Magyar T.E. and Index.hu Zrt v Hungary, the European Court of Human Rights for the first time sought to clarify the limits to be imposed on intermediary liability regimes for online user comments and the factors to be assessed in the determination of the appropriate balance between the Article 10 speech rights of online intermediaries and the Article 8 reputational rights of those targeted by unlawful user comments. In doing so, the Court has left open to Contracting States the choice of intermediary liability regime to be adopted at the domestic level. The author, a judge of the Strasbourg Court, comments extrajudicially on the compatibility of the potential liability regimes with the Court’s new line of case law and the criticisms levelled at the decision in Delfi AS. He argues that the Court may be seen to have adopted a middle ground between two diametrically opposing viewpoints on the regulation of the Internet, one advocating for an environment relatively free from regulation of online conduct, and the other campaigning for a regulated Internet where the same legal principles apply both online and offline.

      Abstract: AbstractThis article will look at the question as to whether it was correct for the police officers in Gäfgen v Germany to be treated leniently by the German courts for ill-treating the kidnapper and murderer of a boy, because the officers felt that they could have saved the child. In doing so, it will evaluate two articles by Professor Steven Greer who has argued that in specific circumstances, such as those in Gäfgen, police officers may be treated leniently for threatening criminal suspects or using other forms of ill-treatment in breach of Article 3 of the European Convention on Human Rights. In his articles Professor Greer argues that the Grand Chamber of the European Court of Human Rights did not take into account the specific circumstances of Gäfgen and failed to explore how the rights of the applicant and the boy were in conflict. This article evaluates the issues which arise in the case through a consideration of the conflict of the different rights involved. It will argue that, while there is a case for allowing some mitigating circumstances to be taken into account when sentencing, the police officers should have received a proportionate sanction in accordance with the German Criminal Code.

  • The European Court of Human Rights’ Case Law on Human Trafficking in
           Light of L.E. v Greece : A Disturbing Setback'

      Abstract: AbstractThe 2010 Rantsev judgment placed the European Court of Human Rights at the forefront of international judicial efforts to scrutinize States’ obligations in the area of human trafficking. Expectations were high after this first-ever judgment against a State for failing to implement a human right-based approach to trafficking. Six years later, the Court’s second ruling on this issue, L.E. v Greece, comes as a disappointment. In order to put this judgment into perspective, this study starts with an overview of how the Court came to address the issue of trafficking under Article 4 of the Convention. It then analyses in detail the reasoning developed by the Court in L.E., highlighting a number of inconsistencies with the thinking followed in Rantsev, in particular in relation to the scope of States’ positive obligations in the area of prevention and victim protection. The author concludes that the weaknesses identified in this ruling raise serious concerns about the Court’s willingness, or capacity, to engage in a holistic human rights-based approach to trafficking.

  • Realizing the Right to Freedom of Thought, Conscience and Religion: The
           Limited Normative Force of the ASEAN Human Rights Declaration

      Abstract: AbstractThis article examines the normative force and limits of Article 22 of the ASEAN Human Rights Declaration (AHRD) to advance the right to freedom of thought, conscience and religion among ASEAN Member States. It argues that efforts to advance this freedom based on the AHRD are likely to be hampered by two constraints, one external to the document and one internal. The external challenge is the lack of a coherent baseline consensus upon which to build a core understanding of the content of the right due to competing visions of freedom of religion among Member States. The internal constraint stems from various provisions within the AHRD that appears to grant states significant discretion in defining the content and scope of human rights. In examining these constraints, this article seeks to inform a broader enquiry as to the AHRD’s potential as a regional human rights instrument.
