  • The Mutual Fund Industry and the Protection of Human Rights

      Abstract: ABSTRACTThis article considers the appropriate application of the United Nations Guiding Principles on Business and Human Rights (UNGP) to the mutual funds industry. Mutual funds can impact human rights by financially supporting oppressive states or abusive companies. Given the indirect nature of such impacts, along with the exclusively external management of the funds, this article argues that a unique approach to implementing the UNGP is necessary for this industry. Divided into five parts, the article outlines the governance structure of mutual funds and the expectations on states and businesses in the UNGP, before assessing the appropriateness of applying current guidance for banks and other financial actors to mutual funds. The article concludes with practical recommendations for both fund managers and states on the implementation of the UNGP in this industry.

  • Empathy and Human Rights: The Case of Religious Dress

      Abstract: ABSTRACTThere has been a huge growth in the study of the concept of empathy—taking the perspective of others—across academic disciplines in recent decades. However, whilst a number of scholars and philosophers have argued that empathy might provide some theoretical underpinning for human rights norms, there has been little exploration as to how empathy might actually be used in the practical adjudication of human rights claims. This article seeks to address this gap. By using as a case study the European Court of Human Rights case law on Article 9 on religious dress and symbols, the authors explore how the concept of empathy might improve the Court’s adjudication on this issue via a process of attempting to understand and give weight to the profound commitment that religious dress/symbols may represent to people of faith.

  • ‘Irreligious’ Cartoons and Freedom of Expression: A Critical

      Abstract: ABSTRACTIn a recent article, Neville Cox argued that there is no right under international human rights law to publish ‘irreligious’ cartoons. Secondly, he questioned the very idea of such a right. Finally, he argued that, given the fact that there is no international right to publish irreligious cartoons and that the message spread by the cartoons was akin to hate speech, the ‘real’ reason for the international solidarity with Charlie Hebdo may have been ‘Islamophobia’. In this article, I will argue that Cox may be right in holding that there is no international right to ‘irreligious speech’, but I will question his reasoning. Secondly, I will argue that, under robust free speech theory, arguments in favour of suppressing anti-religious speech are highly questionable. Finally, and irrespective of the two previous points, I will argue that Cox’s conclusion is mere speculation, and there are no compelling arguments for adhering to it.

  • Marginalisation by the Court: The Case of Roma Children and the European
           Court of Human Rights

      Abstract: ABSTRACTThis article analyses the European Court of Human Rights’ conceptualisation of children as human rights-holders, using Roma children’s access to education as a case study. It argues that the Court consistently fails to treat children as agents in their own right in cases where their rights are being compromised. Roma children, as members of an ethnic or racial minority group, suffer discrimination through their segregation from other children within the education systems across Europe. They are further discriminated against by the Court because of the overriding focus on their parents’ rights, while ignoring their independent status as rights-holders. Thus, the article argues that Roma children are marginalised on account of their status as children and as members of a subordinated social group. The article then proposes an alternative, child-centred, judicial narrative which has the potential to remedy this situation. This approach repositions children and brings them to the centre of the Court’s analysis, essentially asking the Court to directly engage with children as rights-holders, and potentially to strike a different balance between children’s rights, parental interests and the state.

      Abstract: ABSTRACTThe positive obligation to prevent private acts of violence is still developing in international human rights law. The article discusses what preventive measures States are obliged to take against such violence under the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (‘the Istanbul Convention’). It examines the content of the obligation to prevent as well as what triggers it. This is exemplified by analysing the obligation under the Istanbul Convention to prevent honour-related violence. The article concludes that the triggers of the obligations to prevent and to protect differ and that the Istanbul Convention has the potential to influence the understanding in particular of the former obligation. However, first the Istanbul Convention’s monitoring body will have to clarify the extent to which primary prevention measures are required in response to individual risks of violence.

      Abstract: ABSTRACTFollowing the 1994 genocide, more than 4,500 children were held in Rwandan prisons, most accused of genocide-related crimes. Based on field research, this article examines how the United Nations Children's Fund (UNICEF) negotiated the tension between pragmatism and principle in its approach to child génocidaires. It profiles the contextual approach adopted by UNICEF in interpreting international juvenile justice standards, drawing out tensions within UNICEF and between UNICEF and other actors over how best to implement the Convention on the Rights of the Child (particularly as regards detention). It then evaluates whether there was a risk of weakening the normative content in the desire to implement the standards in a socially-sensitive and context-specific way. I argue that by adopting a pragmatic yet principled approach UNICEF was, to some extent, able to enhance the rights of child perpetrators in the difficult context of post-genocide Rwanda.
