      Abstract: Merarik merupakan perkawinan suku adat Sasak yang kaya dengan nilai-nilai budaya dan merupakan kearifan lokal yang dimiliki masyarakat suku Sasak. Merarik dalam suku Sasak adalah membawa lari calon pengantin perempuan oleh calon pengantin lelaki ke tempat keluarga si lelaki untuk disembunyikan dengan tujuan supaya dapat dinikahi dan dijadikan istri. Perkawinan hukum adat Lombok (Merarik) dalam perspektif UU No. 1 Tahun 1974 tentang Perkawinan  dan Hukum Islam adalah sah baik secara hukum positif dan hukum Islam karena perkawinan Merarik proses adat-istiadatnya saja yang berbeda, sedangkan yang lainnya sama baik mengikuti ketentuan UU No. 1 Tahun 1974 tentang Perkawinan maupun syarat-syarat yang terdapat dalam hukum Islam.

      Merarik is a marriage of indigenous Sasak tribe that is rich with cultural values and merarik is a local wisdom owned by the Sasak tribe community. Merarik in the Sasak tribe is bringing the bride ran by the bridegroom to the man's family to be hidden in order to be married and made wife. The marriage of the customary law of Lombok (Merarik) in the perspective of Law no. 1 of 1974 on Marriage and Islamic Law is lawful both positive and Islamic law Because marriage Merarik process of customs are different, while others are equally well following the provisions of Law no. 1 Year 1974 on Marriage and the conditions contained in Islamic law.

  • Pola Relasi Suami-Istri Yang Memiliki Perbedaan Status Sosial di Kota
           Malang

      Abstract: The purpose of this article is to psychologize the relationship of husband and wife based on different social status both in the division of roles, the fulfillment of living and decision making in the family, especially in the area of Malang. This research is a field research using qualitative descriptive approach through an in-depth interview process. The results of this study indicate that the existence of two patterns of the relationship between husband and wife different social status in Malang. The first pattern, the division of labor in the domestic territory is done based on the ability and expertise of a person. While the second pattern is implemented flexibly according to an agreement. The pattern of cooperation done by husband and wife in fulfilling family needs. While the decision-making aspect in the family produces two typologies namely equal position between husband and wife through the process of discussion and the domination. Real forms of dominance such as the attitude of not daring to express opinions and tend to follow the decision of one party.Tujuan artikel ini adalah mentipologikan relasi suami istri berdasarkan perbedaan status sosial baik dalam pembagian peran, pemenuhan nafkah dan pengambilan keputusan dalam keluarga khususnya di wilayah Kota Malang. Penelitian ini merupakan penelitian lapangan dengan menggunakan pendekatan deskriptif kualitatif dengan melalui proses indepth interview. Hasil penelitian ini menunjukkan bahwa adanya dua pola relasi suami istri yang berbeda status sosialnya di Kota Malang. Pola pertama, pembagian kerja di wilayah domestik dilakukan berdasarkan kemampuan dan keahlian seseorang. Sedangkan pola kedua dilaksanakan secara fleksibel sesuai kesepakatan. Pola kerjasama dilakukan oleh suami dan istri dalam memenuhi kebutuhan keluarga. Sedangkan pada aspek pengambilan keputusan dalam keluarga menghasilkan dua tipologi yaitu posisi setara antara suami dan istri melalui proses musyawarah dan adanya dominasi.   • Legalitas Nikah Sirrî Ditinjau Dari Kaidah Fikih

      Abstract: Unrecorded marriage becomes legal issues in Indonesia after the government has obliged that marriage must be registered with the Registrar of Marriage Officers or the Office of Religious Affairs. The propnents of this marriage maintain that such marriage is considered valid and legal under Islamic law, although it is not admitted by the state law. The objective of this research is to discuss the legal problems of unrecorded marriage in Islamic law in the Indonesian context and to understand the changes of legal status of unrecorded marriage from the perspective of Islamic legal maxim. The methodology used in this research is descriptive-qualitative analysis. This study shows that according to the perspective of Islamic legal maxim, unrecorded marriage is not restricted but it may fall under the category of forbidden. It is because there are many deviations in a marriage when it is not registered. Thus, this could harm the family lived in the future.
      Pasca pemerintah mengeluarkan kebijakan untuk mewajibkan pencatatan nikah di hadapan Kantor Urusan Agama (KUA)/Petugas Pencatat Nikah (PPN), nikah Sirrî menjadi isu hukum yang hangat di Indonesia. Permasalahan ini muncul sebagai bagian dari pemahaman masyarakat bahwa pernikahan mereka dianggap valid dan sah secara agama (hukum Islam) namun ‘illegal’ secara hukum positif. Studi ini berusaha untuk mendiskusikan legalitas nikah sirrî dalam hukum islam di Indonesia sekaligus untuk memahami probabilitas perubahan hukum nikah sirrî melalui Kaidah Fikih. Penelitian ini menggunakan analisa deskriptif-kualitatif melalui studi literatur. Hasil dari studi ini adalah dimungkinkannya perubahan hukum nikah sirrî dari yang sebelumnya boleh menjadi haram. Ini berdasarkan fakta banyaknya penyimpangan wewenang pernikahan yang tidak tercatat yang merugikan kehidupan keluarga di masa yang akan datang.

