  • Inequality, Human Rights, and the New International Economic Order
    • Abstract: Global inequality was a major concern to the “new states” that won their independence in the years following the Second World War. Indeed, the New International Economic Order (NIEO)—the campaign of those states to reform the international system—was directed very much at addressing the problem of inequality.1 In a major speech that was part of the campaign for a NIEO, the Senegalese foreign minister, Doudou Thiam, pointed out the extent of that inequality and the alarming fact that it is was intensifying. With regard to the share of global income between developed and underdeveloped countries, he noted that “in 1938 the income disparity was 15:1;by 1966 it was 35:1, and it is projected to be 40:1 by 2000.”2In an ... • Human Rights in an Unequal World: Structural Inequalities and the
           Imperative for Global Cooperation
    • Abstract: Efforts to realize social and economic rights, such as the rights to food, housing, an adequate standard of living, health, and education, are currently taking place in an extremely polarized world. At the global level, inequalities of income and wealth are substantial. According to estimates by Oxfam, in 2015, the sixty-two richest people owned as much wealth as the bottom half of the world’s population.1 Similar estimates from 2010 suggested that it took 388 of the wealthiest individuals to own as much as the bottom half.2 Although the rapid growth of countries like India and China has narrowed the gap in average incomes between some high-performing developing economies and the high-income world, income ... • Beyond and Against the State: Anarchist Contributions to Human Rights
           History and Theory
    • Abstract: What do anarchists have to do with human rights' What possible connection could exist between the “shadowy bombers” who stalked the Western elite at the turn of the twentieth century, and what is arguably the modern doctrine of human equality' Though they have been maligned by historians across the political spectrum as the violent, “primitive” revolutionaries that the expansion of trade unionism and social democracy failed to tame, I argue that anarchists played a central role in the development of human rights at the turn of the twentieth century. As activists involved in a number of transnational campaigns, they were actually among the first to articulate a vision of human rights beyond the state. As theorists ... Read More

  • Introduction: Human Rights and Economic Inequality
    • Abstract: Socioeconomic inequality has been called “the defining challenge of our time,” and “the root of all social evil.”1 Inequalities in income and wealth are growing, and quite clearly affect human rights. They powerfully determine who can avoid harm and reap profits from human rights violations as well as who will bear the cost of and suffer from ongoing harms. But might human rights also affect persistent inequalities' Might they provide useful tools for ameliorating economic inequality' Might they sometimes exacerbate it'These are some of the questions we posed to the interdisciplinary group of contributors to this dossier.2 We acknowledged that international human rights law and discourse have long focused, at least ... • Taxation and Equality: The Implications for Redressing Inequality and the
           Promotion of Human Rights
    • Abstract: Imagine if we were employing thousands of people in Wall Street to travel around the U.S. and developing countries and actually physically destroy public buildings, schools, and hospitals, or sack teachers and nurses. There would be an outcry—and people would say they are violating the human rights of those affected. Yet that is what is going on day in day out in these tall glass towers full of diligent accountants, lawyers, and bankers . . . employed to help the world’s most powerful companies and individuals avoid paying their fair share.1This essay focuses exclusively on the role of taxation in the redress of growing global inequality. It does so for three reasons. Firstly, the gradual development of less ... Read More

  • Righting Inequality: Human Rights Responses to Economic Inequality in the
           United Nations
    • Abstract: This essay excavates an often-forgotten history of engagement by United Nations (UN) human rights bodies with the problem of economic inequality. Retrieving these forgotten struggles and alternative conceptions and formulations of rights might provide impetus for reimagining the more redistributive possibilities for human rights in the present. Currently, it is sometimes suggested that the “human rights community has paid very little attention to economic inequality,” and that “gross inequalities in economic status remain largely unchallenged by human rights law and advocacy.”1 By considering the ways in which institutional debates within the UN have grappled in different periods with the problem of economic ... • Global Inequality and Human Rights: An Odd Couple
    • Abstract: Ever since the emphasis on economic globalization in the 1990s, there has been a technical awareness among economists that growth patterns were accentuating income inequality in the United States, and in most other prosperous and rapidly developing countries in the world. This trend did not cause any significant political backlash so long as the national and global economies were experiencing satisfactory rates of overall economic growth. This changed when national economies in the North, and especially the United States, hit a series of bumps in the road with respect to growth—culminating in the Great Recession of 2008. In this period—roughly correlated to the years since the turn of the century—inequality ... Read More

