  • Citizenship and Citizenships ad omnes includendos: A Human Rights Approach

      The starting assumption is that intercultural dialogue, to be fruitful, must be developed from a basic code of values, that aside from being universal in character and therefore possible to share, must also be a trans-cultural facilitator. Arguably, the international law of human rights provides the axio-legal paradigm for the human-centric foundation of citizenship, then for its re-definition as plural citizenship whose references are no longer only the ius sanguinis and the ius soli, but primarily the ius humanitatis. It presents the human rights approach to citizenship ad omnes includendos, that is for the inclusion of all human beings, as "members of the human family" in a large and multi-level space. Indeed, the horizon for inclusive citizenship is much broader than the territorial dimension of the traditional nation-state; it is the European and world space of internationally recognised human rights. In this light, the European integration process and its political-legal system, being a laboratory of "constituent" activities, provide an evolutionary context in which new citizenship and inclusion practices can be built. Thus an implementation of plural citizenship is strictly linked to re-launching a democratic practice beyond the national borders, and rescuing statehood providing it with new sustainable dimensions. Arguments are raised in favour of the thesis according to which the promotion of universal citizenship strengthens the eligibility of local government institutions to have a more visible place in the architecture and functioning of the world political system. Emphasis is put on the primacy of the international law of human rights over national and sub-national legal systems. Human rights mainstreaming in local and international public policies is considered one of the greatest challenges for reshaping and developing inclusive infrastructures. In this large context of multiple challenges and opportunities, education is asked to help maturing a new "transcend civic identity".

  • Legal comparison and European law: or the paradigm shift from a
           territorial to a spatial viewpoint, in the prospect of an open and
           cohesive society based on European citizenship as model of plural and
           inclusive citizenship

      The presentation is articulated in two distinct but strictly connected sections. The first one (§§ 1-2) focuses on the relationship between comparison based on national legal systems and European law as a major example of stateless law, a new kind of ius commune Europaeum, arguing how such relationship implies a paradigm shift in the conception of the law, consisting in passing from a territorial point of view to a spatial one. The following section (§ 3) highlights the importance of a new idea of citizenship, post-national, plural and inclusive, capable of completing the national citizenship, through its grafting directly with fundamental rights, precisely in the stateless form of the European citizenship, as the main parameter of that paradigm shift, in function of a political and social coexistence aimed at the building of a common European space, grounded on transnational democracy and solidarity, within which individual subjectivity, without necessarily disengaging from one’s own territory, thus understood as territory of national membership, or as residential territory in relation to a living and working condition in a local community, may become central to the overall objective of the formation of a Europe truly united through not only member states but also their peoples, and more generally the people as individuals seen in their relational dimension of civic coexistence at various levels, local, national and European.

  • Civil Society Organisations in the EU: Human Rights discourse through the
           European Women’s Lobby

      The essay provides an in-depth analysis of the way civil society organizations (CSOs) de-fine their roles within the European Union’s political system. The authors argue that CSOs are significant actors for democratic change in the architecture of the European Union since they have capacity to aggregate different political demands, particularly in the area of gender policy. This also thanks to the ‘civil dialogue’ within political space. Our hypothesis is that the European Women’s Lobby (EWL) has obtained significant legitimation from some EU bodies in particular, from the Commission, Parliament and women’s policy agencies. Its political expertise has also been recognized on issues related to women’s human rights international political agenda. We suggest that a progressive adaptation of EWL to the human rights policy framework is a strategic action towards advocacy and lobbying in the EU.

  • The Financial and Economic Crisis: A Missed Opportunity to Rethink the
           Institutional Architecture of the European Union

      The Euro crisis has raised two critical issues. Firstly, the emergence of the financial systemic risk which consists in the possibility that the danger of PIGS state’s default will spread to other EU members and secondly, the reshaping of the EU institutional architecture thanks to the introduction of new legal and economic instruments functional to avoid the single currency’s collapse. The solutions adopted, partially assumed with the recourse to the intergovernmental method, have favoured a significant reinforcement of the EU Commission and especially of the European Central Bank, with a marginalization of the EU Parliament with the further effect of favouring the prevalence of the technocratic method on democratic one. The paper aims to analyse the mentioned aspects, trying to underline the critical aspects of the transformation process that is characterizing the current history of the European Union.

  • Cittadinanza europea e popolo federale europeo: una rivoluzione
           concettuale

      The current EU crisis concerns the very political significance of its institutions, which its own citizens perceive as extraneous and imperfect. The paper is a reflection proposal on this issue, drawing inspiration from Bruno Leoni’s, Mario Albertini’s and Francesco Rossolillo’s social and political researches. By adopting a European interpretative approach, gradual and diachronic, the EU crisis is attributed to the vanishing of a federal political project and to the interruption in the development process of a supranational political community. In conclusion it is suggested that a "revolution" of our political culture should take place, one that by denationalizing the notions of citizenship and people might read a potential for development into the imperfection of the European ones, thus displaying their most substantial feature: an inclusive transience. European citizenship and people would acquire a new meaning: they would become the first historical example of a new pre-cosmopolitan status and an ever-expanding pluralistic identity.

  • Reddito minimo garantito e cittadinanza sociale europea

      Il saggio analizza anzitutto la ‘crisi esistenziale’ della Unione Europea (UE) sviluppatasi nell’ultimo decennio. Nel saggio, sono descritte tre proposte avanzate in letteratura per contrastare la combinazione tra nazionalismo (economico) e populismo (politico). La prima proposta è lo ‘sdoppiamento della Ue’. La seconda propone il ritorno nei confini nazionali della sovranità popolare. La terza proposta concerne il reddito minimo garantito (invece del basic income) come diritto sociale fondamentale dei cittadini europei, che attua una forma di ‘europeizzazione della solidarietà’. Il saggio, infine, analizza il "Pilastro europeo dei diritti sociali" in rapporto alla attuazione della c.d. Europa Sociale, proclamato nel Social Summit di Göteborg del 17 novembre 2017, che prevede un reddito minimo al livello nazionale negli Stati membri dell’UE.

  • Garantire la sussistenza. Povertà, ReI e il futuro del welfare

      The economic crisis has given impetus, in Europe as well as in Italy, to the theoretical and political debate about income support policies. Their aim is to guarantee every person a basic standard of life: in a word, subsistence. The article, following Henry Shue, suggests considering subsistence as a basic economic right and therefore recommends to protect it universally and unconditionally as a birthright. A discussion regarding the possibilities and limits of welfare measures follows, with particular reference to the Reddito di Inclusione (Income of Inclusion), recently approved in Italy, into the wider contest of the European Pillar of Social Rights. The article concludes with a description of a different and complementary approach to current selective welfare measures, which sets aside means testing and aims to prevent severe destitution and intergenerational transmission of poverty.

  • I recenti sviluppi in materia di misure di sostegno al reddito in Italia e
           in Europa

      This paper tries to analyze the legislative development in Italy on the protection of in-voluntary unemployment at local and regional level, in order to highlight its effectiveness or not, with particular reference to the different phases of the economic cycle. Secondly, the red thread that links the development of income support policies and the provision of European structural funds will be deepened. Finally, the debate on the introduction of a European minimum guaranteed income measure, homogeneous for all Member States of the Union, will be analyzed. This work tries to answer whether these measures are really effective in combating poverty and whether they are an adequate response to job transformation, work breakdown, and vulnerability of workers.
