      Near death experiences and the wisdom they produce are the stuff of countless novels, but when the story ends in the author's death, where is wisdom to be found' American neurosurgeon Paul Kalanithi has left an astonishingly eloquent and lucid account of his own dying and his inner journey to find meaning and even peace in that experience. As inspiring as it is tragic, "When Breath Becomes Air" rightly sits on The New York Times list of best sellers, and is a must-read for anyone working in bioethics or health care.

  • Volume 22 Issue 2 - Community attitudes shape palliative care: Seeking a
           resolve to the slippery slope effect

      As part of the Inquiry into End of Life Choices (The Inquiry), commissioned by the Victorian State Government on 7 May 2015, members of the community were invited to share their attitudes towards assisted dying by written submissions. The Inquiry also hosted a panel discussion with a few selected respondents. The final report prepared by the Inquiry is a comprehensive document that identified common themes relating to the benefits and concerns about a possible assisted dying framework. Some respondents used the opportunity to advocate in favour of palliative care services and advance care planning. There were other respondents that were apprehensive about possible changes to the law and wary that it could incite permissible practices of assisted death in Victoria which are in contradiction to existing ethical beliefs, values and norms. Their anxiety was in relation to a potential slippery slope effect of these laws in the future. In this article I will explore how the slippery slope effect has been used to criticise euthanasia legislation, using data from the Netherlands. Although there are indications that the slippery slope is apparent in the Netherlands, there are also contrary indications that are otherwise open for interpretation. I propose that the Inquiry was a valuable opportunity to reflect on community attitudes towards assisted death and that the recommendations to better resource palliative care services, is a positive outcome.

      Christmas is a special time in the Christian calendar. The Christmas story begins with a heavily pregnant Mary riding on the back of a donkey alongside her husband into the city of Bethlehem. Their search for board to see them till the morning is futile. A somewhat kind Inn keeper shows them to his stable, where the animals are accommodated.. That night Mary gives birth to baby Jesus and she lays the newborn down in a manger. The Inn is symbolic of prosperity for those fortunate to share in its comforts. To have to reside instead in the stable reflects that there is not space in the Inn and some people, for not immediately apparent reasons, live on the outside.

      The Caroline Chisholm Centre for Health Ethics1 was established through the collaboration of private catholic hospitals in Victoria, namely: Cabrini Health, Calvary Health Care Bethlehem, Caritas Christi Hospice, Mercy Hospital for Women, Mercy Werribee Hospital, Mercy Palliative Care, St John of God Health Care (Victoria), St Vincent's Hospital Melbourne, and St Vincent's Private Hospital Melbourne. Our role is to develop, review and respond to policies and procedures affecting Catholic Health Care; provide educational resources and formation in ethics and offer ethics consultation and advisement. The Chisholm Health Ethics Bulletin is our quarterly publication that reports on ethical issues arising in health care as well as literature reviews of pertinent research topics that effect national and international interests.

      Advance care planning is a significant and important process of end-of-life care. It provides the opportunity for persons to express their medical treatment preferences prior to losing the capacity to decide for themselves. It also allows for the appointment of substituted decision maker(s) to make medical decisions for persons who have lost capacity. Whilst advance care planning can be beneficial when it is used effectively, the legislative framework surrounding advance care planning is complex and confusing. This brief article will summarise advance care planning, its current legislative framework in Victoria and how proposed recommendations offered by the Inquiry into end of life choices may simplify advance care planning.

      Christine Bryden is a survivor of dementia and has been a passionate advocate for persons with dementia for more than 20 years. She has written 4 books. Her latest 2 books - Before I Forget and Nothing About Us, Without us! - give an insider's perspective into the lived experience of a person with dementia. This article provides a review of these 2 books which detail Christine Bryden's life story, and in doing so, highlight some of the key messages expressed by the author. These key messages include examining the various misconceptions about persons with dementia, the required care for persons with dementia, as well as the need for building a dementia-friendly society.

  • Volume 21 Issue 4 - Making sense of a wish to hasten death

      How should health professionals respond if a patient nearing the end of life expresses a wish to hasten their death? To answer this question, this article draws upon peer‐reviewed literature, the practices of palliative care, and the experiences of two palliative care physicians, Associate Professor Natasha Michael and Associate Professor Mark Boughey. The expression of a wish to hasten death does not necessarily imply a genuine desire to hasten death or to be helped to die. To the contrary, almost always this means that the patient has been overwhelmed by one or more serious concerns. While inadequate pain relief may be one such factor, more typically these concerns are social and spiritual, such as loneliness, social isolation, feeling oneself to be a burden on others, hopelessness, and fears about the process of dying. If a patient expresses a wish to hasten death, health professionals should therefore discuss with them the reasons for this request, and then devise and effectively communicate an individualised care plan which begins to address these concerns.

  • Volume 21 Issue 4 - An overview of the proposed Victorian recommendation
           for assisted dying and its consequences

      A recent report tabled in the Victorian Parliament has proposed that the Victorian Crimes Act 1958 be amended, allowing Victoria to become the only Australian state where euthanasia would be legal. Against this proposed legislation, this article contends the suggested amendments pose a threat to the fiduciary obligations that medical professionals owe to their patients. Moreover, that the parliamentary recommendation poses a considerable risk to the sick and dying, while creating tension within existing, currently overburdened, palliative care services. Any reforms that seek to treat dying patients in a more holistic manner, incorporating their emotional equilibrium, will instead make further provision for expanding the provision of palliative care services.

      This article reviews Exploring the Connections: Catholic social teaching and the social determinants of health, edited by Martin Laverty and Liz Callaghan. The social determinants of health are "those conditions in which we live, grow and age, that can affect our health and well-being." Catholic social teaching is "the Church's teaching about the ordering of life in society and about the attainment of individual and social justice." "It comprises theological and philosophical traditions from biblical and ancient sources taken up and developed throughout the Christian era." This book draws on both concepts to fashion a health care resource that will add to our knowledge and understanding of the lived experiences of disadvantaged people, and - more importantly - our appreciation of ways in which this disadvantage can be overcome.

  • Volume 21 Issue 3 - Victoria's Powers of Attorney Act 2014: Promoting the
           rights of persons with impaired decision-making capacity

      Victoria's new Powers of Attorney Act 2014 came into operation on 1 September 2015. Following recommendations by the Victorian Parliament Law Reform Committee (VPLRC), changes have been introduced in the new Act to simplify the process of making an enduring power of attorney (non-medical). Reforms include the addition of a section on capacity, the introduction of a supportive attorney role distinct from the enduring power of attorney role, and the enhancement of safeguards. This article analyses how the new Powers of Attorney Act 2014 empowers persons with impaired decision-making capacity and also strengthens the mechanisms which protect them from abuse.

      This exploration of business ethics is based on the fifth edition of Business Ethics by Damian Grace and Stephen Cohen. Against the view that business is an ethics-free zone, it argues that for almost all of us, there is an important place for ethics in business. Against the view of neoliberalism or economic rationalism that free and unfettered markets necessarily bring about fairness, it argues that there is a place for government regulation of business. This article also includes material on a number of other topics including ethics in advertising, ethics in the professions, environmental responsibility, and supporting an ethical culture in organisations through codes of ethics and codes of conduct.