  • Seks dan Kuasa dalam Hukum Islam: Studi Fiqh Seksualitas

      Abstract: This article aims to the discourse of sexuality and power in assessing the relationship between husband and wife sexuality that is often considered lame. The study of this article uses a type of socio-legal research by combining a conceptual approach in normative legal science and discourse analysis in the social-humanities sciences. In the perspective of the fiqh of sexuality, the coercion or sexual violence of the husband that befell his wife, limited as a sexual object, is actually an anti-monotheistic act. The relationship between husband and wife should be as a partner, as clothing (libas) which mutually bandage in channeling sexual desire, and give each other peace. There should be equality of husband and wife sexual relations based on willingness and agreement of both parties and affectionate with good treatment among others (mu'asyarah bi alma'ruf).Artikel ini mengkaji wacana seksualitas dan kuasa dalam menilai relasi seksualitas suami-istri yang sering kali dianggap timpang. Kajian artikel ini menggunakan jenis penelitian sosio-legal dengan memadukan pendekatan konseptual (conceptual approach) dalam ilmu hukum normatif dan analisis wacana (discourse analysis) dalam ilmu sosial-humaniora. Dalam perspektif fikih seksualitas, pemaksaan atau kekerasan seksual suami (marrital rape) yang menimpa istri, sebatas sebagai objek seksual, sejatinya merupakan tindakan antitauhid. Hubungan antara suami dengan istri seharusnya adalah sebagai partner, sebagai pakaian (libas) yang saling membalut dalam menyalurkan hasrat seksualnya, maupun saling memberi ketenangan.   • Sistem Kewarisan Bilateral Ditinjau Dari Maqashid Al-Syari’ah

      Abstract: Dividing inheritance in kinship is not often suitable with Islamic Law. Reality, most of Indonesianpeople divide the heritage according to familydiscussion. It is not fair one each other. Because of that, the writer is interested in systemof dividing family inheritance in order to be fair to all the family’s member. This research refers to concept bilateral heritage in Maqashid al-syari’ah. The writer focuses to answer the question of what is the division pattern bilateral heritage in a family reflects toMaqashid al-syari’ah principle (general goals/universal syari’ah)' This research is normative juridical research in approaching legislation, conceptual, and consideration. The result of this research is system dividing bilateral heritage has relevance with Maqashid al-syari’ah al-ammah and relevance with Maqashid al-syari’ah al-khashshah )Pembagian kewarisan secara kekeluargaan seringkali dianggap tidak sesuai dengan syari’ah Islam oleh umat Islam, tetapi dalam waktu yang bersamaan realitas menunjukkan bahwa hukum kewarisan Islam tidak agi sejalan dengan semangat keadilan masyarakat Indonesia, sehingga tidak sedikit umat Islam yang meninggalkannya. Atas dasar ketertarikan penulis kepada model sistem pembagian kewarisan yang berbasis kekeluargaan tersebut, penelitian ini hendak mengkaji tentang konsep kewarisan bilateral dalam kacamata Maqashid al-Syari’ah. Penelitian ini difokuskan untuk menjawab pertanyaan Apakah pola pembagian kewarisan bilateral mencerminkan prinsip-prinsip Maqashid al-Syari’ah' Penelitian ini adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, konseptual dan perbandingan.  Hasil penelitian ini adalah sistem pembagian kewarisan bilateral memiliki relevansi dengan maqashid al-syariah al-ammah (kemaslahatan, keadilan dan kesetaraan) dan juga maqashid al-syariah al-khashshah (hifdz al-din, hifdz al-nafs dan hifdz al-nasab)
