  • Cittadinanza ‘civile’ europea e politiche di integrazione

      Starting with a general overview on integration policies based, respectively, on the assimilationist, multicultural and intercultural model (§ 1), the paper focused on the notion of European (Union) citizenship, looked at from the point of view of its normative relevance in the Union treaties, as well as on its meaning in relation to the basic issues of the qualification criteria and the subjective or personal scope of the notion of the Union citizenship, with regard to the problem of its conceptual autonomy (§§ 2-3). Against this background, in which it can be observed an autonomous foundation with a potentially open and inclusive character of European citizenship, the relationship between immigration and integration within the area of freedom, security and justice is analysed, having regard to EU rules and the European Council multiannual programmes (§ 4), with an aim to argue (§ 5) the feasibility of a broad definition of European citizenship, in the form of the so-called "civic citizenship" such as proposed by the European Commission in two communications, respectively of 2000 and 2003; then supported and further relaunched in more recent times by the European Economic and Social Committee in two opinions, respectively of 2003 and 2014. This broad notion of European citizenship could apply, in virtue of the principle of equality, to third country nationals (migrants and refugees) who are stable long-term residents in a member state. In the last paragraph (§ 6), some final considerations are made regarding the need of a paradigm shift, consisting in re-thinking at European level the notion of citizenship no longer in terms only of nationality (related to state citizenship), but on a residential basis, in terms of function of civic coexistence grounded on shared values, within the transnational common space of the Union.

           Italia' Reddito di inclusione e Reddito di cittadinanza a confronto

      In this study the Author reconstructs the constitutional foundations of the right to an ex-istence, identifing in the guaranteed minimum income as a measure - complying with the constitution and constitutionally necessary, as well as strongly recommended by the Euro-pean Union - to guarantee a dignified existence in case of A lack of income from work. The study focuses in particular on where at present we are in Italy in the construction of a single and universal measure to combat poverty, with the analysis of Reddito di inclusione, launched by the Gentiloni government and active in Italy from 1 January 2018, and of the proposal for Reddito di cittadinanza put forward by the Movimento 5 Stelle; this is also a measure of guaranteed minimum income - not of basic income - reinforced compared to the Reddito di inclusione, but not dissimilar in inspiration and planning.

      The essay outlines the main contents of the Commission’s ‘A New Deal for Consumers’ Communication which contains the proposal for two important legislative initiatives aimed at further improving the European regulatory framework to protect consumer interests and rights in line with the consumers protection policy conducted by the Commission since the seventies of the last century. In particular, with the two directives proposed, the Commission intends to modernize and complete the consumer acquis, through the harmonization and strengthening of the system of sanctions for breaches of the European rules for the protection of consumer interests, the strengthening and harmonization of the remedies contrasting the unfair commercial practices, the adaptation of the regulatory framework to the characteristics of online markets and the supply of digital content and services, the revision of the right of withdrawal in order to reduce the burden on professional economic operators, the revision of certain aspects of the Unfair Commercial Practices Directive and the reform of representative actions protecting the collective interests of consumers.

  • La tutela dei cittadini dell’Unione europea contro la povertà e
           l’esclusione sociale: il diritto ad un reddito minimo garantito tra
           criticità e proposte di adeguamento

      The guaranteed minimum income is a milestone of the European social model. It consists in the disbursement to regular intervals of a support equal to the "minimum subsistence figure" to allow beneficiary citizens to conduct a dignified life. It is a right implicitly set forth to art. 34, paragraph three of the EU Charter of the fundamental rights, which becomes manifest in different implementation schemes prepared by the EU Member States. During the economic crisis, the guaranteed minimum income has revealed some inadequacy in effectively counter of poverty. On the one hand, this paper examines the current dynamics in the European Union. Precisely, it investigates the actual EU system of fight to the social exclusion and the recent proposals in discussion: for instance, the contribution of the European Pillar of the social rights. On the other hand, the paper studies the critical elements of the guaranteed minimum income schemes of the Member States.

      The implementation of a basic income raises several questions: apart from the problems concerning the sustainability of the measure, it is controversial if basic income could be imposed as a complementary measure to those already in place. Among others, the topic that perhaps deserves further study concerns the relationship between the well-known distribution mechanisms on which modern welfare systems are based and the possibility of ensuring a minimum level of economic protection for people, even apart from the ability to generate income. So far, the advanced proposals do not seem to ensure either a real liberation from need or a sort of universality which, instead, seems to be the main feature of similar systems, experienced above all in the countries of northern Europe.