  • Inequality, Debt, and Human Rights: What Can We Learn from the Data'
    • Abstract: What can we learn from the data on economic inequality' The first important rule is that comparisons should be made very carefully. A second is that one should be very cautious about reifying inequality statistics as social indicators. Much of what is available in the international information set is either not reliable or involves noncomparable concepts. For instance—an example taken from the real world—if you see a table in which India has an inequality measure similar to that of Spain, you know something is wrong. India is not as egalitarian as Spain.1But even with reliable figures, the psychological and social effects of inequality depend upon the frame of reference of the individuals involved. These may ... • The Imperative of Redistribution in an Age of Ecological Overshoot: Human
           Rights and Global Inequality
    • Abstract: We live in a world characterized by extreme economic inequality. The world’s forty-two richest people hold more wealth than the poorest half of the human population.1 Meanwhile, the real per-capita income gap between the Global North and the Global South has more than tripled since 1960.2 While inequality is now widely recognized as a problem, legal scholars worry that our existing human rights framework offers little leverage against it. Philip Alston, the United Nations Special Rapporteur on extreme poverty and human rights, drew this conclusion in his 2015 report to the UN General Assembly: “At present, there is no explicitly stated right to equality, as such, under international human rights law.”3 He notes ... • “I Don’t Want to Live in a World Where People Die Every Day Simply
Because They Are Poor”: From the Treatment Action Campaign to Equal
Education, from Stories of Human Rights to the Poetics of Inequality
    • Abstract: In this essay, I will walk us briefly through the shared history of two important current South African NGOs, the “Treatment Action Campaign (TAC)” and “Equal Education,” suggesting some of the ways in which they produce a version of politics within a liberal democratic imaginary that straddles human rights and economic equality/inequality arguments and associated practices.1 My empirically impossible hunch is that, in an era of compounding interregnums of varying intensities and durations, the problem of justice in a range of global and national political imaginaries is caught between a human rights hegemony and one that embraces questions of global and national economic inequality as its organizing frame. Both ... Read More

  • Saving the Slaving Child: Domestic Work, Labor Trafficking, and the
           Politics of Rescue in India
    • Abstract: Domestic labor has had a long, enduring history in India. Vital to the homes and lives of the middle and upper classes, domestic labor has persisted through changing expectations and structures of modernity, of caste and class relations, and of domestic spaces.1 In the past few years, antitrafficking and child rights NGOs in New Delhi, working closely with state agencies, have drawn attention to the exploitative dimensions of domestic labor by rescuing impoverished young rural migrants (especially girls) brought by unregulated “placement agencies” to work in urban households. These NGOs increasingly articulate concerns around labor exploitation in the language of human trafficking and “modern-day slavery” employed ... Read More

  • Inequality, Human Rights, and Social Rights: Tensions and
           Complementarities
    • Abstract: The unprecedented widening of economic inequality in most advanced and emerging markets in the last decades has been recognized by some political leaders—like former president of the United States Barack Obama—and multilateral institutions as a great challenge of our time.1 A consensus is also emerging among scholars that while some degree of economic inequality may not be a problem—insofar as it provides positive incentives to foster individual efforts and economic growth—high and sustained levels of inequality entail large and undesirable social costs.2 Increasing economic inequalities have also fostered the rise of populist leaders who paradoxically champion economic policies that favor economic elites and ...
