  • Towards a Complete Prohibition on the Immigration Detention of Children

      Abstract: The legal position on the immigration detention of children is unclear: is it permissible, subject to the ultima ratio (last resort) principle, or is it prohibited outright' International opinion is divided, with different human rights bodies favouring one or the other position. In November 2017, the Committee on the Rights of the Child and the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families issued a Joint General Comment in which they stated forthrightly that the immigration detention of children is prohibited and that the ultima ratio principle does not apply to the immigration context. This article situates the Joint General Comment in the broader context, interrogates its conceptual foundations and explores the extent to which it is likely to settle the debate. The key finding is that the position adopted in the Joint General Comment is correct but founded on a faulty premise and a misplaced emphasis. A more theoretically solid foundation for the prohibition on the immigration detention of children is advanced based on a teleological interpretation of the right of the child to liberty in the Convention on the Rights of the Child, with a particular focus on the concept of arbitrariness.

  • Indigenous or Out of Scope' Large-scale Land Acquisitions in
           Developing Countries, International Human Rights Law and the Current
           Deficiencies in Land Rights Protection

      Abstract: This article explores the role of international human rights law in protecting the (informal) land rights of local communities in the Global South against large-scale land investment acquisitions in developing countries, which have been claimed to lead to evictions and loss of local livelihoods. The argument is made that, while international human rights law now firmly protects the land rights of indigenous peoples, substantial gaps remain with regard to non-indigenous land users such as peasants, smallholder farmers and cattle breeders, creating the urgent need to expand the existing rules to these vulnerable groups. Furthermore, given its foundation in the indigenous context, the current framework on land rights suffers from intrinsic limitations that might hamper its extension to non-indigenous land users. Thus, international human rights law will have to place greater emphasis on the economic dimension of land if it is to provide effective protection against ‘land grabs’ in the Global South.

           African Charter on the Rights of Older Persons in Africa

      Abstract: On 31 January 2016 the African Union adopted the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa seven months after the Organization of American States adopted the Inter-American Convention on Protecting the Human Rights of Older Persons. Both treaties represent a growing formal recognition of the vulnerability of older persons as a distinct group of persons and of the need to protect them as such by means of special rights. Yet older persons occupy a distinctly ambiguous position, especially in Africa where they are assumed to enjoy reverence, respect and authority but increasingly face deepening poverty, more responsibilities to care for members of their families, marginalisation and abuse. This article critically discusses how the African Older Persons’ Protocol addresses this ambiguous position, focusing in particular on the Protocol’s conception of ‘older persons’, its approach to the rights of older persons and the extent to which it is informed by distinctly African values and the lived experiences of older persons on the African continent.

  • The European Court of Human Rights’ Remedial Practice and its Impact on
           the Execution of Judgments

      Abstract: ABSTRACTThis article analyses the developing approach of the European Court of Human Rights to the indication of specific non-monetary individual or general remedies and the impact of this practice on the execution of its judgments. It draws on interviews with Judges of the Court and officials in Council of Europe institutions, and a statistical analysis of pilot judgments and judgments that invoke Article 46 of the European Convention of Human Rights delivered between 2004 and 2016. The article argues that the Court’s remedial practice is fluid and pragmatic, with differences of perspective between Judges. It discusses the factors that influence judicial decision-making, and examines the implications of the Court’s remedial approach both for its ‘horizontal’ relationship with the Committee of Ministers and its ‘vertical’ relationship with states. It concludes that, from both these perspectives, the door is open to continued evolution, if not revolution, in the Court’s remedial practice.

  • Reforming the Approach to Racial and Religious Hate Speech Under Article
           10 of the European Convention on Human Rights

      Abstract: At present the European Court of Human Rights employs a two-track approach to racial hate speech and religiously offensive speech, respectively. Further, the jurisprudence under Article 10 of the European Convention on Human Rights currently privileges journalistic or scholarly, over creative or artistic, forms of religious criticism. However, in this article it is argued that the ‘gratuitously offensive’ test for religiously offensive speech requires reform, while a consistent approach to racial hate speech cases is equally necessary. By building on Waldron’s account of the harm in hate speech, a single Article 10 test for both racial and religious hate speech is proposed. This new test focuses on harm in the sense of seriously undermining the target’s assurance to a status of equal worth in the community. It abandons the unhelpful race/religion dichotomy in the Article 10 jurisprudence, and is more responsive to the political reality of tense public discourse surrounding issues of race and religion in Europe in the wake of the Syrian refugee crisis and Brexit.

  • Terrorist Hostage-taking and Human Rights: Protecting Victims of Terrorism
           under the European Convention on Human Rights

      Abstract: The 2004 Beslan school siege by Chechen gunmen and the Russian responses to the attack demonstrated the tremendous impact a terrorist attack and a state’s anti-terrorist operations can have on the human rights of victims. The violations of the victims’ human rights were examined by the European Court of Human Rights in Tagayeva v Russia (2017), which this article argues is a landmark case in that the Court placed the human rights of victims at the centre of its concerns and reinforced the idea that states remain bound by the European Convention on Human Rights in large-scale anti-terrorist operations. The principal goal of this article is to examine the positive and procedural obligations of states towards the victims as outlined by the Court and to assess how this case might shape future responses to terrorist attacks. It will be argued that when states respond to a terrorist hostage-taking, they have to focus primarily on the human rights of hostages abducted within or beyond their borders on land or at sea.
